As you know, the Vail Town Council "called up" the Oesign dqit{,* doard (DRB) approval of
the Cornice Building temporary site development sigs. The reasb$for the Town Council "call
up" was related to the placement of the sigu without Town of Vailgpproval. At the May 2,1995
evening Town Council meeting, the council members unanimouslf lotoa to overtum the DRB
approval ofApril 19, 1995. \
Therefore, the temporary site development sign proposed for the Comice Building is uol
apgroved and cannot be displayed on the property. The Town Council stated their reasons for
overtuming the approval of the DRB was because the sign had already been up for approximately
six months and tbat the project was no longer under constuction, and therefore, uo longer met
the intent of the sign code.

On Thursday, Apnlz7,1995, staffnotified the applicant, Carol Duddy of Slifer, Smith and
Frampton/Vail Associates Real Estate, that the Vail Town Council desired to review the Design
Review Board's April 19, 1995, approval of the new temporary site development sign for the
Cornice Building located at 362 Vail Valley Drive. Staffindicated to the applicant that the Town
Council "call up" was related to the unauthorized placement of the sign prior to receiving DRB
approval. AdditionallS the Council expressed a desire to amend the Desigrr Rwiew Board's
condition that the temporary site dwelopment sigr be removed no later than one year from the
date of Design Review Board approval. The Council felt it may be more appropriate to limit the
length of the display of the sign to six months since it had been up for six months prior to
receiving proper Town of Vail approval.
Pursuant to Section 16.20.160, a temporary site dwelopment sign shall be permitted in a special
dwelopment district to indicate or identiff a development ofreal property under construction (see
arached).

Tcmporary site development signs shall bc regulated as
follows:
A. Purpose. to indicare or identify a developmcnt of rcal
property under consrrucrion in H D M F, PA. CSC. CC I , CC2.
SD. MDMF, LDMF, and RC zones;
B. Size shall not exceed twenty squars feet, with a horizontal
dimcnsion no greater than ten feet. Combincd maximum area
for more than onc sign shall nor cxceed twcnry squarc feet:
C. Height, the top of a freestanding sign shall be no higher than
cight fect from gradc. The top of a wall-mounred sign shall be
no highqr than twenty-five feet from existing grade:

BACKGROUND RATTONALE: Town Courrcil directed Town stafi to work wilh
FirslBank of Vail, devetop a program that will povide bans for pdmary residential
property for employees. The property shall be located within the Town ol Vail and
tavorable loan terms will be made available by the Town's pledge ol tunds in the
amount ot ten (10%) percenl of the purchase price ot the individual prop€nies.
The properties will be subieci to deed restrictions whbh will guarantee that the
properties remain avaihble for residential use by employees.

BACKGROUND BATION At the Aprit 25, 1995, Town Council meeting the
Town Courcil mernbers unaninpusly approved a nEtbn lo call up the DRB
approval of a new temporary site development sign al the Comice Building. The
temporary site development sign was unanimously approved by the DRB on April
19, 1995. The approval trom the DRB carried with it two conditions:
1) The sign be set in the ground on posts rather than a moveable slructure as
currently designed, and

information required:
1. please resubmit two sets of plans indicating the exact placement ol the gate
pillars completely on the property.

Municipal Code. The gate itself, located between the two supporting columns

Attached you-will find two copies of a revised site plan. This plan indicates the placement
of the gate columns on the Comice Building property.

As per our discussion last week, portions ofthe gate and a short section offence between

With the Council's acceptance of the Racquet Club unit, we have satisfied all conditions of
approval required by the SDD ordinance. Three issues that need to be addressed are the
Revocable Righr-of-Way Permit, the drainage easement and the Public Way Pennit. As per our
discussion, the building permit for the Comice Building will be available lor issuance or
Wednesday, May 25 with the following understanding:
l) The Revocable Right-of-Way Permit has been submitted to Greg Hall. It is anticipated
that Greg will review and execute this agreement on Wednesday.
2) The Public Way Permit application will be submitted to the Town within one week from
the date the building permit is issued. It is understood that if the permit application is not
submitted, the Town may issue a stop work order on the project. I have asked Gary
Bossow to contact Charlie Davis directlv to deal with this matter.

DRAINAGE EASEMENT AGREEMENT
THls DRAINAGE EASEMENT AGREEMENT (the Easement") is made and entered into

and the TOWN OF VAIL, a Colorado municipal corporation ("the Town"), collectively referred to
the "Parties".
WITNESSETH:
For and in consideration of Ten and No/l00 Dollars ($10.00) and the mutual @venants
hereinafter expressed, the Grantor grants to the Town a perpetual drainage easement upon he
properties described in Exhibit'A" attached hereto and incorporated herein by this reference, the
("Servient Tenement') and as described, shown and depicted in Exhibit "8" attached hereto and
incorporated herein by this reference, (the "Easement parcel.);
TO HAVE AND TO HOLD, for the punose of constructing, maintaining, and repairing the
following improvements under the Easement Parcel, to wit, drainaqe facility for the conveyance
of watsr run-off.
The Grantor and the Town mutuallv covenant and aqree:
1. The Grantor shall have the right to utilize the Easement Parcel for any and all
purposes not inconsistent with the rights and privileges herein granted to the Town, including but
not limited to the right to place improvements other than buildings or retaining wal6 on the
Easement Parcel.
2- Grantee shall engineer and construct a suitable underground storm sewer system
upon the Easement Parcel for water run-off (the "Run-Off System',).
3. This Easement does not and is not intended to grant any access to the Easement
Parcel to the general Public.
4' After construction of the Run-Off System is completed, the Town shall repair and
maintain, in a proper, substantial, and workmanlike manner, the Run-Off System. The Town Shall
install and maintain the Run-Off System without disturbing the rest of the Servient parcel or uses
of the Oamers thereof.
5. The Town shall indemnify the Grantor, defend and hold the Grantor harmless
against all liability, loss or expense for any claim of injuries to persons or damaged property
arising out of the construction, use, or maintenance of said Easement parcel, unless the claim
arises out of the use or maintenance of the Easement Parcel, by the Grantor, his agents, or
employees.
6. This easement shall be perpetual and shall run with the land.
7 - The parties agree that this Agreement contains the entire understanding and
agreement between the Parties and cannot be amended, modified or supplemented in any way,
except by written agreement executed by all Parties and duly recorded in the office of the Clerk
and Recorder of Eagle County, State of Colorado.
8. This agreement shall be governed by the laws of the state of colorado.
9. lf any provision of this Easement shall be held invalid, illegal or unenforceable, it
shall not affect or impair the validity, legality, or enforceability of any other provision of this
Easement Agreement, and ftere shall be substituted for the atfected provision(s) a valid and
enforceable provision(s) as similar as possible to the affective provision(s).
10. This Easement Agreement may be executed in counterparts with the same effect
as if all the parties had executed the same instrument.

Dear Gary:
The purpose of this letter is to relay comments from the Town Engineer regarding the drafi
drainage easement you have provided for Town review. The Town Engineer would like to
have changes made to the drainage easement as identified on the attached copies. Pages 1
and 2 simply have a few typos to be changed. However, Exhibit A and Exhibit B will need to
be changed for the purpose ol providing additional width to your proposed drainage easement.
As you know, the SDD for the Cornice Building was approved on April 5, 1994 by Ordinance
No. 7, Series of 1994. Section Vl ol that ordinance slates that the developer, jointly and
severally, agrees with the following requirements, which are a part of the Town's approval of
the establishment of this SDD No. 32:
'2. The applicant shall provide a drainage easement to the Town in order to
provide for the maintenance of the existing storm water drainage system
located on the western end of this property. The location and width of
the easement will be determined bv the Town Enoineer."
Please amend your proposed drainage easement to provide for the width and location
determined by the Town Engineer and resubmit a copy for linal review and approval. This
easement must be completed and recorded prior to the issuance of a Temporary Certificate of
Occupancy (TCO) for the Cornice Building.

RE: Comments regarding the Cornice Building 352 Vall Valley Drive

The following observations have been made with regard to the Comice Building propefy that are
of concern to the staff and I thougbt it would be helpful to make you aware of these concerns
earlier rather than later, so that they may be resolved well before you wish to obtain a Temporary
Certificate of Occupancy (TCO) for the building. Staff s concems are as follows:
l Ordinance number 9, Series of 1993 (the Town of Vail Lighting Ordinance) allows for a
maximum number of exterior light fixtures on a parcel of properly at a ratio of one fixture
for each 1,000 square feet of lot area. Since the Comice Building property is 3,659 square
feet in size, the maximum number of exterior light fixtures allowed on the entire property
is four. The lighting ordinance also specifies that no fxtures may be installed without
prior town review and approval, so that staffmay verifu that all fixtures comply with the
specifications outlined in the ordinance.
The elevation drawings for the Comice Building which were presented to the Planning and
Environmental Commission (PEC), Town Council, and Design Review Board (DRB), as
well as the elevafion drawings submitted for a building permit, all showed one exterior
light frxture located on the west side of the building, directly above the entry stairs. On
November 16, 1994 you received DRB approval for a gate at the driveway entrance to the
property. This approval also included two pedestal lights on the supporting columns of
the gate. Therefore, to date, lfuee exterior light fixtures have been approved on the
Comice Building property. There appears to be at least thirteen exterior light fixtures on
the building. Obviously, all of these fixtures, with the exception ofthree which have
received prior approval, must be removed before a TCO can be granted for the building.
Staff would like to receive information detailing how the wall zurfaces are to be finished
once the unauthorized fixtures are removed. Additionally, none of the three approved
light fixtures on the property resemble the style of the fixtures previously approved by the
DRB.

2. The second issue which I would like to bring to your attention has to do with the fcnce
located along the south and east sides ofyour property. As shown on the attached copy
ofyour approvod landscape plan, the fence is required to turn north and extend
apiroximately l0 feet along your eastem property line. This portion of the fence was
t.qitra by the PEC in ordiito give the appearance that all of the propeny immediately
east ofthe fence is not privately owned, and is open to the public'
During a site visit to the property on November 16, 1994,the DRB noted that the fence
did not wrap around th" "asi"* side ofthe property, as indicated on the approved plans,
and attached a condition to their approval ofthe new gate that the fence be finished as
drawn on the original plans. (See-attached copy of the lcttcr from George Ruther, which
indicates this DRB conaition.; Since the general contractor for this project has been made
aware of the requiranent to complete this portion of the fence, both in November of 1994
and by way of a copy of this letter, I would like to be clear that no TCO will be granted
for the property *til thut portion of the fence is completed per the approved drawings.
Obviously thcre are other elcments of the Comice Building redevelopment that af,e as yet
unfrnished (i.e. landscaping addition of bench on propelty to the east, etc.) However, the above
items are especially of concem to staffand I thought it would be helpful to make you aware of
them well before you desire a TCO for the building. lf you should need further clarification of the

Scope: Work includes furnishing all

Preparation of roof deck: Roof deck
shall be well seasoned plywood or hori-
zontal tongue-and-groove boards, laid
tightly together and securely nailed.
Plywood shall be 1/2" minimum thick-
ness for rafters spaced up to 20'and
5/8" minimum for rafters spaced 24'.
Application directly over roof iniulation5
or other similar type decks is not
recommended.
The roofing contractor shall examine all
roof decks on which this work is to be
applied and shall notify the architect in
writing prior to starting work of any
defects which are considered detri-
mental to the proper installation of
these materials.
PART 2 - PRODUCI
CP/Components, Parts
Underlayment: Roof slopes of 5" per
foot or more shall use a minimum of
two layers of '15lb. asphalt-saturated
roofing felt (or better) with a minimum
2" headlap and 4" side lap. For roof
inclines of 3" - 5' per foot, double the
underlayment. On roof slopes under 3i
use shingles for design purposes only
over a built-up (flat deck) roofing
svstem.
Fasteners:
. Naib-5hall be standard hot-dipped
galvanized needle-point roofing nails
(or better) with 3/8" flat head. Nails
should be of sufficient length to pene-
trate sheathing so just the tip of the nail
is visible from the underside of the
deck, DO NOT OVERNAIL.
. Storm Anchors - When necessary, shall
be copper, approximately 7/8" long,
with a flat base.
Flashing: 5hall be non-corrodible
metal (choice is dependent on local
conditions - in some areas copperwill
cause water run-off stains) not less than
25 gauge.

Installation: All roofing products shall
be installed in accordance with supra-
dur's complete application instructions
provided with each shipment (also
available upon request). To ensure a
random color distribution. shuffle
shingles, as explained within applica-
tion instructions. Allshingles shall be
from the same batch number:
Storage: All shingles shall be protected
from the weather prior to installation.
KEEP SHINGLE5 CLEAN AND DRY,
covered and high enough off the
ground to prevent moisture seepage
from below. In areas of high humidity, it
is recommended that the plastic wrap in
which individualbundles are oacked be
split to allow for ventilation and to pre-
vent excess water condensation. A
covering shall protect shingles after the
bund les have been ooened.

Gentlemen:
As requested, a representative of Hepworth-Pawlak Geotecbnical, Inc. observed the
excavation at the subject site on June 8 and 10, 1994 to evaluate the_soils exposed for
foundation support. The findings of our work and recommendations for the foundation
design are presented in this report. The work was done as requested by you on June 7,
1994.
The residence will be two stories above a crawl space. The deeper cut area will retain
up to 7 feet of earth. Spread footings have been assumed for support of the structure.
At the time of our visit to the site, the foundation excavation had been cut in two levels
from 3 to 6 feet below the adjacent ground surface. The soils exposed in the bottom of
the excavation consisted ofbrown silty sand and gravel with cobbles at the upper level
and red silty sand with gravel at the lower level. The previous building foundation and
debris had been removed from the site except for some concrete and backf,rll exposed in
the south bank of the lower excavation level. The soils appeared medium dense except
for the concrete debris laden backfill. No free water was encountered in the excavation
and the soils were slightly moist to moist.
The site has been graded for various site improvements and generally appears to have
been filled above the natural red sands and gravels. Considering the conditions exposed
in the excavation and the nature ofthe proposed construction, spread footings placed on
the sand and gravel soil designed for an allowable soil bearing pressure of2,000 psf
should be adequate for support of the proposed residence. Footings should be a
minimum width of 16 inches for continuous walls and 2 feet for columns. The concrete
debris should be removed. This will require lowering the proposed interior pad down
to the red sand and gravel soils. Exterior footings should be provided with adequate
soil cover above their bearing elevations for frost protection. Continuous foundation
walls should be reinforced top and bottom to span local anomalies such as by assuming
an unsupported length of at least 10 feet. Foundation walls acting as retaining structures
should be designed to resist a lateral eartl pressure based on an equivalent fluid unit
weight of at least 45 pcf for on-site sand and gravel soil backfill. A perimeter
foundation drain should be provided to prevent temporary buildup of hydrostatic
pressure behind the walls and prevent wetting of the lower level. Structural fill placed
within floor slab areas can consist of the on-site soils compacted to at least 95% of

standard Proctor density at a moisture content near optimum, Backfill placed around the
structure should be compacted and the surface graded to prevent ponding within at least
10 feet of the building.
The recommendations submitted in this letter are based on our observation of the soils
exposed within the foundation excavation and do not include subsurface exploration to
evaluate the subsurface conditions within the loaded depth of foundation influence. This
study is based on the assurnption that soils beneath the footings have equal or better
support than those exposed. The risk of foundation movement may be greater than
indicated in this report because of possible variations in the subsurface conditions. In
order to reveal the nature and extent of variations in the subsurface conditions below the
excavation, drilling would be required. It is possible the data obtained by subsurface
exploration could change the recommendations contained in this letter.
