Applicant Vail Resorts, represented by Braun Associates, Inc.Planner: Bill Gibson ll. SUMMARY The applicant, Vail Resorts, represented by Braun Associates, Inc., is requesting a conditional use permit pursuant to Section 12^7H-3, Permitted and Conditional Uses; First Floor or Street Level, Vail Town Code, to allow for a "temporary business office" located at 450 East Lionshead Circle (Treetops commercial building/Lot 6, Vail Lionshead Filing 1. This conditional use permit request will allow for the relocation of Vail Resort's existing mountain operations offices from the Gondola Building, which will be displaced by the construction of the Lionshead Core Site development, to the currently unoccupied retail spaces on the first-floor of the Treetops commercial building (former Verbatum and VBS, Vail Bike Service, locations). Based upon Staff's review of the criteria outlined in Section Vlll of this memorandum and the evidence and testimony presented, the Community Development Department recommends approval, with conditions, of this request subject to the findings and conditions noted in Section lX of this memorandum. DESCRIPTION OF THE REQUEST Vail Resorts is requesting a conditional use permit to allow for the conversion of existing vacant retail space within the Treetops commercial building into a'temporary business office" for employees directly related to Vail Resorts' operation of Vail Mountain; administration, snowmaking, mountain operations, ski school, marketing, and other similar positions. The existing empty retail spaces will be remodeled as a "temporaty busrness office". oTemporary business offces" are allowed as conditional uses on the first-floor or street level of a building in the Lionshead Mixed Use l(LMU-1) District pursuant to Ordinance No. 26, Series of 2004. This conversion, if approved, will be allowed for up to three years from the date of approval and will require annual review by the Planning and Environmental Commission. These 'temporary office uses"are intended to be permanently relocated to the new Core Site Hotel and/or North Day Lot office building. Therefore, this conditional use permit will expire upon the issuance of a temporary or final Certificate of Occupancy for the Lionshead Core Site Hotel or the North Dav Lot office buildino. I ll. There is no Design Review Board proposal related to the request. A vicinity map (Attachment A), the applicant's request (Attachment B), and architectural floor plans (Attachment C) have been attached for reference. BACKGROUND On November 16, 2004, the Vail Town Council adopted Ordinance No. 26, Series of 2004, to allow "Temporary Business Offices" on the first-floor of buildings within the Lionshead Mixed Use 1 zone district. The purpose of this ordinance is to allow existing Lionshead area office uses, which are displaced by the construction of redevelopment projects, to be temporarily relocated within the Lionshead area. REVIEWING BOARD ROLES Order of Review: Generally, applications will be reviewed first by the PEC for acceptabili$ of use and then by the DRB for compliance of proposed buildings and site planning. Planninq and Environmental Commission: The PECis responsrb/e for final approval, approval with modifications, or denial of CUP. Desiqn Review Board: The DRB has NO review authority on a CUP, but must review any accompanying DRB application. Town Council: Actions of DRB or PEC maybe appealed to the Town Council or by the Town Council. Town Council evaluates whether or not the PEC or DRB erred with approvals or denials and can uphold, uphold with modifications, or overturn the board's decision. Staff: The staff is responsible for ensuring that all submittal requirements are provided and plans conform to the technical requirements of the Zoning Regulations. The staff also advises the applicant as to compliance with the design guidelines. Staff provides a staff memo containing background on the property and provides a stalf evaluation of the project with respect to the required criteria and findings, and a recommendation on approval, approval with conditions, or denial. Staff also facilitates the review orocess. APPLICABLE PLANNING DOCUMENiS A. General: These regulations are enacted for the purpose of promoting the health, safety, morals, and general welfare af the Town, and to promote the coordinated and harmonious development of the Town in a manner that will conserve and enhance its natural environment and its established character as a resort and residential community of high quality. lv. CHAPTER 12-2, DEFINITIONS (in part) Secfirrn 1 2-2-2: Definitions OFFICE, TEMPORARY BUS/NESS: An office for the conduct of general busr''ness and service activities far a duration of time not to exceed three (3) years, subject to an annual review by the Planning and Environmental Commission to vertfy the applicant's compliance with the conditions of approval, to accommodate the displacement of an existing office in the Town of Vail due to redevelopment for insurance agents, brokers, secretarial or stenographic servrceg or offices for general busrness activities and transactions, where sforage, sale, or display of merchandise on the premises occupies /ess than fen percent (10%) of the floor area. A temporary business office shall not include offices of real esfates agenfs. The applicant shall demonstrate to the Planning and Environmental Commission that an existing retail business is nof involuntarily displaced by a Temporary Busrness Offce. ARTICLE 12-7H: LIONSHEAD MIXED USE 1 (LMU-I) DISTRICT (in part) Secfion 1 2-7H-1 : Purpose: The Lianshead Mixed Use 1 District is intended to provide sltes for a mixture of multiple-family dwellings, lodges, hotels, fractional fee clubs, time shareg /odge dwelling units, restauranfs, offices, skier seruhes, and commercial establishments in a clustered, unified developmenL Lionshead Mixed Use 1 District, in accordance with the Lionshead Redevelopment Master Plan; is intended to ensure adequate light, air, open space and other amenities apprcpriate to the permitted flzpes of buildings and uses and to maintain the desirable qualities of the District by establishing appropriate site development standards. This District is meant to encourage and provide incentives for redevelopment in accordance with the Lionshead Redevelopment Master Plan. This Zone District was specifically developed to provide incentives for propefties to redevelop. The ultimate goal of these incentives r.s to creafe an economically vibrant lodging, housing, and commercial core area. The incentives in this Zone District include rncreases in allowable gross residential floor area, building height, and density over the previously established zoning in the Lionshead Redevelopment Master PIan study area. The primary goal of the incentives is to create economic conditians favorable to inducing private redevelopment conslsfent with the Lionshead Redevelopment Master Plan. Additionally, the incentives are created to help finance public off-site improvements adjacent to redevelopment projects. With any development/redevelopment proposal taking advantage of the incentives created herein, the following amenities will be evaluated: sfreefscape improvements, pedestrian/bicycle access, public plaza redevelopment, public art, roadway improvements, and similar improvements. Secfrbn 12-7H-3: Permitted and Conditional Uses; First Floor or Street Level: A. Definitian: The "first floor" or "street level" shall be defined as that floor of the building that rs /ocafed at grade or street level alang a pedestrianway. C. Conditional Uses; The following uses sha// be permifted on the first floor or street level floor within a structure, sub1'ecf fo issuance of a conditional use permit in accordance with the protzlsrons of chapter 16 of this title: Barbershops, beauty shops and beauty parlors. Conference facilities and meeting rooms. Financial institutions, other than banks. Liquor stores. Lodges and accommodation units. Multiple-family residential dwelling units, timeshare units, fractional fee clubs, lodge dwelling units, and employee housing units (type lll (EHU) as provided in chapter 13 of this title). Tem porary Basiness Office Additional uses determined to be similar to conditional uses described in fhis subsecfion, in accordance with the provisions of section 12-3-4 of this tiUe. Chapter 12-16; CONDITIONAL USES PERMITS (in part) Sec&bn 12-16-1 : Purpose; Limitations In order to provide the flexibility necessary to achieve the objectives of this title, specified uses are permitted in ceftain districts subject to the granting of a conditional use permiL Eecause of their unusual or special characteristics, conditional uses regur're review so that they may be located properly with respect to the purposes of fhr's title and with respect to their effects on surrounding propefties. The review process prescribed in this chapter is intended to assure compatibility and harmonious developmerlt between conditional uses and surrounding prcperties in the Town at large.' Uses /r'sted as conditional uses rn the various dlsfrlcts may be permitted subjecf to such conditions and limitations as the Town may prescribe to insure that the location and operation of the conditional uses will be in accordance with the development objectives of the Town and will not be detrimental to other uses or properties. Where conditions cannot be dewsed, to achieve these objectives, applications for conditional use permits shall be denied. B. Lionshead Redevelopment Master Plan The Treetop building is also governed by the development objectives as stated in the Lionshead Redevelopment Master Plan. Of the six Policy Objectives outlined in the Lionshead Redevelopment Master Plan, staff has identified the following objective as applicable to this proposal: 2.3.1 Renewal and Redevelopment Lionshead can and should be renewed and redevelopment to become a warmer, mare vibrant environment for guests and resrdents. Lionshead needs an appealing and coherent identity, a senss of place, a personality, a purpose, and an improved aesfhefic character. 2.3.2 Viklitv and Amenities We must seize the opportunity to enhance guest experience and communi$ interaction through expanded and additional activities and amenities such as performing aft venues, conference facilities, ice rinks, sfreefscape, parks and othe r recre atio n a I im p rovem e nts. vt.ZONING ANALYSIS Zoning:Lionshead Mixed Use 1 District Zoninq General Use District Natural Area Preservation District Lionshead Mixed Use l District Lionshead Mixed Use lDistrict Land Use Plan Designation: Tourist Commercial Current Land Use: Vacant retail Develooment Standard Required ProoosedParking 14.6 spaces 21.13 spaces (no change) As this conditional use permit request only affects the use of an existing tenant space and does not propose any exterior changes to the existing building; this conditional use permit proposal does not alter the existing lot area and site dimensions, setbacks, building height and bulk, density, gross residential floor area (GRFA), site coverage, or landscaping and site development. The only development standard affected, other than use, is parking. This proposal increases the parking demand for this tenant space from 12.5 to 14.6 parking spaces. The existing Treetops commercial building currently has surplus parking, and if this proposal is approved, the Treetops commercial building will still exceed its minimum parking requirement by 6.53 parking spaces. REVIEW GRITERIA Before acting on a conditional use permit application, the Planning and Environmental Commission shall consider the following factors with respect to the proposed use: 1. Relationship and impact of the use on the development objectives of the Town. Staff believes the proposed convefsion of existing vacant retail space to "temporary buslness ofifrce" use is consistent with the development objectives of the Town. This conversion from empty retail spaces to "temporary buslness ofifrce" uses will ensure that Vail Resorts' employees are working near the ski mountain and will fill curently vacant space in the Treetops building with activity. Staff also believes this proposal is consistent with the intent, purpose, and standards of Ordinance No. 26, Series of 2004, which allsws for this temporary relocation of otfice uses within Lionshead. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff does not believe this proposal will have a significant negative effect on the above criteria in comparison to existing conditions. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking areas. As this proposal exceeds the minimum parking standards of the Vail Town Code, Staff does not believe this proposal will have a significant negative eff€ct on the above criteria in comparison to existing conditions. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. As this proposal does not involve any exterior change to the existing Treetops commercial building, Staff does not believe this proposal will have a significant negative effect on the above criteria in comparison to existing conditions. Staff believes this proposed "temporary busrness office" uses will bring vitality to this currently vacant tenant space. Staff believes that the temporary nature of lhis request will ensure that the Treetops commercial building will be returned to its retail/shopping character (as recommended by the Lionshead Redevelopment Master Plan and the Lionshead Mixed Use 1 zone district) once the construction of the Lionshead Core Hotel construction has been completed. 2. 3. lx.STAFF RECOMMENDATION The Department of Community Development recommends the Planning and Environmental Commission approves, with conditions, this conditional use permit request to allow for the proposed "temporary buslness offices",located at 450 East Lionshead Circle (Treetops commercial building). Staffs recommendation is based upon the review of the criteria described in Section Vlll of this memorandum and the evidence and testimony presented. Ihis existing office space is utilized by VR employees directly related to the operation of Vail Mountain (admin, snorvmaking, mountain operations, ski school, marketing, etc.) and as such their offices need to be located proximatc 1o the mountain. This C.U.P. is for "temporary business offices" in accordance with the reccntly approved amendncnt to the Lionshead Mixed Use 1 zonc district. The proposed office space is to be located within the existing street levcl of the Treetops Cornmcrcial Building. This space is currenlly vacant. The total square footage ofthe temporary offtce space is 5,425 square feet. Zonins Considerations The proposed use will not involve any changes to the exterior of the building. As such there are no changes to scluare footage, site coverage, building height, etc. The proposed use represents a change in use from previously existing retail use to office use. Retail parking requirements are 2.3 spaces per 1,000 sq. ft. and office requirements are 2.7 spaces per 1,000 sq. ft. This change in usc technically results in an increase in parking reqnirement from l2.5 spaccs to 14.6 spaces, a net increasc of2.1 spaces. The bulk of the parking requiremcnt for existing officc uses in the Gondola Building is cunently being met at the North Day lot. This lot will continue to provide parking for the proposed temporary offices at Treelops. C.U.P. Revicw Criteria Thc following criteria are to be used in evaluating a conditional use request: 1. Relationslrip and inrpact of tlre use on developnrcnt objectives of the town. Responsc The proposed use is directly related to what is arguably the Town's tttost irlportant development objcctivc - the redevelopnrent of the Core Site. While the proposed offlce use on street level cloes conflict wilh the Town's cleveloptrent objcctive to have retail and restaurant uses oll ground floor, the office use is tenroorarv in nalurc. 2. Effect ofthe use on light and air, distribution ofpopulation, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities and public facilities needs. ResDonse The proposed tcmporary use will not affect any ofthe considerations outlined above. 3. Effect upon traffic, with particular reference to congestion, automotive and pedestrian safety and convenicnce, traffic flow and cor.rtrol, access, maneuverability, and removal of snow from the streets and parking areas. Response The proposed temporary use involves the relocation ofoffice uses that prcsently exist in Lionshead. As such, this use will not affect any ofthe considerations Iisted above. 4. Effect upon the charactcr ofthe area in which the proposed use is to be located, including the scale and bulk ofthe proposed use in relation to surrounding areas. Response There are no exterior changes proposed to the building and as such no change to scale, bulk or mass. 5.
