As per our con�rersation, I have now enclosed a full scale site and grading plan as per the
i�o�� revised proje.ct.
These chanaes are:
1. Deck: The decic has naw been decreased in size towards the north (golf course} as to
avoid endaaigering the root systein of the large spnlce tree and not lo impede your
deck views. The deck stairs have been turn ta their existing direction versus out to the
north. �,s per the earlier plan, the d�ck k�as been expanded out to the east to
accommodate the l�flt tub.
2. Dividin� '��Vall: You �vill note tl�at proposed wall between your deck and tl;e area ocf
of Hiliiard's bascmeiit has been eliminated. Given the hot and patio was deleted fi•ozn
this ar�a, t1�e plau was revised to just a heated wallc��vay from the basennent door to the
decic stairs. Additionally a retaining wall replaces the IZi�h w�all and urill be at grade
and flares a�rray from you deck to allow ror drainage and access ut�der your deck.
3. Utilitv 1Vleters: Although not totally specific on the plan, the gas meters will be
moved to either the dividing retaining wall or on the north ��all of the dec]c siairs and
we would also like to mo��e the water meters fronl your cra�vl space. V��e tivill also
reFocate the irri�ation clock (probably upgrade), likely around ta Hilliard's east side.
You �vill noEe that we had the sewer and �uater lines located and suneyed. VVe will likely

This application is required for proposals involving minor exterior alterations and/or site improvements.
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.

• Indicate all easements identified on the subdivision plat and recorded against the property as
indicated in the title report. List any easement restrictions.
• Spot Elevations at the edge of asphalt, along the street frontage of the property at twenty-five
foot intervals (25'), and a minimum of one spot elevations on either side of the lot.
• Topographic conditions at two foqt contour intervals
• Existing trees or grt�Ups of frees havring trunks with diameters of 4" or more, as measured from a
point one foot above grade. .

• Adjacent roadways labeled and edge of asphalt for both sides of the roadway shown for a
minimum of Z50' in either direction from property.

• Indicate all existing ground cover and shrubs.
• Detailed legend, listing the type and size (caliper for deciduous trees, height for conifers, gallon
size for shrubs and height for foundation shrubs) of all the existing and proposed plant material
including ground cover.
• Delineate critical root zones for existing trees in close proximity to site grading and construction.
• Indicate the location of all proposed plantings.
• The location and type of existing and proposed watering systems to be employed in caring for
plant material following its installation.
• Existing and proposed contour lines. Retaining walls shall be included with the top of wall and
the bottom of wall elevations noted.
• Lighting Plan:
• Indicate type, location and number of fixtures.
• Include height above grade, lumens output, luminous area
• Attach a cut sheet for each proposed fixture.

1. If the utility approval & verification form has signatures from each of the utility companies, and no comments are made directly
on the form, or no action is taken within 2 weeks of the Utility's receipt of the form without explaination the Town will presume
that there are no problems and the development can proceed.
2. If a utility company has concerns with the proposed construction, the utility representative shall note directly on the utility
verification form that there is a problem which needs to be resolved. The issue should then be detailed in an attached letter to the
Town of Vail. However, please keep in mind that it is the responsibility of the utility company and the applicant to resolve

C) The Company must receive an appropriate affidavit indemnifying the Company against un-ffied
mechanic's and material-men's liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been coastruction, improvements or major repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; fmancial information
as to the seller, the builder and or the contractor; payment of the appropriate premium fully
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured
has contracted for or agreed to pay.

I am writing with some further comments on the revisions.
1) Please provide the ERWSD approval for the deck encroachment in the easement. I just spoke to Steve Croke and he is
accelerating this as he though this was due with the Building Permit.
2) In order for the space under the deck to not count as GRFA and be allowed to encroach into the setback the space
under the deck will need to be less than 5 feet in heigh and be accessed through a door measuring no more than 12 square
feet. I calculate the door area to be slightly more than 15 square feet per Sheet A5.1. On the set submitted for building
permits please provide adequate information to confirm these points.
3) On the plan set submitted for building permits please depict on the plan tree protection fencing around all trees located
within the area to be disturbed.
Once the ERWSD sign off is provided I will sign off on the DRB.

Ms. Giphart,
This letter is being sent in response to your submittal of a Design Review application to demo an
existing deck and replace it with a larger deck and patio and a request to excavate an existing
crawlspace to create finished living space. I have consulted with the Town of Vail Public Works
Department, Fire Department, and the Eagle River Water and Sanitation District, and here are the
comments I received in addition to my zoning comments.
• The proposed deck expansion appears to be in excess of five (5) feet from grade and therefore
must be a minimum of 7.5 feet from the property line per Section 14-10-4B, Architectural
Projections, Decks, Balconies, Steps, Bay Windows, Etc., Vail Town Code. Your proposal
shows the deck setback only five (5) feet. Please reconfigure the deck to be a minimum of 7.5
feet off of the property line.
• It appears that in conjunction with your proposal you will be removing three (3) Aspens and
replant five (5) Aspen. The language in the table on Sheet L-1 is a little confusing as the tern
"remains" is used next to what I believe are the addition of five (5) new Aspens.
• Please provide a contractor staging plan in conjunction with your submittal for a building permit
application.
• Please contact the Eagle River Water and Sanitation District to request an encroachment
agreement for improvements in the utility easement. A copy of the approved encroachment
agreement will be required prior to approval of this Design Review application.
• From Sheet A5-1 it appears that you are enclosing the underside of the new deck. The
enclosure of the underside of the deck creates Gross Residential Floor Area (GRFA) which
must be included in your calculations for floor area and site coverage. One suggestion would
be to enclose only those portions of the underside of the deck that are less than five (5) feet in
head height thus not qualifying as GRFA. Section 12-15-3, Definition, Calculation, And
Exclusions, Vail Town Code, provides greater detail on this.
