Triumph Custam Homes v�n,vw.triumphdev.com 3.21.2013 Spraddle Creek Estates, Hillside residential Lot 6 1067 Riva Glen Road Vail, Colorado 81657 Description of the proposed Lot 6 building envelope change The owner of lot 6 at Spraddle Creek Estates is proposing to move and reconfigure the existing building envelope. The property is undeveloped and the size of the envelope is not being changed. The existing building envelope is an approximate rectangle shape with slight variations. It is approximately 255' in the east west direction and 110' in the north south directions. The existing envelope is located in the south west corner of the lot, tucked into the easement setbacks. Tight against the west easement set back AND tight against the south setback. The south west corner moves to the north and east to have more of a linear shape as this lot is very steep in nature. With this horizontal shape, the home follows more closely the natural contours. Existing building envelope size = 22,398 sq.ft. /proposed envelope size = 22,397 sq.ft. Reasons for Lot 6 building envelope change The proposed lot 6 building envelope change promotes harmony, reduces impact on neighbors to the east and allows for overall better design with less impact to the steep site. The balance of the lot between driveway access,building bench, ht. and retaining walls was a delicate balance on this site. This building envelope move allows for the best results in the above mentioned items. - Spraddle Creek master plan demonstrates access to Lot 6 from below, off Riva Glen Road AND from above off Spraddle Creek Road. The owner has selected the above access from Spraddle Creek Road. This has been discussed and initially approved by Public Works. The new address is 1000 Spraddle Creek Road. This move and associated access is one of the driving forces to move the building envelope. I have attached the master plan showing the different options for access. - Moving the envelope to the east and north on the site allows for the vehicular access to come in at a more natural slope following the existing grades /bench. As we raised the design, this allowed the driveway to reduce from 15%to the existing design of 10%through the center portions of drive. At both ends we graduate down to 8%then 6%then 4%. As we entry off Spraddle Creek Drive AND entering into the auto court this is down to 1%slope. This raise up and lowing the grade allows for a safer entrance and exit off the driveway. P.970.479.9990 12 Vail Road,Suite 700,Vail,CO 81657 . . - Moving the building envelope to the east, allows for increased separation between building envelope and the adjacent home to the west. This proposed envelope change supports the Spraddle Creek guidelines' intent to create privacy between homes. On page one the Spraddle Creek design guidelines state, "The Residential design guidelines are established to ensure that certain criteria and design disciplines will be in effect which will cause the development of the community to grow in as an integrated and compatible manner as possible... and to promote value, quality and harmony will all the development at Spraddle Creek." This move allows for a 50' further separation between the existing home and the new master suite on the proposed home. - The more east west oriented building envelope also allows the house design to better respond to the natural land forms by orienting parallel with the topography. On page 4, the building sitting , "Building forms and massing shall respond to the site characteristics of slope and topography." Grading for the home is currently designed to be a balanced site, no export and no import. As we cut on the north side, this will become the fill for the building bench on the south side. The north e�rterior walls will work as retaining walls for a portion of the cut. The remaining cut / grade will be achieved through boulder retaining walls. - With the proposed new envelope, grading outside the envelope on the southern visible areas of the site is integrated into the landscaping design. Chasing the grades will require some of that work to occur outside the revised envelope. Grading above the home on the north side is for drainage and will be concealed by the home. Significant new landscaping will be planted around the home and enhanced native grasses will be planted on any disturbed areas. Site walls outside the envelope for the garage and driveway will comply with the guidelines' three foot maximum ht. in the front setback and 6' on the remaining site with a minimum of two feet between walls. - There are many precedents of building envelope changes in Spraddle Creek, which demonstrate that in many cases the original envelopes were not the best solution for the site and potential home designs. The previously approved building envelope changes have created better homes and promoted harmony between neighbors. If the building envelope is not adjusted, there will be a overall greater impact to the neighbor to the west. The home would need to be taller, with a third story, to achieve the GRFA. The proposed driveway will be steeper as the home would be located lower on the site. (b)The Company may�easonably�equi�e the Insured Claimant to submit to examination unde�oath by any autho�ized�epresentatNe of the Company and to produce for examination,inspection,and copying,at such�easonahle times and places as may be designated by the author¢ed representative of the Company, all records,in whatever medium maintainetl,inclutling books,letlgers,checks,memwantla,correspondence,�eports,e-mails,disks,tapes,and videos whether beaeing a tlate 6efo�e ar after Date of Policy,that reasonabry pertain to the loss or damage.Further,if requested by any authorized representative of the Company,the Insu�ed Claimant shall grant its pe�mission,in writing,fa any autho�ized representative of the Company to examine,inspect,and copy all of these�ecards in the custotly or control of a thetl party that�easona6ty pertain ta the loss or damage.All information designatetl as confidential by the Insuretl Claimant provided to the Company pursuant to this Section shall not be disclosed to others unless,in the reasonable jutlgment of the Company,it is necessary in the administration of the claim.Failure of the Insuretl Claimant to submit for examination unde�oath protluce any�easonabry requestetl information,a grant permission to secu�e�easonabry necessary information from th�d parties as�equ�ed in this subsection,unless prohibited by law or gov�nmental regulation, shall terminate any liabilfty of the Company under this policy as to that cfaim. 7.OPTIONS TO PAY OR OTHERWISE SETTLE CLAIMS;TERMINATION OF LIABILITY In case of a claim untle�this policy,the Company shall have the following adtlitional options: (a)To Pay or Tender Payment of the Amount of Insurance. To pay or tender payment of the Amount of Insurance untler this policy togeth�x with any costs,attorneys'fees,and expenses incumed by the Insuretl Claimant that were autha�¢ed by the Company up to the time of payment a tender of payment antl that the Company is obligated to pay. Upon the exercise by the Company of this option,all liability and obligations of the Company to the Insured under this policy,othe�than to make the paymer� �equFed in the subsection,shall terminate,including any lia6ility or obligation to defend,p�osecute,or continue any litigation. (b)Ta Pay or Otherwise Settle With Parties Othe�Than the Insured oe With the Insu�ed Claimant. (q To pay or otherwise settle with other parties fo�a in the name of an Insu�ed Claimant any claim insured against unde�this policy.In atldftion,the Company will pay any costs,atto�neys'fees,and expenses incuITed by the Insured Claimant that were authorized by the Company up to the time of payment and that the Company is obligated to pay;or (ii)To pay or otherwise settle with the Insuretl Claimant the loss w tlamage p�ovitled for unde�this policy,together with any costs,attorneys'fees,antl expensed incurred by the Insured Claimant that we�e authorized by the Company up to the time of payment and that the Company is o6ligated to pay. Upon the exe�cise by the Company of etthe�of the options provitled fo�in subsections(bHp o�(ii),the Company's obligations to the Insured under this policy for the claimetl loss a tlamage,othe�than the payments�equied to be made,shall te�minate,including any liability or obligation to defend,prosecute,a continue any litigation. 8.DETERMINATION AND EXTENT OF LIABILITY This policy is a contract of indemnity against actual monetar�r loss a damage sustainetl a�incurred by the Insured Claimant who has suffe�ed loss or damage by �eason of matters insu�ed against by this policy. (a)The extent of liability of the Company for loss a tlamage untle�this policy shall not exceed the lesser of ()the Amount of Insu�ance;or (ii)the difference between the value of the Title as insured and the value of the Title subject to the�isk insu�ed against by this policy. AO.FA.06.3 Cove�Page 3 of 5 (6)If the Company pu�sues fts�ights under Section 5 of these Conditions antl is unsuccessful in establishing the Title,as insu�ed, ()the AmouM of Insu�ance shall 6e increased 6y 10%,and (ii)the Insured Claimant shall have the right to have the loss o�damage dete�minetl efthe�as of the date the claim was made by the Insu�ed Claimant o�as of the date it is settled and paid. (c)In addition to the sxtent of liability untler(a)and(b),the Company will also pay those costs,atta�neys'fees,and expenses incurred in accadance with Sections 5 and 7 of these Conditions. 9.LIMITATION OF LIABILITY (a)If the Company establishes the Title,or removes the alleged defect,lien,or encumbrance,or cures the lack of a right of access to or hom the Lantl,or cures the claim of Unmarketable Tttle,all as insu�ed,in a reasonably diligent manner by any methotl,including litigation and the completion of any appeals,tt shall have fulry pertormed its obligations with respect to that matter and shall not be liable fa any loss o�damage caused to the Insuretl. (b)In the event af any litigation,inclutling litigation by the Company or with the Company's consent,the Company shall have no liability fo�loss or damage until the�e has been a final tletermination by a court of competent jurisdiction,and disposition of all appeals,adve�se to the Title,as insured. (c)The Company shall not be liable for loss or damage to the Insured for liability voluntariry assumed 6y the Insuretl in settling any claim oe suit without the p�ior written consent of the Company. 10.REDUCTION OF INSURANCE;REDUCTION OR TERMINATION OF LIABILITY All payments under this policy,except payments matle for costs,attorneys'fees,and expenses,shall�etluce the Amount of Insu�ance by the amount of the payment. 11.LIABILITY NONCUMULATIVE The Amount of Insurance shall be�etluced by any amount the Company pays under any policy insu�ing a Mortgage to which exception is taken in Schedule B or to which the Insured has agreed,assumed,a taken subject,or which is executetl by an Insured afte�Date of Policy and which is a cha�ge or lien on the Title,and the amaunt so paid shall be deemed a payment to the Insured unde�this policy. 12.PAYMENT OF LOSS When liability antl the extent of loss a tlamage have 6een definitety fixed in accordance with these Conditions,the payment shall be made within 30 days. 13.RIGHTS OF RECOVERY UPON PAYMENT OR SETTLEMENT (a)Wheneve�the Company shall have settled and paid a claim untler this policy,it shall be sub�ogated and entitletl to the rights of the Insured Claimant in the Title and all other�ights and�emedies in�espect to the claim that the Insueed Claimant has against any person or p�operty,to the extent of the amount of any loss,costs,attorneys'fees,and expenses paitl by the Company.If requestetl by the Company,the Insured Claimant shall execute documents to evitlence the transfer to the Company of these rights and�emedies.The Insuretl Claimant shall p�mit the Company to sue,compromise,o�settle in the name of the Insu�ed Claimant and to use the name of the Insured Claimant in any transaction or Iftigation involving these�ights and remedies. If a payment on account of a claim does not fulry cover the loss of the Insuretl Claimant,the Company shall defer the exercise of its right to recove�until afte� the Insu�ed Claimant shall have�ecovered its loss.
