HomeMy WebLinkAboutRucksack complaint letter February 27, 2009 Honorable Mayor Dick Cleveland Inter-office mail Re: Rucksack construction project building permit number B08-0072 located at 288 Bridge Street Lots C&D, Block 5A, Vail Village Filing 1 Mr. Mayor, The following summary is in response to your request on information in regards to the recent events that have occurred at the Rucksack construction site. Snow removal from the Rucksack building onto the A&D Building Bob Webb, Code enforcement officer, was contacted by Susan Jasem at 8:00 am on February 25th, 2009 registering a complaint as to person(s) from the Rucksack building were dumping snow onto the roof of the A&D building next door. This complaint was forwarded to Leonard Sandoval of the public works department. Upon visiting the site it was determined that the snow was removed to repair a section of roof flashing. Approval of drainage from the Rucksack building onto the A&D building The approved plans for this construction project did not include approval of drainage to be taken from the Rucksack building to the A&D building. The contractor, however, has run a drainage pipe from a 9 square foot roof area into the A&D building gutter. I have contacted the Rucksack building owner who indicated he will have the drain rerouted to an approved location within the Rucksack drainage system. A building inspection shall be performed to insure that this does take place. Egress from the second floor window of the A&D building An 18 inch passageway for the second floor window to grade was constructed by the Rucksack contractor as per an agreement with the A&D building owners. This passageway is not a building/fire code requirement, therefore was not considered as part of the building permit approval process. Chief McGee and I on Wednesday visited the site to become familiar with what has been done in regards to this passageway and we have concluded that it is an attractive nuisance. The design professional for the project will be required to provide a solution to remove the nuisance that will be acceptable to the Building and Fire Investigation teams. Action taken I have scheduled a meeting with the Rucksack construction team and inviting representatives of the A&D building to discuss these aforementioned items as well as a concern by the public works department in regards to the roof drainage from the A&D building that prior to the recent construction drained on the Rucksack property. This meeting is tentatively scheduled for next Friday March 6th, 2009.
