Department of Community Development Vail, Colorado 81657 970-479-2138/479-2139 FAX 970-479-2452 August 18, 2008 William Pierce, Bill@vailarchitects.com CC: Nick Seglie, Nseglie@vailarchitects.com Re: Rucksack Building Residential Addition PEC080048, DRB080319 288 Bridge Street/ Lots C & D, Block 5A, Vail Village 1st Filing Dear Bill, I am writing to provide the following initial comments and concerns on the development application for an addition to the two residential units of the Rucksack Building: Process: Because the Town of Vail owns the property to the east, or behind, the Rucksack Building, where balconies currently encroach on the Town’s property, the applicant must first go to the Vail Town Council to ask for permission to proceed through the development review process on Town property. The next step in the development review process will be to first go to the Planning and Environmental Commission (PEC) for review of the Major Exterior Alteration Application. Upon approval by the PEC, the Design Review Board (DRB) will then review the Design Review Application for an Addition. Once the DRB gives final approval, the applicant can apply for a building permit. As a condition of the building permit, the Planning and Environmental Commission must give final approval for a new condominium plat prior to issuance of any certificate of occupancy (including a temporary certificate of occupancy). Required Exemption Plat: As a condition of the building permit issued for the commercial renovation that is currently under construction, an exemption plat to combine multiple lots into one development site is required prior to Temporary Certificate of Occupancy. Application Incomplete: The Major Exterior Alteration Application is incomplete, and will need the following in order to be deemed complete and ready to present to the PEC: Signature from William and Deborah Gardiner Adequate homeowner’s association sign-off, showing approval of the latest set of plans, with or without consent to proceed once minor changes have been made to such plans Listing of adjacent properties and mailing addresses for the record, in addition to a complete set of envelopes (5 envelopes submitted to date) As discussed in our meeting on Friday August 15, 2008, there are a number of unresolved building code issues, with a short list provided at that meeting. Please contact the Chief Building Official Martin Haeberle in order to work out these issues. Specifically, living space may not be allowed in the fourth floor due to egress issues. Please explain how the proposed rear staircase compares to the current staircase. Because of the stream setback, these stairs cannot increase their encroachment and must remain in the same footprint. Should the application require further encroachment, the applicant will be required to file for a variance from the setback requirements. Access is also an issue, and an adequate staging plan will need to be submitted in order to show how access will be gained in the rear of the building. It is my understanding that staging is contingent upon the A&D Building allowing access off Gore Creek Drive, and proof of such an agreement will be required prior to issuance of any permits. In order to proceed with the current applications, the above issues will need to be addressed. Upon receipt of the necessary items for a complete PEC application, we can schedule the application for review approximately 30 days later.
