As stated in a previous letter dated September 5, 2008, there were a number of unresolved issues and missing application materials from the PEC and DRB applications for the remodel and addition to the residential units in the Rucksack Building. Specifically, I have not received an updated letter of approval from the Homeowners Association. However, I have received an email from Jay Peterson, representing Jeff Selby, informing the Town that there has not been approval granted for this particular project. Since then, I have received a letter from Jeff Hyman, representing the Gardiner and Mullally residences, stating that HOA approval was given along with approval for the commercial renovation. Since there are discrepancies between the HOA members and this is a civil matter, I ask that you resolve any issues among the homeowners association prior to resubmittal of the application. You may then resubmit a complete application to the Town of Vail and the applications can be reopened without incurring any additional fees. I apologize for any inconvenience this may cause, however; the Town of Vail must have a complete application to proceed any further. I have included all of the submitted application materials with this letter, and the Town has retained a copy for our records. Do not hesitate to contact me with any questions or concerns.
