As a disclaimer, while Staff has attempted to provide a comprehensive list of items for this project, it does not preclude Staff from making additional requests as part of the TCO and CO process. Please note that this letter does not include requirements from the Fire and Public Works Departments. A condominium plat must be recorded prior to issuance of a certificate of occupancy. In order to obtain a temporary certificate of occupancy for any portion or all of building, the applicant must resolve the encroachment issue with the trash enclosure, and have all exterior work completed, including re-roofing. Should these issues not be resolved, the applicant must enter into a developer improvement agreement (DIA) with the Town of Vail. This can be done by completing a DIA form found at www.vailgov.com, providing bids for removal of the potential encroachment, re-roofing the remainder of the building, and any other exterior work that remains incomplete, and also provide cash or a letter of credit for 125% of the bid price. The DIA must expire no later than July 1, 2009, when all of these issues must be resolved. Provide a TCO plan indicating items that will not be completed and a schedule for completion of these items. This must be submitted a minimum of 2 weeks prior to requested TCO date. Town staff shall review for a final approval of all conditions required for the TCO. All life safety and accessibility items are required to be completed and accepted, that pertain to the area(s) requested, in order to obtain a TCO.
