MEMORANDUM TO: Planning and Environmental Commission FROM: Community Development Department DATE: December 8, 2008 SUBJECT: A request for final review for an amendment to an approved development plan, pursuant to 12-9C-5, Development Standards, Vail Town Code, to allow for temporary skier parking at the Vail Mountain School, located at 3000 Booth Falls Road/Lot12, Block 2, Vail Village Filing 12, and setting forth details in regard thereto. (PEC080070) Applicant: Vail Mountain School, represented by Janet Refior Planner: Nicole Peterson I. SUMMARY The applicant, Vail Mountain School, represented by Janet Refior, is requesting final review, for an amendment to an approved development plan to allow for temporary skier parking at the Vail Mountain School, located at 3000 Booth Falls Road. Based upon Staff's review of the criteria and findings in Section VII of this memorandum and the evidence and testimony presented, the Community Development Department recommends that the Planning and Environmental Commission approves, with conditions the development p�an amendment. II. DESCRIPTION OF THE REQUEST The applicant, Vail Mountain School, represented by Janet Refior is proposing to provide temporary skier parking at the existing Vail Mountain School surface parking lot everyday, from December 20, 2008 th�ough January 4, 2009. The School will be charging $15 per car, as a fundraiser for the senior class. There will be at least 3-4 students and 1 adult supervisor on-site from 7:45am — 10:OOam and from 3:OOpm — 4:OOpm. The students will be responsible for making sure the parking lot is clean at the end of each day. There are a total of 88 spaces in the existing parking lot. On Saturday's and Sunday's, 30 spaces will be leased by Vail Resorts, for ski instructor parking, 5 spaces will be reserved for maintenance and teacher parking and the other 53 spaces will be available to the public. The applicant is proposing one sign that will state, `Lot Full' to notify the public when the lot is full and to prevent over- parking. Staff has included a vicinity map for the Commission's review (Attachment A). I11. BACKGROUND The following is a brief synopsis of Vail Mountain School development over the last 20 years: 1 , • 0 1972 -Vail Village 12th Filing was annexed into the Town of Vail and platted. This subdivision plat shows Lot 12 that at 8.66 acres. 0 1972-At the time of annexation Agriculture Open Space zoning was applied to Lot 12. The total area of the parcel was 8.66 acres. The minimum lot size of the Agriculture Open Space zone district is 35 acres. 0 1979 -Vail Resorts conveyed the Tennis Court site to the Booth Falls Homeowners through a quick claim deed. 0 1979-The first two story building was constructed on the site. 0 1980-Vail Resorts conveyed the land that the School is on today to the Vail Mountain School. 0 1979—Original 2-story building constructed 0 1984— North classrooms and rockfall berm constructed 0 1989— Gymnasium and stage addition constructed 0 1992—Additional story added to existing building 0 1995— Library expansion 0 1999—Temporary classroom structure added 0 2000—April 24th, VMS received approval for a development plan (master ' plan) and a conditional use permit for the expansion of the school facilities, including eight EHU's 0 2002 — School was redevetoped including addition of land, re-platting, re- zoning, 8 EHU's, approximately 87,300 square feet of new building area, a new soccer field, landscaping, re-location of Katsos Ranch Road and relocation/ renovation of the `cabin' (Baldauf House, built in 1906), historic landmark. IV. ROLES OF REVIEWING BODIES Planninq and Environmental Commission: The Planning and Environmental Commission is responsible for final approval, approval with modifications, or denial of a development plan amendment, in accordance with Chapter 12-9C, General Use District, Vail Town Code. Design Review Board: The Design Review Board is responsible for the final approval, approval with modifications, or denial of any accompanying design review application. Town CounciL The Town Council has the authority to hear and decide appeals from any decision, determination, or interpretation by the Planning and Environmental , Commission and/or Design Review Board. The Town Council may also call up a decision of the Planning and Environmental Commission and/or Design Review Board. V. APPLICABLE PLANNING DOCUMENTS Vail Town Code 12-9C-1 GENERAL USE(GU) DISTRICT PURPOSE The general use district is intended to provide sites for public and quasi-public uses which, because of their specia/ characteristics, cannot be appropriately regulated by the development standards prescribed for other zoning districts, and for which development standards especially prescribed for each particular development proposal or project are necessary to achieve the purposes prescribed in section 12-1-2 of this title and to provide for the public welfare. The general use district is intended to ensure that public buildings and grounds and certain types of quasi-public uses permitted in the district are appropriately located and designed to meet the needs of residents and visitors to Vail, to harmonize with surrounding uses, and, in the case of buildings and other structures, to ensure adequate light, air, open spaces, and other amenities appropriate to the permitted types of uses. Vail Land Use Plan CHAPTER 11—LAND USE PLAN GOALS/POLICIES The goals articulated here reflect the desires of the citizenry as expressed through the series of public meetings that were held throughout the project. A set of initial goals were developed which .were then substantially revised after different tyqes of opinions were brought out in fhe second meeting. The goal statements were developed to reflect a general consensus once the public had had the opportunity to reflect on the concepts and ideas initially presented. The goal statements were then revised through the review process with the Task Force, the Planning and Environmental Commission and Town Council and now represent policy guidelines in the review process for new development proposals. These goa/statements should be used in conjunction with the adopted Land Use Plan map, in the evaluation of any development proposal. The goa/ statements which are reflected in the design of the proposed Plan are as follows: 2. Skier/Tourist Concerns 2.1 The community should emphasize its role as a destination resort while accommodating day visitors. 3 . . � 2.2 The ski area owner, the business community and the Town leaders should work together closely to make existing facilities and the Town function more efficiently. 2.3 The ski area owner, the business community and the Town leaders should work together to improve facilities for day skiers. 2.4 The community should improve summer recreational options to improve year-round tourism. 2.5 The community should improve non-skier recreational options to improve year-round tourism. 2.6 An additional golf course is needed. The Town should work with the down valley communities to develop a golf course as well as other sports facilities to serve the regional demand for recreational facilities. 2.7 The Town of Vail should improve the existing park and open space lands while continuing to purchase open space. 2.8 Dav skier needs for parkinp and access should be accommodated throuqh creative solutions such as: a) Increase busing from out of town. b) Expanded points of access to the mountain by adding additional base portals. c) Continuinq to provide temporaN surface parkinq. d) Addition of structured parking. VII. CRITERIA AND FINDINGS ; Before acting on a development plan amendment application, the Planning and Environmental Commission shall consider the following criteria with respect to the proposed use: 1. Relationship and impact of the use on the development objectives of the Town. Staff believes the proposed development plan amendment is consistent with the development objectives of the Town. The proposal results in the effective use of an existing parking lot that is underutilized during the winter break, for public parking. The Vail Land Use Plan specifically states the goal of temporary surface parking to meet the needs of day visitor's in Section 2.8, below: 2.8 Dav skier needs for parkinq and access should be accommodated throuqh creative solutions such as: a) Increase busing from out of town. b) Expanded points of access to the mountain by adding additional base portals. c) Continuinq to provide temporary surface parkinq. d) Addition of structured parking. 4 ' % � . 2. The effect of the use on light and air, distribution of population, transportation facilities, utilities, schools, parks and recreation facilities, and other public facilities needs. Staff believes the proposed use has little to no effect on the elements listed in this criterion because the parking lot is existing. However, Staff did request information on transportation facilities (bus service) to the site, due to the temporary skier parking. Mike Rose, TOV Transportation Department, believes approximately 190 people are expected per day and there are extra buses on the weekends, if needed. 3. Effect upon traffic with particular reference to congestion, automotive and pedestrian safety and convenience, traffic flow and control, access, maneuverability, and removal of snow from the street and parking areas. � Staff believes the proposed temporary parking will not negatively impact the traffic flow, as the parking lot already exists. However, to mitigate any possible over-flow parking, Staff has drafted a condition, it Section VIII of this memorandum, that there shall be no over-flow parking on the Right-of-way, street or landscaping and double-parking is prohibited. 4. Effect upon the character of the area in which the proposed use is to be located, including the scale and bulk of the proposed use in relation to surrounding uses. Staff believes the proposed temporary parking is consistent with the character of the area, because the parking lot is existing. VIII. STAFF RECOMMENDATION The Community Development Department recommends that the Planning and Environmental Commission approves with conditions the development plan amendment, pursuant to 12-9C-5, Development Standards, Vail Town Code, to allow for temporary skier parking at the Vail Mountain School, located at 3000 Booth Falls Road. Should the Planning and Environmental Commission choose to approve this request; the Community Development Department recommends the Commission pass the following motion: "The Planning and Environmental Commission approves the development plan amendment, pursuant to 12-9C-5, Development Standards, Vail Town Code, to allow for temporary skier parking at the Vail Mountain School, located at 3000 Booth Falls Road and setting forth details in regard thereto. Should the Planning and Environmental Commission choose to approve this request, the Community Development Department recommends the Commission makes the following findings: "The Planning and Environmental Commission finds the following based upon the criteria outlined in section Vlll of the December 8, 2008 Staff 5 . i memorandum: 1. Should the Planning and Environmental Commission choose to approve this request, the Community Development Department recommends the Commission adopt the following conditions: : 1. The applicant shall monitor and enforce no double-parking and no over-flow parking on the Right-of-way, street or landscaping. 2. This is a residential area and not commercial zoning. This is a commercial venture. 2. We enjoy our vacation time in our home and a large increase in traffic will adversely effect our quality of life. We have lived there for 24 years and purchased in this area for the residential ambiance. 3. Even a temporary permit will increase the traffic and persons in this area. Presently, people park in the lot and it is not well patrolled by the police. I frequently am asked by commuters if they can park in the lot. Most do so anyway. I cannot recall ever seeing a ticket issued. 4. Once this is permitted, even on a temporary basis, people will return and park there. Plus, this will set a precedent for future years and we will forever be : inundated by commuters during the holidays. When the lot is full, people will look to park on Booth Falls Road or Bald Mountain Road. 5. The bus stop cannot handle even one more person who is not a resident of the area. During the busy seasons, the East Vail bus is very full from 8-10 inbound and and the 3-4 outbound . It frequently passes this stop. Waiting for two or three busses is not uncommon. Bald Mountain stop is worse because they are the last stop on the inbound. 6. If the TOV adds busses to accommodate this permit, it is an increased cost to the system. Who pays for this? This will increase the workload of the police department to enforce the no parking areas. Do you have extra officers to do this? Again, there is a cost involved and it should be paid by Vail Mountain School. In summary, this permit should not be granted even though it is for the good cause of student fund raising. It will effect the quality of life of the residents of this area and the increased costs will be born by the taxpayers. Plus, I believe that this is a violation of zoning.
