I am counsel for the owners of the two residential units in the Rucksack Building both of whom filed a development application with the Town of Vail, namely William A. Gardiner and Debora A. Gardiner,Martin J.Mullally Credit Trust,and Yvonne Mullally Survivors Trust. William Pierce is the architect for their requested development. I was provided a copy of your correspondence of August 18, 2008,to Mr. Pierce that set forth your initial cornments and concerns regarding the developrnent of the two residential units. Mr. � Pierce will respond to your comments as he has the appropriate knowledge and experience regarding these matters. One matter that I was asked to address pertains to paragraph 3.b., of your correspondence,where you request"adequate homeowner's association sign-off. . . ." We believe that was provided to tlie Town of Vail in the Resolution of September 29, 2007, a copy of which provided to the Town of Vail on October l,2007,by Jeffrey Selby in conjunction with his development application of the Rucksack Building. Please refer to paragraphs 2-3. Mr. Selby's application was approved by the Town of Vail based upon his representation that he had authority of the HOA which by the way only includes Mr. Selby and the two residential owners. The Resolution as represented by Mr. Selby gives HOA approval for his development of the Rucksack building,as well as the development of the units of the residential owners. The Town of Vail allowed Mr. Selby to move forward with his development of the Rucksack Building in accordance with the Resolution. We believe that the Resolution should answer your initial comment and concern regarding this issue. Process: In order to move forward with a PEC meeting on October 13, 2008, you will need to respond ta the comments below prior to September 23, 2008. 2. Required Exemption Plat: As a condition of the building permit issued for the commercial renovation that is currently under construction, an exemption plat to combine multiple lots into one development site is required prior to Temporary Certificate of Occupancy. 3. Application Incomplete: The Major Exterior Alteration Application is incomplete, and will need the following in order to be deemed complete and ready to present to the PEC: a. Signature from William and Deborah Gardiner b. Adequate homeowner's association sign-off, showing approval of the latest set of plans, with or without consent to proceed once minor changes have been made to such plans 4. There are a number of unresolved building code issues, including the following: a. �iving space may not be allowed in the fourth floor ar loft area b. Because the stairway is so close to the northeast properfy line adjacent to the A&D Building, a no=build area will need to be established on the A&D property's access . easement. Please provide us with the current easement language. 5. Access is also an issue, and an adequate staging plan will need to be submitted in order to show how access will be gained in the rear of the building. It is my understanding that staging is contingent upon the A&D Building allowing access off Gore Creek Drive, and proof of such an agreement will be required prior to issuance of any permits. In order to proceed with the current applications, the above issues will need to be addressed by September 23, 2008. The plan fails to delineate between existing buiiding and new porfiion so VFES is unable to do a complete review. The entire building must meet current codes for both the Monitored Fire Alarm System (NFPA 72, 2002 ed.) and the Fire Sprinkler System (NFPA 13, 2002 ed.). They must also comply with all TOV standards. At this time, I don't see any large issues other.than possibly the ladder to the upper loft area. I believe that the Building Department will address that issue also. They may also need sprinklers to cover the wood decks that exist. Hope you enjoyed the Conventions! Be it resolved that the plans brought forward by Mr..Jeff Selby, owner of units Cl, C2, and C3,to redevelop the Rucksack Building,per the plans dated September 29, 2007, are approved. a. Mr. Jeff Selby will bear all cost related to the redevelopment. This includes but is not limited to any upgrades that will be required by the Town of Vail to bring the building up to the current building codes. b. That the maximum increase of the units will be: i. C1,no increase � ii. C2, TBD � iii. C3, TBD c. Any material changes to the plans dated September 29, 2007 will require � additional approval by the Rucksack Homeowners Associations and would cause a stoppage of the redevelopment until approval. d. The developer will also address and correct the lack of hot water issues in Units Rl.and R2 believed to be caused by the over consumption of hot water by the tenant in Unit C 1. 2. Be it resolved that the owner of Unit Rl has been given approval by the Rucksack Homeowners Association to redevelop said unit by a maximum of 20% of the current square footage, subject to review and approval by the Town of Vail. 3. Be it resolved that the owner of Unit R2 has been given approval by the Rucksack Homeowners Association to redevelop said unit by a maximum of 700 additional square footage, subject to review and approval by the Town of Vail. 4. Be it resolved that as part of the Redevelopment of the Rucksack, the official , name of the building will be changed to the Bridge Street Building and the name ' of the Homeowners Association will be changed to The Bridge Street Building Homeowners Association(BSBHA). 5. Be it resolved that the use of the C3 unit will be changed from commercial to residential. The C3 unit will be relabeled the R3 unit. The C3 unit shall be designed as attached with a portion of the unit to be constructed on the adjacent property over the Burton Store on the Otto Stork Property. The members of the Rucksack Condominium Association approve the residential unit(including tlie expanded space)and the combination of the two properties to form one Association. It will be the responsibility of the developer to notify all city, county, and state agencies, of these changes. i I 6. As stated in a previous letter dated September 5, 2008, there were a number of unresolved issues and missing application materials from the PEC and DRB applications for the remodel and addition to the residential units in the Rucksack Building. Specifically, I have not received an updated letter of approval from the Homeowners Association. However, I have received an email from Jay Peterson, representing JefF Selby, informing the Town that there has not been approval granted for this particular project. Since then, I have received a letter from Jeff Hyman, representing the Gardiner and Mullally residences, stating that HOA approval was given along with approval for the commercial renovation.
