I. SUMMARY
The applicant, Vail R�sorts Development Gompany (VRDC), represented by Braun
Associates Inc., is requesting a major subdivision, pursuant to Chapter 13-3, Vail Town
Code, to allaw far the platting of Lots 1 and 2, Lodge Subdivis�on, located at 164 Gore
Creek Drive/Lots A & C, �lock 5-C, Vail Vialage First Filing. Staff has reviewed the
application and is recommending that the Cornmission approves the request subject to
the findings outlined in Seciion VI of this memorandum.
II. DESCRIPTION �F THE REQUEST I
The applicant, Vail Resorts Development Company (VRDC), represented by Braun
Associates Inc., is requesting a major subdivisior�, pursuant to Cha�ter 13-3, Vail Town
Code, to allow for the platting of Lots 1 and 2, Lodge Subdivision, Cocated at 164 Gore
Creek Drive/Lvts A & C, Block 5-C, Vail Village First Filing.
The purpase of the major subdivision is to vacate the comman lot line creating Lot C and
to establish Lots 1 and 2, Lodge Subdivision (Lot 1 — Lotfge at Vail/Lot 2— Lodge South
Condominiums). According ta the proposed plat, Lot 1 is 17,337 square f�et (0.398
acre) in size ae�d Lot 2 is 88,165 square feet (2.024 acres) in size. This is a slight
change from the previous{y approved lot sizes af 14,680 square feet (0.337 acre} and
90,822 (2A$ acres), respectively.
II1. BACKGROUND
O� April 14, 1997, the Town of Vail Planning and Environmental Commissian approved
a minar subdivision of the Lodge Tower Parcel. The purpose of the minar subdivision
was to fprm�l�ze the ownership and histpric deve�opment pattern of the Lodge Towrer
Parcel since it was divided pursuant to a condominiurn plat reeorded ir� October of 1973.
Far zoning purposes, the Lodge Tower Parcel development site is considered legally
establishecf, non-conforming with respect ta site coverage, GRFA, lancfscape area,
density, and parking.

According to Sect�on 13-3-4, Commission Review of Application; Criteria, Va�l Town
Gode,
"The burden of proof shall rest with the applicant to show that the application is in
compliance with the intent and purposes af tfre Chapfer, Zoning Ordinance and
other pertinent regulatrons thaf the Planning and Enviranmerrtal Commission
deems applicable. Due consideration siaall ,be g�ven to tne recommendatians
made by public agencres, utility companies and other agencies consulted under
subsection 13-3-3C above. The Planning and Env+ronmental Commission shall
review the applrcation and consider its appropriateness in regard to Town
poGci�s relating fo subdivision contral, densities proposed, regulations,
ordinances and resolutivns and other applicable documents, environmental
integrity and compatr"bility with surroundrng land uses and other applicable
documents, effects on the aestheiics of fhe Town."
One of the basic premises of subdivision regulations is that minimum standards for the
creation of a new lot must be me#. This project will be reviewed under t�te Majar
Subdivisior� Criteria, pursuant to Section 13-3-4, �ubNdivision Reg�lations, Vail Town
Code.
The first criterion to be considered by the Planning and Environmental Commission for a
Major Subclivision application is:
Lot Area—The Zoning Code requires that the minimum lot or site area for a lat
located in the Commerciaf Core I (CCI} zane district shall be 5,000 square feet of
buildable area. !
Staff Respanse— The major subdivisian meets this requirement.
Frantage — The Subclivision Regulations require a mir�'rmum street frvntage of
thirty feet (30').
Staff Response — Through the provision af a perpatual parkirrg and entrance
easement(book 231, page fi13), adequate and accepta6le means of ingress and
egress wil!be provided.

The second set of criteria to be considered by the Planning and Environmental
Commission for a Major Subdivision application is the subdivision purpose statements.
The subdivision �urpose stateme�ts are as follows:
�. To inform each subdivider of the standards and criteria by which development
and proposals will be evaluated and to provide informatian as to the type and
extent of improvements required.
Staff Response — The review of this requsst has fvllowed the regulatrons
prescrrbed for major subdivisions of land.
2. To provide for the suk�ivision af property in the future without conflict with
development on adjacent properties.
Staff Response — Thrs proposal simply formalizes the subdrvisivn approvals
granted rn 1973 and 1997. Th� subdivision wvill nof conflict with future
development on adjacent properties.
3. To protect and consarve the value of land throughout the municipality and the
value of buildings and irraprovements on the lar�d.
Staff Response — Staff does not believe that the proposed subdivfsion request
will have any neg�tive im,pacts on the value of land vr the value of bu+ldinqs and
improvements on the land.
4. To insure that subc�ivisit�n of property is in compiiance with the Town Zoning
Ordinance, to ach�eve a harmonious, convenient, workabl� relativnship among
aand uses, consistent with municipal development objectives.
Sfaff Response— The proposed subdivision meets fhe intent and purpose of the
Zoning Regulaf+ans for the parce! of land. The rmprovemenfs on the land are
considered io be legaNy established non-confarming and wrll continue to be sa
upon subdivlsion af the parcel. According to Town af Vail recards, rhe two
parcels have been treated separately fvr zonr'ng purposes since 1973. I
5. To guicfe public arad private policy and action in arder to provide adequate a�d
efficient transportation, water, sewage, schools, parks, playgrountis, recreational
and other public requirements and facilities and generally to provide that pubic
facilities wil� have sufficient capacity to serve the proposed subdivision.
Staff Response — Sfaff does not believe the requested major subdivisron wil!
have any adverse impacts on fhe above-described criteria.
6. To provide for accurate legal d�scriptions of newly subdivided land and to
establish reasonable and desirable construction, design standards and
procedures.
Sfaff Response — The proposal wi11 result in an aecurate legal description of the
subdivrded land.

7. To prevent the pollutdon of air, strearras, and ponds, to ins€�re adequacy of
drainage facilities, to safeguard the water table and to encourage the wise use
and management of natura� resources throughout the municipality in order to
preserve the inte�rity, stability and beauty ot the community and the value of
land.
Staff Response—S�aff does not!�elieve the proposed major subdivision wil!have
any negative impacts on rhe abvve-described criter�a.
VI. STAFF REC�MMENDATION
The Community Development Depa�tmer�t r�commends that the Planning and
Env�ronmentai Commission approves the request for a major subdivision, pursuant to '
�hapter 13-3, Vail Town Code, to allow for the platting of Lots 1 a�d 2, Lodge
Subdivision, located at 164 Gore Creek Drive/�vts A & C, Block 5-C, Vail Village First '
Filing. Staff's recommendation of approval is based upon the review of the criteria
o�atlined in Sec#ion V of this rmemorandum and the evidence and testimony presented on
the request.
Should the Plar�ning and Er�vironmental Commission choose to approve this request,
staff recommends that the foll�w�ng finding be made as part of#he mation,
"The Commissi�n finds that the applr`cant has derrronstrated tv the satisfaction of
the Commission that the application is in compliance with the intent and
purposes of the Chapter, �'oning Ordinance and other pertinent regulatians tiaat
the Planning and Environmental Commissian deems applicable. Further, fhe
Commissron firtds that the reques� if appropriate in regard to Tawn policies

Tom Braun explained the desir� of the school to utilize a portion of the a�proved employee
housing units for storage while the school is being completed. He explained that the current
number of students dicf not req�i�e an increase in the number of staf� members, therefore the
need for the �HUs is not necessary at the current time. The proposaf is to use six of the eight
EHUs fa�office space and storage. He cantinued by explaining th� timeline for getting the other
EHUs operatian and occupied by th�e new staff. The applicant requested that they be able to use
alq eight garages for storage.
No public in�ut.
George �.amb sees this as a housekeeping item. No problem utilizing the EHRJs for storage
however the storage should be mair�tained within the building and garages in vrder to maintain a
residential character. He believes two of the garages should be avail�ble for the occupants of
the EHUs.
Doug Cahill agreed with Gearge Lam�'s comments. He reiterated that there should �ae a
residential character to the property regard9ess of its use for storage if approved.
Chas Bernhard# asked if there was excess parking on the campus to accommodate the twa
occupants of the EHUs.

John Schofield agreed with all the comments.
Doug Cahill made a motion to approve the conditional use permit per the staff memorandum with

Raberk McCleary presented the revisions made to the plans and responded to questions of the
Commission. The Commission's questions focused an pedestrian aecess in and around the
development site and the connectEVity of the proposed buildings.
Chip Melick discusseci the proposed deve�apment and the standard from which th�projeci deviated.
John Schofiefd asked for public comment.

George Lamb expressed his appreciation to the applicant for breaking up the proposed ridgeline.
He suggested that the applicar�t communicate their plans with the residential owners in Golden Peak
and other neighboring property owners to avoid last minute concerns about impacts to views to the
east. George stated that traffic irnpacts on Vail Valley Drive could be a concern.
Doug Gahill expressed a suggestion ta create the conrtectivity between buildings on the first floar
instead of the thirc�floor. He suggested further research into the use of the surplus parking spaces to
avoid further congesting Vail Valley arive. I�e questioned the applicanYs intent ta "clean up" the
Gore Creek and Mill Creek riparian corridors.
Ghas Bernhardt indicated that he liked this proposal better than the previous plan. He felt that
landscaping should be considered to help visuaily break mass the horizontal mass of the buildings.
Cnas suggesied that the applicant conceptually explore the passibility of large trees in the landscape
plan.
Jahn Schafield stated his concern that the redevelopment of residentia!condominiums can not rely
salely upon deviations frorr�the development regulations to"fund"renovation projects. That said,he
suggested the applicant now subnait a complete application and proc�ed towards a decision of the
Commission. Ne expressed that building bulk and mass and building height were the two most
important concerns oi the Commission and needed to be addressed. He further stated that parkir�g
and impacts to traffic on Va�P Valley Drive.

John Schofield stated t�at i� the negative impacts of parking could be addressed, then surplus
parking on the Manor Vail Lodge development site could be acceptabie.
