Minor Exterior Alteration
General Information: This application is required for all proposals involving minor changes to buildings and site
improvements, such as roofing, painting, window additions, landscaping, fences, retaining walls, etc. Applicable Vail
Town Code sections can be found at www.vail4ov.com under Vail Information—Town Code Online. All projects requiring
design review must receive approval prior to submitting a building permit application. An application for Design Review
cannot be accepted until all required information is received by the Community Development Department, as outlined in
the submittal requirements. The project may also need to be reviewed by the Town Council and/or the Planning and
Environmental Commission. Design review approval expires one year from the date of approval, unless a building permit
is issued and construction commences.

Re: Proposal for Re-Beautifying Open Space— Bald Mtn. Road —Vail
Dear Mr. Pierce,
Thank you for taking the time to prepare and submit a proposal to re-beautify Town —owned
open space adjacent to your property located at 2730 Bald Mountain Road in Vail, Colorado.
Additionally, thank you for your offer to donate all materials, labor and future maintenance to the
open space area in question.
As promised, I have reviewed your proposal, as submitted, and determined that the Town of
Vail must deny the request to complete work on Town-owned open space land. My
determination was based upon many factors and considerations. The factors and
considerations included the following:
• The intent and purpose behind the Town of Vail acquiring and maintaining town-owned
open space land.
• The intended vs. unintended consequences of granting such approvals.
• The existing conditions of the open space area surrounding the area identified for"re-
beautying".
• Any precedents set as a result of granting an approval.
• The concern of"privatization" of publically-owned land.
• Input and feedback from other Town of Vail employees.
As a result of the denial, I must ask that the area impacted be restored to its previous condition.
To do so, all of the dirt deposited on town-owned land shall be removed to the original
topographic condition, the area planted with a native grass seed mixture, a temporary form of
irrigation shall be provided to ensure the seed germinates, and a written agreement signed by
you acknowledging that you will cease to use town-owned open space lands for purposes other
than which they were intended. All costs associated with the completion of the restoration work
shall be at your sole expense and all work shall be completed to the Town's satisfaction by no
later than June 28, 2013. An inspection by the Town of Vail shall suffice for the Town's
acceptance. It shall be your responsibility to submit a restoration plan to the Town of Vail
Community Development Department by no later than 5:00 pm, Wednesday, February 20,
2013.
In return for agreeing to the terms outlined above, I will request that the Town's prosecutor
suspend any further action on the summons served to you for the alleged violation of the
ordinances of the Town of Vail. I will recommend any and all further action be suspended until
after June 28, 2013, or upon acceptance of the required restoration work by the Town of Vail,
whichever occurs first.
