Dear George:
In accordance with the "Second Amendment to Core Site Development Agreement," Vail
Resorts is submitting a DRB application and PEC application to allow for the necessary
improvements to provide skier drop-off at the North Day Lot, located at 600 West Lionshead
Circle / Lot 1, Block 1, Vail Lionshead Filing 3. As you can see from the plans submitted, the
design is substantially in conformance with the Exhibit A of the above-referenced agreement.
The South Frontage Road access has shifted slightly to the east to align with the access for the
proposed Employee Housing and Transit Center project on the North Day Lot, which will be
submitted on or before February 25, 2008. Simultaneously, we have submitted for CDOT
approval of the access and have provided documentation for your reference.

Note: Pursuant to CRS 10-11-122, notice is hereby given that:

the Board of County Commissioners, the County Clerk and Recorder, or the County Assessor.
Note: Effective September 1, 1997, CRS 30-10-406 requires that all documents received for recording or filing
in the clerk and recorder's office shall contain a top margin of at least one inch and a left, right and bottom
margin of at least one half of an inch. The clerk and recorder may refuse to record or file any document that
does not conform, except that, the requirement for the top margin shall not apply to documents using forms

Note: Colorado Division of Insurance Regulations 3-5-1, Paragraph C of Article VII requires that "Every
title entity shall be responsible for all matters which appear of record prior to the time of recording
whenever the title entity conducts the closing and is responsible for recording or filing of legal
documents resulting from the transaction which was closed". Provided that Land Title Guarantee
Company conducts the closing of the insured transaction and is responsible for recording the

Note: Affirmative mechanic's lien protection for the Owner may be available (typically by deletion

A) The land described in Schedule A of this commitment must be a single family residence which
includes a condominium or townhouse unit.
B) No labor or materials have been furnished by mechanics or material-men for purposes of
construction on the land described in Schedule A of this Commitment within the past 6 months.
C) The Company must receive an appropriate affidavit indemnifying the Company against un-filed
mechanic's and material-men's liens.
D) The Company must receive payment of the appropriate premium.
E) If there has been construction, improvements or major repairs undertaken on the property to be purchased
within six months prior to the Date of the Commitment, the requirements to obtain coverage
for unrecorded liens will include: disclosure of certain construction information; financial information
as to the seller, the builder and or the contractor; payment of the appropriate premium fully
executed Indemnity Agreements satisfactory to the company, and, any additional requirements
as may be necessary after an examination of the aforesaid information by the Company.
No coverage will be given under any circumstances for labor or material for which the insured
has contracted for or agreed to pay.
Note: Pursuant to CRS 10-11-123, notice is hereby given:
This notice applies to owner's policy commitments containing a mineral severance instrument
exception, or exceptions, in Schedule B, Section 2.
A) That there is recorded evidence that a mineral estate has been severed, leased, or otherwise
conveyed from the surface estate and that there is a substantial likelihood that a third party
holds some or all interest in oil, gas, other minerals, or geothermal energy in the property; and
B) That such mineral estate may include the right to enter and use the property without the
surface owner's permission.

Here you go. Some of these you may need to call to get clarity.
1) Depict the fire staging area that exists in the far southeast corner drive aisle.
2) Depict the FDC connections that are on the Landmark on the site plan.
3) Show all fire hydrants on the site plan. There is one depicted in Tract C next to the relocated path. Make it easier to
pick up on the site plan.
4) The Town's plowing equipment cannot get into the new ramp design for the pedestrian bridge. There may be a need to
hand shovel it until such time as it can put onto a snow melt system. The Town would expect that Vail Resorts would
address the snow shoveling of the ramp until that time.
5) Who will be in charge of enforcing the skier drop off time limits?
6) Show the appropriate amount of snow storage on the site plan. Who will handle snow removal during periods of great
accumulation?
7)Is the permit parking that skier drop off would pass through for vail resorts employees? Who will enforce the permits for
parking in this lot?
8) Staff believes it may be necessary to add a pedestrian sidewalk connection in the southeast corner of the skier drop off
connection the area to the relocated path. It appears snow will be stored in the far eastern end of the parking lot blocking
pedestrian access to the path.
9) Is there any new lighting associated with the project? If so provide details.
10) Where are the accessible handi-capped spaces? Are they down closer to the Lionshead core as there is no access from
this temporary location?
11) Along the Frontage Road staff believes the path should continue east from the intersection with the path on Tract C.
It may be better to do this with the later development.

like to hear them ASAP so we can start addressing them. Is that something

Also,you mentioned having a meeting on Monday(1/21)with just TOV,

be beneficial to construct the ultimate lane configuration at this point to eliminate ripping up the new construction within a
couple of years.
18)The letter to CDOT indicates that there is a traffic analysis for this new access,please provide a copy to the Town.
19) East end of culvert should be extended to eliminate the hole right next to the entrance.
20)The path will need to include lighting. The Town is currently undertaking a lighting study for the Frontage Rd.The
lighting will need to comply.

this area a Memorandum of Understanding will need to be completed. This is
the preferred option.
2)There needs to be signage at this location identifying where accessible
parking is located. In DRT it was discussed that this was likely down near
Arabelle.
3) There needs to be additional signage associated with this parking area
to direct people to the ski yard. There is no sidewa�k this winter along
West Lionshead Circle. Signage should be included in the proposal direction
people to the southeast corner of the parking lot.
4) A general comment was provided requesting that the language of the
proposed sign be reworded to come across a little less harsh.
