Approval1 Department of Community Development 75 South Frontage Road Vail, CO 81657 PH: 970-479-2138 FAX: 970-479-2452 www.vailgov.com May 23, 2013 Town of Vail Planning and Environmental Commission and Adjacent Property Owners Re: A report to the Planning and Environmental Commission on the administrator’s approval of an amendment to an existing conditional use permit and its conditions of approval, pursuant to Section 12-16-10, Amendment Procedures, Vail Town Code, to allow for the continued use of a miniature golf course and the addition of two (2) bungee trampolines, located at 560 East Lionshead Circle/Lot 2, Vail Lionshead 6th Filing, and setting forth details in regard thereto. (PRJ130140) Applicant: Vail Resorts Development Company, represented by Jeffrey Babb Planner: Jonathan Spence Dear Planning and Environmental Commission members and adjacent property owners: The purpose of this letter is to inform you that the Town of Vail Staff has approved an amendment to the approved conditional use permit for the Vail Resorts miniature golf course, and the addition of two (2) bungee trampolines, located at 560 East Lionshead Circle/Lot 2, Vail Lionshead 6th Filing. The conditional use permit for the miniature golf course was conditionally approved on April 4, 2010, with an expiration of October 15, 2013. Staff’s approval includes the following conditions: 1. All conditions of approval for the miniature golf course from the 04/14/2010 approval will remain valid with the exception of Condition #12, expiration date that will be replaced with the following “Should conditions warrant as a result of observations or valid objections related to the operation of the miniature gold course/bungee trampolines, the Planning and Environmental Commission reserves the right revisit this item for additional review.” 2. All new fencing shall match the previously approved and installed four (4) rail split fence. 3. Measures shall be taken to ensure that no staging of participants or spectator gathering impedes the operation of the Gore Valley Trail. The Town of Vail Staff has determined that this amendment to the approved miniature golf course conditional use permit meets the review criteria prescribed by Section 12-16-10, Amendment Procedures, Vail Town Code. This administrative approval of a conditional use permit amendment will be reported to the Town of Vail Planning and Environmental Commission at its Monday, June 10, 2013 public hearing at 1:00 p.m. in the Vail Town Council Chambers, located at 75 South Frontage Road West. The Planning and Environmental Commission reserves the right to “call up” this administrative action for additional review at this hearing. This administrative action may also be appealed by an adjacent property owner, any aggrieved or adversely affected person, or the Vail Town Council as outlined in Section 12-3-3, Appeals, Vail Town Code. 2 Please feel free to contact me should you have further questions.
