Drawer 54D0 Avon Co. 81620 RE: Gore Creek Residences Fi��rep[ace Gas Valves Mr. Johnson, This conespondence is to provide insight and closure to the g�s shut-off valves for � certain fireplaces being installed at the Gore Creek Residences praject. There are two types of fireplace models being i.nstallet� in the project. This correspondence is in regard tQ the "Golden Btount Super-Fire Model SF 4224-TV" u�its only. Inspections for gas-line and fireplace rough installations first began on 1/16/06. The first set of inspections was perfarmed for units I S and 16. At that time our inspector Greg Denckla, approved the gas-piping for the unit as a whole, including the fireplaces. He c�id note corrections that are requireci to be addressed for the fireplac� installation on mechanical permit #MD5�0265 but thought the fir�place gas-line and shut-off valves were compliant to the 2003 IFGs�. Future inspections were requeste:d for units 13 and 1� on 3/10/06. At that tirne, I performed the gas-piping inspection and noted that a correction was required t�ecause of the location of the shut-off valves for these certain fireplaces. This inspectian was performed and noted on mechanical permit# MOS-0213. Again this correction was noted or� 3/15/�6 on mechanical permit#Mfl5-0265. It appears thak there have been three additional inspections performed on gas-lines and �replaces for other units in the Gore Creek Residences project. Some were approved arid others were not approved showing inconsistency on our part. The Town of Vail Buildin� Safety ar�d Ins�a�ctions Services team holds a weekly staff meeting to discuss code related items. The gas-valve- sh�t-off issue is clearly an example of an item we need to discuss and obtain a consistent interpretation. We first discussed this issue on 3/23/06. ,At that time, a vigorous discussion accurx-ed rega�ding the Fuel Gas ���RECYCLEDPAPER ' � � Pg? code requirements and the subs�quent interpretation. At that tiFne I t�ad asked for a copy of the manufacturer's installatic�n requirements to determine if any additional guidance would be pravided. We did not meet again as a team until4/13/Ob. As predicted, another discussion occurred without cornplete res�lution Qn or�bout 4/20f06, I received a copy of the manufacturer's installation requirements. Upon further review of the manufacturer's installation requirements and research of the code requirements, a formal interpretation �vas rendered. Listed below is a copy of the email generated that is now being used as a formal interpretation: Some histary: Prior to ado;ptian of the 2003 IFGC,we had the 1998 IMC or as an alternative the 1997 UMC. The 1998 IMC stated: "Section 947,Shutoff Valves. Shutoff vaP✓es required by section 13051 and serving decorative gas-Fired appliances shall be located outside of the fireplace firebox,adjacent to and in the same room as the fireplace." "Section 1305.1 Appiiance Connection, �very gas o�rtlet shall have an individual shutoff valve.The shutoff valve shall be in the same roam and within 6 feet of the apphiance served. Access shall be provided ta the shutoFf valve" Very Clear Language. The 1997 UMC stated: "Section i312.i4 Barbecue or Fireplace cautlets,Gas outlets in a barbeque shall be controlled by an a,�proved aperating valve located within the same �aom and outside the fireplace but not rr�ore than 4 feet fram the o�atfets. Prior codes that were used were the UMC's 1991 &1988 versions that said basically the same thing. Again Very Clear language but a conFlict in regard to location and distance.WVe had to provide a judgment of the 2 Godes regarding the Ipcation of the shutoFf valve. It was decided then that the more restrictive of the twa requirements�pplied. We now have adapted the 2D03 IFGC. We also tried to review the newer code ta determine if there were any major changes that may affect our administratiora of the new code. We also tried to reaiew this new code to determine if any cfi�anges wer�made that would affect the outcomes oF future interpretations&installations.This may be one of those cases that we misse�d the shift in code language. Here is the 20�3 IFGC: "Section 4Q9.5, Equipment Shutoff Valve; Each appliance shall be provided with a shutoFf valve separate from the appliance.The shutof#valve shall be located in the same room as the appliance, not further t�an 6 feet from the appliance, and shall be�nstalled upstrear�from the union,co�nector or quick disconnect devkce it serve�. Such shutoff valves shall be provided with access. Exception, ShutofF valves for vented decnrative appliances a�d decorative appliances for installation in vented firepfaces shall not be prohibited from being installed in an area remote frorn the appliance where such valves are provided with ready access.Such vaives shall be permanently identified and shail serve no other equipment. Piping from the shutoff valve to within 3 Feet of the appiiance connection shall be sized in ac�ordance with section 402." Not As Clear Language. Regarding the Gore Creek Residen�es,the shutaff�alve is located within the Fre box WLTHOUT ready access. More research irf the code is required. 50,I looked at section 409.5.i for additionai guidance: Section 409.5.1,Shutoff Valve In Fireplace, Equipment shutoff valves located in the firebox of a fireplace sh�ll be installed in accordance with manufact�urer's instructions." Atter review oF the installation manual for this appliance(Gore Creek Residentes), I could not find any information on the shutoff valve, its lacation,ac[ess paints or piping schematics. So we m�sst return back to the other code r � � Fg.3 section 409.5.There is no ready access :o the valve, no permanently affixed label to identify the valve, no guidance from the manufacturer or located separate from the appliance, tE�e interpretation stands as before.The shutoff valve shall be located outside thE�firebox. If I/We make an interpretation and not clear of the consequences, I will be consesvative and stay with a more restrictive interpretation.ThaC wou8d be the one that would keep us out oF trouble in the futwe.
