Town of Vail Firepiace Ordinance In Septemb�r of 1991,the Vail Town Co�ncil adopted an ordirtance which res�ricts te constructian and use of open hearth fireplaces within municipal baundaries. Since that time the ordinance has F undergone numerous changes and revisions, striving for compromise,yet effectiweness in addressing the air quality issue. 7herefore the followring criteria has b�een adopted: ♦ CoRS#ruction of open hearth wood burning fireplaces is no longer permitted within Town of Vaii mwnicipal boundaries. ♦ Dwellin4 Units� Each new dwelling unit may contai�: One (1} EPA Phase YY certified solid fuel burning device and nv mor�tha�t two(2)gas appliances (B vent) OR Two (2) gas fog fireplaces and no more than two (2) gas appliance fireplac�es (B bent). ♦ Restricted Dwellinq Units— Each new restricted dwelling unit may contain: ane (1) gas log fireplace and not more than one (1) gas appliance fireplace. ♦ Accammodation U�its— Each new accommodation unit may contain: One (1) gas log fireplace ar o�e (1) gas appliance fireplace. ♦ Tf two or mare separate dwelling units or accommodation units are combined to form one larger �nit,the combined unit may retain one woodb�rning fireplace (if one already exists) and no more - than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas. ♦ If during the course of a remodel an existing woodburning freplace is altered or moved, the unit must then camply with ali provis�ons of the ordinance.
