♦ T�e Tawn of Vail has adopted the �003 Ir�ternational Mechanical Cocle and the 2003 Internatior�al �
Fuel Gas Code.
♦ All new construction within tl�e Town of Vail is considered to be of unusually tight construction,
th�s all combustion air,is required to be drawn fram outside the structt�re fQr mechanicat
equipment. , � , r

In September of 1991,the Vail Town Council adopted an ardinance which restricts te construction and
use of open hearth fireplaces with�n municipal b�oundaries. Since that time the ordinance has
undergone numerous changes and revis�ons,striving for compromise,yet�ffectiveness irr addressing
the air q�ality issue. Therefore the following criteria has been adopted: '
� Construction of open hearth wood burning Freplaces is nv longer permitted within 7own of Vail
rnunicipal boundaries.
♦ Dwellina Units— E�ch new dwelling unit may con#ain: � ~ �
One(1) EPA Phase II certifed solid fuel burning device and na mare than two(2)gas appliances
(B vent)
OR
Two �2) gas log fireplaces and no mc�re than trnro�(�) gas app��anc� fireplaces (B bent).
♦ Restricted Dwellinq Units— Each new restricted dwelling unit may contain:
O�e (1) gas log fireplace ar�d not more than one {1) gas appliance fir�place.
♦ Accommodation Units— Each new accommodation unit may contain.
Qne (1) gas tog fireplace or on� (1) gas appliance fireplace. �
♦ If twv or more separate dwelti�g units or accommodation units are combined to forrn one larger
unit,the combined unit may retain o�e woodburning fireplace �if�one already exists} and no more
than 2 gas applia�ce fireplaees, or may convert up to two existing fire,places ta gas.
♦ If during the course of a remodel an exist�ng woodbur�aing fireplaee is altered or mo�ed, the unit
must then comply with all provisia�s of the ordir�ance. That is,the fireplace must be canverted to
natural gas or replaced by an �PA Phase II certifed unit.
