♦ T�he Town of Vail has adopted the 2003 Internationai Mechanical Code ai�d the 2003 International
Fuel Gas Code.
♦ All new con�tructior� within the Town of Vail is considered to be of unusually tight construction,
th�S� all �omb�st�on air is required to be drawn ;from outside the Stru�ture, for ,mechanical
equipment. .

Town of Vail Fireplace Ordinance
In September of 199�,the Vail Town Counci!adopted an ordinance which restricts te cvnstructian and
use of open hearth fireplaces within municipal boundaries. Since that time the ardinance i�as
undergone numero�s changes and revisions,striving for compromise,yet effectiveness ir�ad�lressing
the air quality issue. Therefore tlte following criteria has b�en adopted: �
♦ Construction of open hearth wood burning fireplacea is no longer permit#ed within Town of Va�l
municipai boundaries.
♦ Dwellinq Uni�.s— Eac#� new dwelling unit may cor�tain: . �
One(1) EPA�hase II certified solid fuel burning device and no more than two(2)gas appliances
(B vent)
OR •
Twv (2) gas log fireplaces anc� �o more than two �2) gas applian�e fireplaces(8 bent).
♦ Restric'ted Dwellin Units— Each new restrict�d dwelling unit may contain:
One (1} gas log fireplace and not more tfi�an one.(1) gas appliance fireplace. '
♦ Ac�oFnmodation Units— Each new accommodation unit may contain:
One {1) gas log fireplace or one (1) gas appliance fireplace.
♦ If twro or more separate dwelling units or accammodation units are combin�d to form ot�e larger
unit,the combined unit may retain one woodburning fireplace {if one already exists) and no more
than 2 gas appliance fireplaces, or may�onvert up to two existing fireplaces t�o gas.
♦ If during the coe�rse of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the orc�inance. That is,the fireplace must be converted to
natural gas ar replaced by an EPA Phase IY certified unit.
