♦ All new construction wit�in the Town of Vail is considerec� to be af un�sualty tight construction,
th�s all combustion air is required to be drawn from outside the structure for mechanica�
equipmer�t.
Tawn af Vail �irealace Ordinance
In Sept�mber of 1991,the Vail Town Council adopted an ordinance which restricts te canstruction and
use of apen hearth fireplaces within municipa� 6oundaries. Since that time the ordinance has
undergone numerous changes and rerrisions,striving for compromise,yet effectiveness in addressing
the air qe�ality issue. Therefor� the following criteria has been adopted:
♦ Construction of open hearth wood burnir�g freplaces is no longer permitted withi�n Town of Yail
r�unicipa! boundaries.
♦ Dwellina 'Units— Eact� new dwelling unit may contain:
One(1) EPA Phase II�ertifeci solid fuel burning de�ice and no more#han two(2)gas appliances

OR
Two (2) gas Ivg freplaces anc� no more than two {2) gas appliance fireplaces (6 bent).
♦ Restricted Dwellin Units— Each neuv restricted dwelling unit may contain:
One (1) gas log fireplace and not more than on� (1) gas appliance firep�ace.
� Accommodation Units — Each new accomrnodation unit may contain:
One {1) gas log firepl�ce or ane (1) gas appliance Fre�lace.
♦ If two ar more separate dwelling un�ts u�r accommodation units are combi�ed to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may con�ert up to twro existing fireplaces to gas.
♦ If d�ring the course of a re�odel an existing woodburning firepiace is attered or moved, the unit
must then comply with all provisions of the ordinance. That is,the fireplace must he converted to
natural gas or replaced by an EPA Phase II cer�ified unit.
