Frontage Road West Dear Mr. Spence, On behalf of our client McDonald's USA, LLC, we are pleased to electronically submit the revised PEC Conditional Use Permit submittal. We have addressed your May 16, 2013 comments as follows; 1. A traffic study letter is included in this submittal. 2. A written narrative addressing the conditional Use Permit criteria is included in this submittal. 3. A copy of the deed showing the trash enclosure use agreement is included in this submittal. Please note the use is listed in the deed itself. 4. All easements are shown on sheet 2 and 3 of the PEC drawings. 5. The underlying improvements have been removed from all sheets in the PEC submittal. 6. Stamped and addressed envelopes for all adjacent property owners has been sent to you by Fed-EX. 7. The project narrative has been corrected to show 29-seats. 8. A variance request for overall landscaping, landscape minimum width requirements, parking in the front setback, and parking space depth is included in this submittal. The site meets onsite snow storage requirements. The site plan shows an ADA connection from the frontage road to the front of the building. A connection form the hotel on the west side of the property has been added. This connection will also serve the southerly and westerly parking areas. 2. McDonald's has determined that a two-story building is too great of a liability, because of the potential for slip and fall during snow months. Therefore, the current site plan still reflects a single story building. 3. As we have discussed at our previous concept meetings with Mr. Campbell, McDonald's team has looked at several different site plans for this site. We looked at rotating the building 180-degrees, however any drive thru stacking in that configuration would immediately block the main shopping center island. We also looked at rotating the building 90-degrees, but the lot is not deep enough to allow an adequate layout. 4. A variance for the flowing items is included in this submittal. a. A variance request to allow 16.6% total landscaping, and less than the 15-feet minimum width is included in this submittal. b. A variance to allow the vehicle overhang to count towards the required 19-feet deep parking stall is included in this submittal. c. The site meets the required onsite snow storage, so no variance for snow storage is included. d. A variance request to allow parking in the front setback is included in this submittal. 5. McDonald's team has included 3-different elevations showing differing types of architecture which relate to the overall shopping center and the Town of Vail. Our team has met several times with Mr. Campbell to develop the architectural elevations included in this submittal. Additionally, it is our understanding that the Design Review Board, is the governing board for the architectural elevations. The attached revised PEC Conditional Use Permit submittal addressed your latest comments as described in this letter. Please feel free to call me if you have any questions during your review.
