Dear Mr. Winter: One of the many functions of Code Enforcement is to provide for the enforcement of the Town of Vail Municipal Codes. It has come to our attention that the above-described property may be in violation of the Town of Vail Municipal Codes as follows: Reported Violation(s): You are currently redirecting groundwater into the Town of Vail right-of-way without permission. You also have an above-ground, exposed pipeline which is in violation. Section 5-1-4 (DEPOSITING WASTE MATERIAL) of the Town Code states, in part, that : The throwing, depositing, scattering by any person or the permitting by any person of the throwing or scattering of any waste or other material of any kind upon any sidewalk, street, alley, public passageway,public park, open area or upon any private property within the Town shall be deemed a public nuisance. (Ord. 18(1966) §2(c)) We are asking that you submit a Design Review application showing the location of all temporary and permanent proposed pump pits, pipelines (above or below grade) and proposed landscaping plans. You must also contact Leonard Sandoval with Public Works to discuss the right-of-way issues with him. His phone number is 479-2198. Please remedy this situation within 15 calendar days from receipt of this letter. Failure to do so will result in a summons being issued. Your prompt attention regarding this matter will be greatly appreciated and will help assure that Vail continues to be the desirable and pleasant resort community for which we all strive.
