HomeMy WebLinkAboutCode Enforcement - 2004 January 12, 2004 Jeffrey Snyder President, Aspen Tree Condos PO Box 3391 Vail CO 81658 CERTIFIED MAIL-RETURN RECEIPT REQUESTED Re: East sidewalk not cleared New boilers installed without permits or approvals Dear Mr. Snyder: One of the many functions of Code Enforcement is to provide for the enforcement of the Town of Vail Municipal Codes. It has come to our attention that the above-described property may be in violation of the Town of Vail Municipal Codes as follows: Reported Violation(s): You have installed new boilers without the proper approvals or permit. Also, the sidewalk adjacent to the east side of your building was not cleared sufficiently after the last snows. It is also alleged that the contractor used to install the new boilers may not be licensed to do such work in the Town of Vail. Section 12-11-3 (DESIGNAPPROVAL) of the Town Code states, in part, that: A. Scope: No person shall commence removal of vegetation, site preparation, building construction or demolition, dumping of material upon a site, sign erection, exterior alteration or enlargement of an existing structure, paving, fencing or other improvements of open space within the corporate limits of the Town unless design approval has been granted as prescribed in this Chapter. The addition of plant materials to existing landscaping, gardening and landscape maintenance shall be exempt from this provision. B. Violation: It shall be a violation of this Chapter and the building permit for any person to commence, continue or complete work that has not received design approval as prescribed in this Chapter and/or is not in conformity with the plans approved and authorized by the Administrator and/or the Design Review Board and the Building Official. (Ord. 39(1983) § 1) Section 5-1-10 (ICE, SNOW AND OBSTRUCTIONS ON SIDEWALKS) of the Town Code states, in part, that. A. Duty To Clear Sidewalks: It shall be the duty of every owner or occupant of any lot, property, or parcel of land within the Town, or his/her agent, to keep the sidewalks in the public right of way on or adjacent to such lot or parcel of land, free and clear of and from snow, ice, mud, and all other obstructions. It is unlawful to fail to keep the sidewalks free and clear of snow, ice, mud, and all other obstructions. Snow, ice, mud, and other obstructions cleared from sidewalks shall not be deposited in public streets or alleys. B. Notice To Responsible Person: If the Town Manager or his/her designee finds that any portion of a sidewalk has not been cleared of snow, ice, mud, and other obstructions as required by subsection A of this Section and that a hazardous condition exists, the Town Manager or designee shall notify the owner or manager or any property, the lessee leasing the premises or any adult occupant of a single-family dwelling that such person must remove the snow within twenty four (24) hours. Notice under this subsection is sufficient if hand delivered or telephoned to the owner, manager, lessee, or occupant. C. Town Abatement For Noncompliance: If the person so notified fails to remove the snow as required by the notice set forth in subsection B of this Section, the Town Manager or his/her designee may cause the snow removal to be done to meet the requirements of this Section and charge the cost thereof, plus an additional amount up to twenty five dollars ($25.00) for administrative costs to the person so notified. D. Lien: If any person fails or refuses to pay any charge imposed under this Section, the Town Manager may, in addition to taking other collection remedies, certify due and unpaid charges to the Eagle County Treasurer for collection. (Ord. 3(1992) § 1: We are asking that you submit a complete application within 15 calendar days from receipt of this letter. We are also requesting that you make sure your walkways are cleared and in a safe condition. Failure to do so will result in a summons being issued.
