Re: Wall failing and threatening public safety and the right-of-way

Dear Mr. Viola:
One of the many functions of Code Enforcement is to provide for the enforcement of the Town of
Vail Municipal Codes.
It has come to our attention that the above-described property may be in violation of the Town of
Vail Municipal Codes as follows:
Reported Violation(s): The above-mentioned wall is failing and is currently leaning
outward over the public right-of-way. Several areas of this wall have cracked and are in
disrepair.
Section 5-1-1 (DEFINITIONS) of the Town Code states, in part, that:
NUISANCE: For the purpose of this Code, a nuisance is hereby defined as any act
or condition which endangers the public health or environment or results in
annoyance or discomfort to the public or damage to any property or injury to any
person.
PERSON: As used in this Chapter means a natural person, corporation, business
trust, estate, trust, partnership, association, joint stock company, joint venture, two
(2) or more persons having a joint or common interest, any other legal or commercial
entity, or a receiver, executor, trustee, conservator or other representative appointed
by order of any court. (1997 Code: Ord. 18(1966) § 1)
Mr. Viola, I called your office on 03-15-04 and left a voice mail requesting a return call from you
so that we could meet to discuss this issue. To date, I have not heard back from you. The Town
of Vail has placed concrete barriers in one area of failing wall to protect the public and our right-
of-way. The Town of Vail sees this issue as an urgent issue requiring a prompt response.
We are asking that you take action to relieve and remediate the failing wall sections within 3 days
of receipt of this letter and secure the area from public intrusion. We are also asking that you
submit a plan to remedy this situation within 7 days of receipt of this letter. Failure to comply
will result in a summons being issued.
Your prompt attention regarding this matter will be greatly appreciated and will help assure that
Vail continues to be the desirable and pleasant resort community for which we all strive. Please
