Re: Unit 3, 1390 Buffehr Creek Road
Dear Mr. Leach:
One of the many functions of Code Enforcement is to provide for the enforcement of the
Town of Vail Municipal Codes.
It has come to our attention that the above-described property may be in violation of the
Town of Vail Municipal Codes as follows:
Reported Violation(s): You have done work beyond the scope of work approved.
All permits for this job have expired and there have no final inspections
performed.
Section 104.2.3 (RIGHT OF ENTRY) of the 1997 Uniform Building Code states:
When it is necessary to make an inspection to enforce the provisions of this code, or when the
building official has reasonable cause to believe that there exists in a building or upon a
premises a condition that is contrary to or in violation of this code that makes the building or
premises unsafe, dangerous or hazardous, the building official may enter the building or
premises at reasonable times to inspect or to perform the duties imposed by this code, provided
that if such building or premises be occupied that credentials be presented to the occupant and
entry requested. If such building or premises be unoccupied, the building official shall first make
a reasonable effort to locate the owner or other person having charge or control of the building
or premises and request entry. If entry is refused, the building official shall have recourse to
the remedies provided by law to secure entry.
Please contact me within 15 calendar days from receipt of this letter to schedule a time to
allow the Town of Vail to inspect the crawlspace area to determine compliance.
Your prompt attention regarding this matter will be greatly appreciated and will help
assure that Vail continues to be the desirable and pleasant resort community for which we
all strive. Please feel free to call me with any questions, comments or concerns you may
have. My office phone number is 970-477-3417.
Very Truly Yours,
David Rhoades, Code Enforcement Officer
