It has come to our attention that the above-described property may be in violation of the Town of Vail Municipal Codes as follows: Reported Violation(s): The trash enclosure, located at 1705 Geneva Drive, is often overflowing and creating an unsightly condition and a possible health hazard. Also, there is often a trash accumulation at other properties owned by Vail PBK, LLC in the Matterhorn area because they must transport their trash to one central location. Section 5-2-4 (REFUSE STORAGE) of the Town Code states,in part,that: All refuse, except rubble and recyclable materials, shall be stored either in "refuse containers", as defined in Section 5-2-1 of this Chapter, or in "refuse storage rooms", as defined in Section 5-2-1 of this Chapter, at a designated place on the premises, either inside or outside, easily accessible to refuse haulers within the Town, and shall be properly concealed so as to not degrade the architectural and landscaping qualities of the premises. Concealment facilities shall be approved by the Department of Community Development. (1997 Code: Ord. 4(1973)§4(a)) We are asking that you place adequate refuse containers at each property. These properties include,but are not limited to: • 1692 Matterhorn Circle • 1682 Matterhorn Circle • 1699 Geneva Drive • 1705 Geneva Drive • 1706 Geneva Drive Please keep in mind that all refuse containers must be properly concealed. Refuse storage rooms must receive Design Review approval prior to erecting. In our discussions last year I advised you that you may be required to fully comply with the Town Code if the trash/refuse problem continued to happen. The Town continues to respond to complaints at these properties. Please remedy this situation within 15 calendar days from receipt of this letter. Failure to do so will result in a summons being issued. Your prompt attention regarding this matter will be greatly appreciated and will help assure that Vail continues to be the desirable and pleasant resort community for which we all strive.
