Administrative Application
Plat Correction
General Information: Administrative Plat Corrections are required to make changes to previously approved plats where
the character and intent of the original plat is not altered. Examples include address changes, plat note amendments,
plat title corrections, easement vacations, and other minor corrections. This process is intended to allow for the
correction of plat errors and minor plat amendments where no "subdivision" occurs and conformance with applicable
provisions of the Vail Town Code have been demonstrated. Please see Section 13-13, Administrative Plat Correction
Procedures, Vail Town Code for more detailed information, the Vail Town Code can be found on the Town's website at
www.vailqov.com.

The applicant must submit written joint property owner approval for applications affecting shared
ownership properties such as duplex, condominium, and multi-tenant buildings. This form, or similar
written correspondence, must be completed by the adjoining duplex unit owner or the authorized agent of
the home owner's association in the case of a condominium or multi-tenant building. All completed forms

A pre-application meeting with Town of Vail Staff is not required; however, highly recommended. The purpose of a pre-
application meeting is to identify any critical issues pertaining to the proposal and to determine the appropriate development
review process for an application. Please call the Development Review Coordinator at 970-479-2128 to schedule a

Application Submittal
Submit all required information under the submitta/requirements section of this application by the deadlines stated above.
Incomplete applications will not be processed. Upon receipt of a complete application, the Community Development
Department shall review the submitted materials for general compliance with the appropriate requirements of the zoning
code. If the application is not in compliance with zoning code requirements, the application and submittal materials shall be
returned to the applicant with a written explanation of non-compliance.
Recordinq
Following the review and approval of the plat, the applicant shall produce one (1) mylar of the plat for signatures and
recording. The applicant shall collect all signatures except the Town Administrator and the County Recorder, and submit
the signed mylar to the Community Development Department, 75 South Frontage Road, Vail, CO. The Town Clerk shall
record the mylar with any additional declarations or covenants submitted. The mylar shall be accompanied by the recording
fees:
• Eagle County recording fees (made out to Eagle County Recorder).

Mylar format shall be in India ink, 24 inches x 36 inches, scale of 100 feet = 1 inch or larger, margins of 1 '/ inches - 2
inches, and shall match the approved paper copy of the plat.
Planninq and Environmental Commission Meetinq Requirements
1. The applicant, or their representative(s), shall be present at the Planning and Environmental Commission public
meeting. The item will be postponed if the applicant fails to appear before the Planning and Environmental
Commission, on their scheduled meeting date.
SUBMITTAL REQUIREMENTS
The Town of Vail offers two (2) methods for submittal of materials for review of applications. Materials can be submitted
either digitally or on paper. Whichever method you select all materials shall be submitted in that format throughout the
Design Review process. The Town encourages you to consider using the submittal of digital documents and plans.
If submitting digitally all elements of the application shall be uploaded to the Town's share file site as a complete set of
materials. If submitting paper three (3) copies of the materials noted with an asterisk (*) and one (1) copy of all others
are required. The materials necessary to have a complete application are as follows:
❑ Completed application form including owner's signature (cover sheet).
❑ Application fee.
❑ Title report, including Schedules A& B to verify ownership and easements.
❑ Joint Property Owner Written Approval Letter, if applicable (pg. 2). This form is applicable to all applicants that share
ownership of the subject property. For example, the subject property where construction is occurring is a duplex,
condominium or multi-tenant building. This form shall be completed by the applicanYs neighbor/joint property owner.
In the case of a multiple-family dwelling or multi-tenant building, the authority of the association shall complete this
form.
❑ Two (2) paper copies of the plat including the following:
• Paper size shall be 24 inches by 36 inches.
• Scale of 100 feet= 1 inch or larger.
• Margins of 1 '/2 inches—2 inches.
• Accurate dimensions to the nearest one-hundredth (0.01) of a foot for all lines, angles and curves used to
describe boundaries, streets, setbacks, alleys, easements, structures, areas to be reserved or dedicated for
public or common uses and other important features. All curves shall be circular ares and shall be defined by the
radius, central angle, arc chord distances and bearings. All dimensions, both linear and angular, are to be
determined by an accurate control survey in the field which must balance and close within a limit of one in ten
thousand (10,000).
• North arrow and graphic scale.
• A systematic identification of all existing and proposed buildings, units, lots, blocks, and names for all streets.
• Names of all adjoining subdivisions with dotted lines of abutting lots. If adjoining land is unplatted, it shall be
shown as such.
• An identification of the streets, aileys, parks, and other public areas or facilities as shown on the plat, and a
dedication thereof to the public use. An identification of the easements as shown on the plat and a grant thereof �
to the public use. Areas reserved for future public acquisition shall also be shown on the plat.
• A written survey description of the area including the total acreage to the nearest appropriate significant figure.
The acreage of each lot or parcel shall be shown in this manner as well.
• A description of all survey monuments, both found and set, which mark the boundaries of the subdivision, and a
description of all monuments used in conducting the survey. Monument perimeter per Colorado statutes. Two (2)
perimeter monuments shall be established as major control monuments, the materials which shall be determined
by the town engineer.
• A statement by the land surveyor explaining how bearing base was determined.
• The proper plat title format for filing a plat in the town, as outlined in section 13-11-1, Plat Title Formats, Vail
Town Code.
• A certificate by the registered land surveyor as outlined in section 13-11-4, Surveyor's Certificate, Vail Town Code
as to the accuracy of the survey and plat, and that the survey was performed by him/her in accordance with
Colorado Revised Statutes title 38, article 51.
• A certificate by an attorney admitted to practice in the state, or corporate title insurer, that the owner(s) of record
dedicating to the public the public rights of way, areas or facilities as shown thereon are the owners thereof in fee
simple, free and clear of all liens and encumbrances except as noted (According to Section 13-11-5, Title
Certificate, Vail Town Code).
• The proper form for approval of the plat by the Town of Vail as per Section(s), as they apply, 13-11-7, Town
Council Certificate, 13-11-8, Planning and Environmental Commission Certificate, and/ or 13-11-9, Administrator
Certificate, Vail Town Code.
• The proper form for filing of the plat with the Eagle County clerk and recorder as per Section 13-11-6, Clerk and
Recorder Certificate.
• Certificate of dedication and ownership as per Section(s) 13-11-11, Certificate of Ownership, and or Section 13-
11-3, Certificate of Dedication for Mortgage Holder or Deed of Trust Holder, Vail Town Code. Should the
certificate of dedication and ownership provide for a dedication of land or improvement to the public, all
beneficiaries of deeds of trust and mortgage holders on said real property will be required to sign the certificate of
dedication and ownership in addition to the fee simple owner thereof as per Section(s) 13-11-2, Certificate of
Dedication and Ownership, and/or Section 13-11-3, Certificate of Dedication for Mortgage Holder or Deed of
Trust Holder, Vail Town Code.
A certificate by the treasurer of Eagle County that will certify that the entire amount of taxes due and payable upon ail
parcels of real estate described on the plat are paid in full, as per Section 13-11-10, Certificate of Taxes Paid, Vail
Town Code.
❑ Other data, certificates, affidavits, or documents as may be required by the administrator or planning and
environmental commission or council in the enforcement of these regulations, may include but is not limited to:
• Complete and final environmental impact report if required by the zoning ordinance.
• Complete engineering plans and specifications for all improvements to be installed, including, but not limited
to, water and sewer utilities, streets and related improvements, pedestrian and bicycle paths, bridges and
storm drainage improvements.
• Maps at the same scale as the final plat showing existing topography and proposed grading plan (contour
interval requirements same as preliminary plan), a landscape and/or revegetation plan showing locations,
type and sizes of existing and proposed vegetation.
• A map the same scale as the final plat depicting all high and moderate avalanche hazard areas, forty percent
(40°/o) and higher slope areas and 100-year floodplain areas as defined in the hazard ordinance of this
code1.
• Copies of any monument records required of the land surveyor in accordance with Colorado Revised Statutes
title 38, article 53.
• Any agreements with utility companies when required.
• Protective covenants in form for recording.

F�xhibit A,attached hereto;and
WHERLAS,the land being conveyed herein was acquired by the Town of Vail from the
United States h'orest Service in the Land Ownership Adjustment Agreement;znd
W[I1:RGAS,the Land Ownership Adjustment Agreement and the conveyance ofthis land is
consistent with the Vail Comprehensive Open Space Ptan adopted in 1994;and
WIIER�AS, it is contemplated that this conveyance will be concluded through a series nf
tr�nsfcrs tc� adjoining property owners on Ptarnnigan Road that will assist removing private
encroachmcnis from publicly oumed land,providing a boundary between the Town of VaiI and the
Unitcd Statcs l�orest Service property.
NOW,THEREPORE,BE IT ORDAINLD,RY THF,TOWN COUNCIL OF'T'HE TOWN

l. T'he Town Council hereby approves the sale of proper[y for a total purchase price of
$1.212,OU0.
2. Tiie"l�own Council specifcally agrees that the purchase price to be paid by Roy May
shall be paid as foliows:
"Che purchase price for the May property is One I Iundred Twenty-Eight Thousand

Conservation Easement is Six Iiundred Eighty Thousand and 00/100s Dollars
($C80,U00.00)for a total payment of Eight Hundred Eight Thousand Eighty-Nine and
00/1OOs Dollars($808,089.OQ)(the"Total Payment'�,payable as follows:
a. Five Thousand and 00/100's Dollars($5,000.00)upon contract acceptance;and

payable at closing;and

reason held to be invalid,such decision shall not affect the validity of the remaining portions of this
ordinance;and the Towei Council hereby declares it would have passed this ordinance,and each part,
section,subsection,sentence,clause or phrase thereof,regardless of the fact that any one or more
parts,sections,subsecti�ns,sentences,clauses or phrases be declared invalid.

I. DESCRIPTION OF THE REQUEST AND BACKGROUND
The zoning request has been slightly revised since your recommendation of approval on July7,
1998. Additionally, this proposal includes a request for a major resubdivision of lots on
Ptarmigan and Rockledge Roads. The changes in the rezoning are a result of fine tuning of the
proposed plats.
The Town of Vail is applying for zoning on propety which was previously unzoned. This
property was obtained by the Town of Vail under the Land Ownership Adjustment Agreement
(LOAA) with the United States Forest Service. A portion of the land is proposed to be zoned
Primary/Secondary Residential. The Town is working with adjacent property owners who may
purchase this land from the Town. The remaining area will be zoned Natural Area Preservation
District which does not allow for development.

II. BACKGROUND
This proposed resubdivision and zoning change is a one of the final steps in a Land Exchange
with the US Forest Service and the Town of Vail. The basic purpose of the exchange is to
remove Forest System lands from within the Town boundary and to acquire Forest System
Lands that have public or private improvements. One of the critical reasons why the Forest
Service was interested in the Exchange was to address private and public encroachments on
US Forest Service Lands. Lands owned by the Forest Service on Rockledge Road and
Ptarmigan Road were the major issues of concern regarding encroachments.
In the early 90's, the Vail Town Council directed staff to begin working with the Forest Service to
address encroachments on Forest System lands and to identify ways to discourage private
exchanges around the Town of Vail. On Rockledge Road residents requested that the Town
initiate an exchange to address encroachments on Forest System lands. Residents on
Ptarmigan were very interested in protecting a 4.25 acre parcel on the South Side of Ptarmigan
Rd. In 1994, the community completed the Vail Comprehensive Open Space Plan which
identified properties that should be considered for a land exchange. In June, 1995 the Town of
Vail and the U.S. Forest Service signed an agreement to initiate a land exchaige. The original
proposal for the land exchange involved 4 parcels of TOV land totaling 77 acres and 11 parcels
of USFS lands totaling 110 acres. The exchange removes Forest Service lands from within the
Town of Vail and involves a number of de-annexation actions to remove areas the Town of Vail
would not acquire.
In December of 1997, the Town and Forest Service exchanged titles to the involved parcels of
land and now owns the lands identified in exhibits attached located on Rockledge and Ptarmigan
Rd. Throughout the land exchange the Town has worked with property owners on Ptarmigan
and Rockledge to develop a means for residents to acquire the land where they have physical
improvements on Forest Service lands. This subdivision is now occurring simultaneously with
the zoning application. Lands conveyed to private property owners will be deed restricted so
that development can not occur on any land the Town acquired from the Forest Service and is
noted on the plat as well. However, the Town believes thatthe zoning on the property that will
be conveyed to adjacent property owners needs to have the same zoning to take advantage of
additional GRFA and site coverage. This will involve zoning that land which will be conveyed to
adjacent property owners to the Primary/Secondary District. Tract A on both plats and the parcel
on the south side of Ptarmigan Road will, however, be zoned to Natural Area Preservation
District since the intention with these parcels has always been to be maintained as open space.
III. CRITERIA
The PEC shall make the following findings before granting approval of a zone change request:
1) Is the existing zoning suitable with the existing land use on the site and adjacent
land uses?
The purpose of this major subdivision and rezoning is to address private encroachments
on what is now Town of Vail property. The rezoning will be consistent with the zoning
directly adjacent to the exchange properties on Rockledge Road and Ptarmigan Road.

2) Is the amendment preventing a convenient workable relationship with land uses
consistent with municipal objectives
The amendment will facilitate legal access to both Rockledge and Ptarmigan roads.
Completing this exchange and conveying the encroached upon lands to the adjacent
property owners fulfils long stated objectives identified in the Land Ownership
Adjustment Agreement, the Land Use Plan, and the Comprehensive Open Lands Plan.
3) Does the rezoning provide for the growth of an orderly viable community?
Addressing long standing private encruachments on public property helps to support a
viable orderly community by not having private residential structures exist without legal
access and clouded titles.
4) Is the change consistent with the Land Use Plan?
Section 1.9 of the Land Use Plan on page 7 states that National Forest land which is
exchanged soled or otherwise falls into private ownership should remain as open space
and not be zoned for private development. This reference refers to private exchanges.
The exchange with the Forest Service with the Town was a public exchange to protect
open space that may have been disposed off by the USFS. The 4.25 acres of open
space acquired from the Forest Service on the south side of Ptarmigan Road will be
protected by deed restrictions and zoning The land conveyed to individual home owners
will also be deed restricted and will not allow development on lands acquired from the
Forest Service. This zoning request will facilitate the resolution of long standing
encroachments of private roads, strudures, landscaping on public property. On page 10
of the Land Use Plan, the Plan acknowledges that the Town and the USFS need to work
together to address lands that were identified for possible disposal. Lands on Ptarmigan
Road and Rockledge Road were designated as such because of the private and public
encroachments on these properties. This subdivision and rezoning will help facilitate the
resolution of these encroachments.
IV. STAFF RECOMMENDATION
Staff recommends approval of this major subdivision and zoning requests subject to the
following finding:
That the proposed zone districts are compatible with and suitable to adjacent uses, are
consistent with the Town's Land Use Plan and Zoning Regulations, and are appropriate
for the area and that the major subdivision is consistent with the criteria and standards of
Title 13, Subdivision Regulations.
