��o. S, Series of i973, of 'the i'aw� of VaiT , Calorado> as amended, estabTished
th�rteen zoning distrZCts for �ne mur�ic-ipali�y, one of which is tne Special
Deve1opment �istrict;
WH�REAS, Vaii V�llage Inr�, Inc. , a Calarado Corporation , submitted
an ap�lica��on requesting that the Town establish Spec�a7 Development Dis�ric�
6, h�re3nafter referred to as "SD6", for the deve7opmen� on its parcel of 7and
comprising 3.455 acres in the Vail Vi�lage area, County of Eagle, State of
Colorado, more comp7ete7y d�scribed on at�ached Exhibi� "A".
4dHEREAS, �he estab1ishment of the req�es�ed SIX6, wi71 ensure un�fied
and coordinated deve7apment and use af a cr�tical site as a wnoTe and -in a
n�anner suitab1e for the area in which i� is situa�ed.
� WHEREAS, the Town Council considers that it is reasonable, appropr�ate,
and benefic�al to the Town ar�d its c��izens, �nhabitants, and v�sitors to
estabiish said SD6.
NOW, THEREFORE, BE TT ORDAINED BY THE TOW[�I C�UfdCIL OF �HE TOl�1N OF
VAII., CQLO�ADQ, A5 FOLLOWS:
� Section 1 . Ti�1e
This ordinance shall be kr�own as the "Ordinance Es�abTish�ng Special
DeveTopmen� Dis�rict 6".
Section 2. Amendment pracedures F�i�'i17ed; Planning Comm�ssion Report.
The amendment procedures prescribed in Sectian 21 .5Q0 of the Zaning
Ordinance have been fulfiZled, with the r��or� o� the Plann�ng Comr�ission re-
commending the enactment of th�s ordinance.
Section 3. S�ecial D�velopment District 6 �stablished; Amendments to
� Zoning Ord�nance and Q�Eficia] Zon�ng Map.
Pursuan� to�6he �rov�sions of Ar�7cies 3 , 73, and 2� of the Zonir�g
�rdinance, Ord-inance No. 8, Series o-� �973, of the Town of Vail , Colorada, as

a�nended, Speeial Developmen� District 6 (SD6) , a special development zoning
district, �s hereby established for �h� deve]opment on a certa�n parcel of land
compr�sing 3.455 acres in the Vail Village area of the Town of Vail , and the
Zoning Ordinance and the Off�cial Zoning Map are hereby amended by �he addit�on
of the fo� lowing provisions which shali becon�e the seventh Chapter of Artieie 13,
-� the caption of wnich shall be "Special Deve7opment District b" and a map which

sha31 become an addi�ion �o the Officiai Zon�ng Map.
Sec��on 4. P�trpose o� Specia7 Deveiop�nen� nistrict.
A specia] deveiopment district is established to assure comprehensive
devel.opment and use o� an area in a manner that wi� l be harmanious with the
general charac�er of the Town of Va�l , Colorado, prov�de adeq�ate open spac�
and recreationai amenit�es, and pronzote �hc objec�ives of �he Zoning Ordinance
of the Town; ordinariiy a s�ecia� d�strict will be ereated only when the development
density wi11 be lower than aTiowed by the ex�sting zoning, and the development
i5 regarded as complementary to �he 7own by ti�e Town Counc�l , Planning Cor�miss�on,
and Design Review Board, and there are signi�F�cant aspects of the specia7
deve]opm�nt which cannot be satisf�ed under -�he exist�ng zoning.
Sec�ion 5. Appraval of Develapment Plan.
� A. 7he Development P7an for the Vail V�llage Inn which is part of
�ts sa7d app� ication sY�a11 be incor�ora•�ed E�y reference, and made a part of
Special Deve7opment District 6 and constitutes a general p7an and c�uide for
develapment within the Special District.
B. Amendments to the Approved Develvpment Plan which do not change
�ts sUbstance and which are fu17y recomme�ded in a repor� af the Planning Commission
may be approved by th� Tow�t Council by resolution.
C. �'he EnvironmentaT Tmpac� R�port and a supp1e�ental �eport far each
phase of construction which s�ali 6e subm�tted �o the Zoning Adminis�rator in
accordance with Ar�icle 16 hereof, pr7or to the cammencemen� of site preparation,
bu77d�ng construction, or ather impravemen�s of open space.
(1 ) Eac� phase o� the development shail require review and recom-
mendations o�' the Planning Commission and approval by the Tawn Council .
� D. Each phase of the developmen�t shall require the prior approval
of the Design Review Board �n accordanc� w-�th the app1icab�e provisions o�

Hanamoto, Beck and Abey, on February 12, 1976.

to �he Zan�ng Administrator with the p7ans for each phase of the deveiopment.
B. A site plar�, at a sca7e o-F 7 inc� equais A�0 f�e� or larger, shaw�ng
the 7ocat�ons and dimensions of ali bui7dings and structures, �ses �herein,
and all principa�l site deve�opment fea�ures such as landscaped areas, recreatior�a7
faci7 �t�es, pedestr�an plazas and waikways, service areas, dr�veways, and off-
street park3ng and 1oad�ng areas.
C. A preliminary �andscape plan, a� a scale of 1 ir�ch equals 40 feet
� or larger, showing existing landscape fea�ures to b� re�ained or removed, and
showir�g proposed iandscaping and landscaped site deUe7opment �eatures such as
autdoor recreational faci��ties, btcyc7e pa�hs, trails, pedestrian plazas and
wa7kways, wa�er features, and other elements.
D. Schematzc buiTd�ng elevat�ans, sect�ons and -�loor pians, a�
appropria�e sca7es, in suffic�ent deta�l to determine fioor area, general
c�rculation and use locat7on, and general scale and bulk o� t�e proposed
dev�lopm�nt. S�ecific detai1 for these iten�s and the appearance sha71 be
subrn�tted on a phase basis,
E. A volumetric mad�T as am�nded by Cansultan�s, Royston, fianamoto,
Beck, and Abey an February 72, 1976, of the site and the proposed developmen�
documen�ed by photographs, at a sca1e of 1 inch equals 16 -Feet or Targer,
por-�raying the scale and relationshi� of the development ta the site, and �1-
� lustrat�ng the form and mass af s�rUCtures in deveiapm�n�. Suppiementary
volumetric madels shal� be subm�tted prior to constr�ction o� each phase to
ref7ect existing and proposed developmen�.

SectZOn 7. Permit�ed Uses in th� Special Distric�s.

� Section 8. Canditianal Uses �n the Special District.
A. A11 conditional uses as defined in �he Pub� ic Recommadation
�is�rict, 5ection 7.300 0� the Zaning Ordinance, and sub�ect �o the issuance
of a Cond�tio�al Use �ermit in accord with the pravisions o� Article 1� of the
Zoning Ord�nance.
S�ct�on 9. Accessory Uses in t�e Special Districts.
A. A11 accessory uses as de�'ined in the Publ3c Accommodation District,
Section 7.400 a� the Zoning Ord�nance.
Sec�ian 10. Development Standards.
The #'ollawing development standards are minimum deveiopment standards
in the Special D�strict:
A. Lot area a�d site dimens�ons.
� The Sp�c�al D3s�rict shall cons�st of an area totalling 3.455 acres
as specified in 5ection 3 hereof.
B. Setbacks.
The required setbacks sha71 vary as ind�ca��d in the Developmen-� �lan,
provid�ng space for pianting and an acceptable re1at�onsl�ip �o adjacent properties.
Portions of t�e comm�rc-ial space may abu� the sou�h property line.
C. D�stances between buiidings.
7he min�mum dis�ance between �ui�dings on adjacent s��es shail be
as indicate� �n the Deve7opm�nt Plan but irt no case s�a1� be less than 50 �eet.
D. Neight. (S�ory s}�a7T be as defined by the Uniform Build-ing Code. ) �

The intent af the height limits and ranges is that the
� building camplex should be as law as possible. A� this level ot detai1

it is not realis�ic to �ie doGwn a precise maxir�um eleva�ion. Finai designs
with regard to elevation wi13 depend upon �urther detail study and pro-
jection of the buiiding�mass onto photos of the ac�ual si�e conditior�s. The
massing r�speets the spirit of what is desir�d and ��nal heigh�s will be
estab1ished based on fina� dec�sion. The shopping intent is to maintain
the v�llage quality and to main�ain the two story elevations as the �re�-
�ominant height. T�is height can vary upward or downward by half a leve7 .

The gross residential floor area (GRFA) of a�7 buildings constructed
in the Special District shall not exceed lOd,000.00 square feet. The gross
residentia] floor area devated to aecammodation units shall exceed the gross

H. lJseable Open Space.
Useab�e opan space sha71 be �rov�ded as req�ired in t�e Pubiic
Accommodat-ion District, Sec��on 7.508 0� the Zoning Ordinance.
I. Landscaping and Site Development.
� A� 7east 30%of the tota7 site area sha71 be landscape ar�d plaza area.
Landscap�ng and 4ther site development s�all abserve the landscaping concept as
�nd�cated in the approved Development P3ar�.
J. Parking a�d Loading.
(� ) Park�ng and ioadtng sha77 be provid�d as required �n the
Pub7ic Accammodation Disti^ic�, Section 7.510 and consistent w�th the provisions
of Artic7e 74 of the Zoning Ordinanc�. All required parEcing sha7� be within
the main bu�ldi�g ar build�ngs or benea�h accessory decfcs , plaza and patios except
the minimum �ecessary for registra�ion and temporary loading and unioad�ng.
(2) Par�cing shall .be prov-ided for C�arter Buses. .�
{3} Load�ng, �elivery, and garbage faciTities shai7 b� o�f-
s�reet and with�n the structure as indicated on the Development P1ar�t.
Section T� . Ltmitation on Fireplaces.

� Sec�ion 13. Recreat�onaT Ameni��es Tax.
The recreatio�al ar�en�ities tax due for the development wit�in SDb
under Ordinance No. 2, Series of �974 0� �he 7awn of Vai ] , Colarado, shaTi be
assessed a� a ra�Ce not to exceed $0,75 per square �ao� of f7oor area and shall
be paid in conjurtction w�th construction phas�s and priar to the issuance
� of a build�r�g permit.
� 5ection 14. Limitat7on an Existence of Specia� Developr�ent Distr�ct 6
Prior to the adop�ion of the Approved Qevelopmen� Plan, the Town
Council reserves to �he Town �he right �o abrogate or mod�fy Special Development
R�str�ct 6 for good cause tt�rough the enactment of an ordinance; provided, however,
tha� �n the event the Town Council finds it to be appropriate �o consider
whether to abrogate or modify SD6, the procedures sha11 be in accord wit� Artic�e 27
hereof.
