The Planning and Environmental Cammission began at 9 :4R a.m.
�im Viele began the meeting with Ztems No. 4 and 5 . He asked for any
public input. There was none.
Craig Snowdon, architect for I�em No. 5, Riva Ridge South Condominiums,
discussed the sta�f recommendation for this item. The staff
xecommended approval o� the front setback varianc� w�th the condition
�hat the Riva Ridge Sou�h Condominium Associatian agree to not have any
delivery or loading in fromt of the entrance along Wi��ow Creek Circ�e.
Craig, r�presenting R�va Ridge South, agreed to the staff
� recommendatian and condition of approval. �

Rick Pylman gave the s�a�� presenta�ian. He explained that the
applicant was requ�sting an amendment to Special Developmen� District
No. G in order to al�aw the addition of 5,714 squar� feet of grass
residential floor area. This amendment would a11ow the applicant ta
convert exis�ing commercial space (current�y occupied by G�ODS) to a
residen�ial unit. Rick reviewed the design criteria and expla�ned that
there wauld be vary little design impact from the conversion. The
staff recommendation was for app�oval with the following two
canditians:
�. Special Development Distric� No. 6 be amend�d by adding a �ota1 of
3 , 927 squar� �eet to the existing allowance.
2 . The unit be use restricted according to Section 17 . 26. 075 of the
Town of Vai� Subdivision Regulatians.
Peter Jamar, architect for the pxoject, pointed out �hat the reason the
owners were mak�ng this request was because �he existing space was nat
�iab1� as a retail space. He added that the reason the applican�
wished to add a full 1, 787 square f�e� to the existing space was ta
allaw �lexibi�ity for possible future additions. Although �he
• applicant cou�d accept the staff's candition o� additional square
footage, the app�icant did nat agree wi�h the sta�f's �ecommendatian
regarding the rental agreement.
There was a lengthy discussion among the Board and applicant. The
planning m�mbers had mixed apinions. The Board, in general , did not
support the amo�nt of additional space requested. �everal sugges�ians
and changes to the proposa� were of�ered by the Board. Jim poin�ed out
�ha� he did not feel comfortable changing a praposa� and then votang an
so�ething di�ferent than wha� was p�oposed. He felt that the Baard
should rnaintain p�ocedure and vote on the propasal as p�esented.
Pam motioned for approval of the request to amend SDD Na. 6 as per �he
staff inemo wi�h the exceptian that the whale unit nat be restric��d,
but tha� a min�mum of 2 bed�ooms each beinq at least 30o square feet be
res�ricted and �hat the incr�ase af GRFA be 4 , 827 sauare �eet. Also it
would be r�quired �that tha area ta the south be preserved as open as it
exists, tha� the entrance be on the west, and that the existing displ�
space qo to tha ad�ac�n� sho . Th� motion was based on th� assum tp ion
�ha� parkinq spaces for the unit exist. Sid seconded the motion. __
Vote: 3-4 de�eated.
Pea�v mavad to recommend to the Town Counci� denial of the reques� as
pres�nted due to a loss of commercial s ace in the Corer _and the
replacement o� a re�ail space wi�h condominium space that is not
. appro riate �or shor� term rental. Kathv s�conded the motion.
Vote: 4-3 denial .
