General Information: An amendment of the zoning regulations or change in zone district boundaries may be initiated by
the Town Council, by the Planning and Environmental Commission, by petition of any resident or property owner in the
Town, or by the Administrator. Required criteria and findings for such petition are stated in Section 12-3-7C, Vail Town
Code. Relevant sections of the Vail Town Code can be found on the Town's website at www.vailgov.com. The proposed
project may also require other permits or applications and/or review by the Design Review Board and/or Town Council.

Application for Text Amendment
Background:
Ordinance No.19, Series of 2003, approved by Town Council on November 4, 2003,
replaced Title 11, Sign Regulations with a new Sign Code. The new sign code was
developed collaboratively between the Community Development Department, business
owners, signage professionals and the Planning and Environmental Commission. The
new sign code was intended to support the Town's vision of being the Premier Resort
Community while making the code easier to understand, implement and enforce.
Prior to the new sign code, the language related to vehicle signs was located in Sec. 16-
24: Exempted Signs and read:
Signs displayed on trucks, buses, trailers or other vehicles which are being
operated or stored in the normal course of a business, indicating the name of the
owner, business and location, which are applied to moving vans, delivery trucks,
rental trucks and trailers and the like; provided, that the primary purpose of the
vehicles is not for the display of signs, and provided that they are parked or
stored in areas appropriate to their use as vehicles.
The new sign code revised the language of Vehicle Sign and relocated it to Sec. 11-7:
Other Signs. This language reads:
Any vehicles displaying the name of the business associated with said vehicle
shall be used on a regular basis for service and delivery or other vehicular needs
related to that business activity. Vehicular signs shall not be used for the sole
purpose of advertising a business, as determined by the administrator
The new language was effective in removing content based references but does not
clearly convey what is permissible. Ambiguous and vague phrases including "on a
regular basis", "other vehicle needs" and "sole purpose of advertising", for example, can
be difficult for business owners to understand and have proven to be problematic for
enforcement, if not unenforceable.
Proposal:
Staff has initiated this text amendment to add clarification to the code language and to
introduce a site planning standard related to vehicle signs.
Preliminary Analysis:
1. The extent to which the text amendment furthers the general and specific
purposes of the Zoning Regulations; and
The proposed amendment furthers the general and specific purposes of the Zoning
Regulation by improving the ability to describe and enable the fair and consistent
enforcement of signs in the town of Vail.
2. The extent to which the text amendment would better implement and better
achieve the applicable elements of the adopted goals, objectives, and policies
outlined in the Vail Comprehensive Plan and is compatible with the development
objectives of the Town; and

goals, objectives, and policies outlined in the Vail Comprehensive Plan and are
compatible with the development objectives of the Town by working to maintain the
quality of the built environment and Vail as a world class destination resort.
3. The extent to which the text amendment demonstrates how conditions have
substantially changed since the adoption of the subject regulation and how the
existing regulation is no longer appropriate or is inapplicable; and
The proposed amendment is not meant to address a condition that has substantially
changed since the adoption of the subject regulation.
4. The extent to which the text amendment provides a harmonious, convenient,
workable relationship among land use regulations consistent with municipal
development objectives.
The proposed amendment is intended to assist the community in understanding the
regulations pertaining vehicle signage. Staff believes the proposed text amendment will
continue to facilitate and provide a harmonious, convenient, workable relationship
among land use regulations that are consistent with the Town of Vail master plans and
development objectives.
5. Such other factors and criteria the Commission and/or Council deem
applicable to the proposed text amendment.
