1 MEMORANDUM TO:PlanningandEnvironmentalCommission FROM:CommunityDevelopmentDepartment DATE:December8,2008 SUBJECT:Arequestforfinalreviewforanamendmenttoanapproveddevelopment plan,pursuantto12-9C-5,DevelopmentStandards,VailTownCode,to allowfortemporaryskierparkingattheVailMountainSchool,locatedat 3000BoothFallsRoad/Lot12,Block2,VailVillageFiling12,andsetting forthdetailsinregardthereto.(PEC080070) Applicant:VailMountainSchool,representedby JanetRefior Planner:NicolePeterson ______________________________________________________________________ I.SUMMARY Theapplicant,VailMountainSchool,representedbyJanetRefior,isrequesting finalreview,for anamendmenttoanapproveddevelopmentplan toallowfor temporaryskierparkingattheVailMountainSchool,located at3000BoothFalls Road. BaseduponStaff’sreviewofthecriteria andfindings inSection VII ofthis memorandumandtheevidenceandtestimonypresented,theCommunity DevelopmentDepartmentrecommendsthatthePlanningandEnvironmental Commission approves,withconditions the developmentplanamendment. II.DESCRIPTIONOFTHEREQUEST Theapplicant,VailMountainSchool,representedbyJanetRefior is proposing to providetemporaryskierparkingattheexistingVailMountainSchoolsurface parkinglot everyday,fromDecember20,2008throughJanuary4,2009.The Schoolwillbecharging $15percar,asafundraiserfor theseniorclass.There willbeatleast3-4studentsand1adultsupervisoron-sitefrom7:45am – 10:00amandfrom3:00pm –4:00pm.Thestudentswillberesponsiblefor makingsuretheparkinglotiscleanattheendofeachday. Thereareatotal of88spaces intheexistingparkinglot.OnSaturday’sand Sunday’s,30 spaces willbeleasedbyVailResorts,forskiinstructorparking,5 spaceswillbereservedformaintenanceandteacherparkingandtheother53 spaceswillbeavailabletothepublic.The applicant isproposingonesignthat willstate,‘LotFull’tonotifythepublicwhenthelotisfull andtopreventover- parking.StaffhasincludedavicinitymapfortheCommission’sreview (AttachmentA). III.BACKGROUND ThefollowingisabriefsynopsisofVailMountainSchooldevelopmentoverthe last20years: 2 o 1972 -VailVillage12th FilingwasannexedintotheTownofVailandplatted. ThissubdivisionplatshowsLot12thatat8.66acres. o 1972-AtthetimeofannexationAgricultureOpenSpacezoningwasapplied toLot12.Thetotalareaoftheparcelwas8.66acres.Theminimum lotsizeoftheAgricultureOpenSpacezonedistrictis35acres. o 1979 -VailResortsconveyedtheTennisCourtsitetotheBoothFalls Homeownersthroughaquickclaimdeed. o 1979-Thefirsttwostorybuildingwasconstructedonthesite. o 1980-VailResortsconveyedtheland that theSchoolis ontodaytotheVail MountainSchool. o 1979 –Original2-storybuildingconstructed o 1984 –Northclassroomsandrockfallbermconstructed o 1989 –Gymnasiumandstageadditionconstructed o 1992 –Additionalstoryaddedtoexistingbuilding o 1995 –Libraryexpansion o 1999 –Temporaryclassroomstructureadded o 2000 –April24th,VMSreceivedapprovalforadevelopmentplan(master plan)andaconditionalusepermitfortheexpansionoftheschool facilities,includingeightEHU’s o 2002 –Schoolwasredevelopedincludingadditionofland,re-platting,re- zoning,8EHU’s,approximately87,300squarefeetofnewbuilding area,anewsoccerfield,landscaping,re-locationofKatsosRanch Roadand relocation/renovation ofthe‘cabin’(BaldaufHouse,builtin 1906),historiclandmark. IV.ROLESOFREVIEWINGBODIES PlanningandEnvironmentalCommission: ThePlanningandEnvironmentalCommissionisresponsibleforfinalapproval, approvalwithmodifications,ordenialofa developmentplanamendment,in accordancewithChapter12-9C,GeneralUseDistrict,VailTownCode. DesignReviewBoard: TheDesignReviewBoardisresponsibleforthefinalapproval,approvalwith modifications,ordenialofanyaccompanyingdesignreviewapplication. TownCouncil: TheTownCouncilhastheauthoritytohearanddecideappealsfromany decision,determination,orinterpretationbythePlanningandEnvironmental Commissionand/orDesignReviewBoard.TheTownCouncilmayalsocallupa decisionofthePlanningandEnvironmentalCommissionand/orDesignReview Board. VailLandUsePlan CHAPTERII –LANDUSEPLANGOALS/POLICIES Thegoalsarticulatedherereflectthedesiresofthecitizenryasexpressed throughtheseriesofpublicmeetingsthatwereheldthroughouttheproject.A setofinitialgoalsweredevelopedwhichwerethensubstantiallyrevisedafter differenttypesofopinionswerebroughtoutinthesecondmeeting.Thegoal statementsweredevelopedtoreflectageneralconsensusoncethepublichad hadtheopportunitytoreflectontheconceptsandideasinitiallypresented.The goalstatementswerethenrevisedthroughthereviewprocesswiththeTask Force,thePlanningandEnvironmentalCommissionandTownCouncilandnow representpolicyguidelinesinthereviewprocessfornewdevelopmentproposals. ThesegoalstatementsshouldbeusedinconjunctionwiththeadoptedLandUse Planmap,intheevaluationofanydevelopmentproposal. ThegoalstatementswhicharereflectedinthedesignoftheproposedPlanare asfollows: 2.Skier/TouristConcerns 2.1 Thecommunityshouldemphasizeitsroleas adestinationresortwhile accommodatingdayvisitors. 4 2.2 Theskiareaowner,thebusinesscommunityandtheTownleaders shouldwork togethercloselytomakeexistingfacilitiesandtheTown functionmoreefficiently. 2.3 Theskiareaowner,thebusinesscommunityandtheTownleaders shouldwork togethertoimprovefacilitiesfordayskiers. 2.4 Thecommunityshouldimprovesummerrecreationaloptionstoimprove year-round tourism. 2.5 Thecommunityshouldimprovenon-skierrecreationaloptionstoimprove year-round tourism. 2.6 An additionalgolfcourseisneeded.TheTownshouldworkwiththe downvalley communitiestodevelopagolfcourseaswellasothersports facilitiestoservethe regionaldemandforrecreationalfacilities. 2.7 TheTownofVailshouldimprovetheexisting park andopenspacelands while continuingtopurchaseopenspace. 2.8 Dayskierneedsforparkingandaccessshouldbeaccommodated throughcreativesolutionssuchas: a)Increasebusingfromoutoftown. b)Expandedpointsofaccesstothemountainbyaddingadditional baseportals. c)Continuingtoprovidetemporarysurfaceparking. d)Additionofstructuredparking. VII.CRITERIAANDFINDINGS Beforeactingona developmentplanamendment application,thePlanningand EnvironmentalCommission shallconsiderthefollowingcriteriawithrespectto theproposeduse: 1.Relationshipandimpactoftheuseonthedevelopmentobjectivesof theTown. Staffbelievestheproposed developmentplanamendment isconsistentwith thedevelopmentobjectivesof theTown.Theproposalresultsintheeffective useofanexistingparkinglot thatisunderutilizedduringthewinterbreak,for public parking.TheVailLandUsePlanspecificallystatesthegoalof temporarysurfaceparkingtomeettheneedsofday visitor’sinSection2.8, below: 2.8 Dayskierneedsforparkingandaccessshouldbeaccommodated throughcreativesolutionssuchas: a)Increasebusingfromoutoftown. b)Expandedpointsofaccesstothemountainbyaddingadditional baseportals. c)Continuingtoprovidetemporarysurfaceparking. d)Additionofstructuredparking. 5 2.Theeffectoftheuseonlightandair,distributionofpopulation, transportationfacilities,utilities,schools,parksandrecreation facilities,andotherpublicfacilitiesneeds. Staffbelievestheproposedusehaslittletonoeffectontheelementslistedin thiscriterion becausetheparkinglotisexisting.However,Staffdidrequest informationontransportationfacilities(busservice)tothesite,dueto the temporaryskierparking.MikeRose,TOVTransportationDepartment, believesapproximately190peopleareexpectedperdayandthereareextra busesontheweekends,ifneeded. 3.Effectupontrafficwithparticularreferencetocongestion,automotive andpedestriansafetyandconvenience,trafficflowandcontrol,access, maneuverability,andremovalofsnowfromthestreetandparking areas. Staffbelievestheproposedtemporaryparkingwillnotnegativelyimpactthe trafficflow,astheparkinglotalreadyexists.However,tomitigateany possibleover-flowparking,Staffhasdraftedacondition,itSectionVIIIofthis memorandum,thatthereshallbenoover-flowparkingontheRight-of-way, streetorlandscapinganddouble-parkingisprohibited. 4.Effectuponthecharacteroftheareainwhichtheproposeduseistobe located,includingthescaleandbulkoftheproposeduseinrelationto surroundinguses. Staffbelievestheproposed temporaryparking isconsistentwiththe characterofthe area,because the parking lotisexisting. VIII.STAFFRECOMMENDATION TheCommunityDevelopmentDepartmentrecommendsthatthePlanningand EnvironmentalCommission approves withconditions thedevelopmentplan amendment,pursuantto12-9C-5,DevelopmentStandards,VailTownCode,to allowfortemporaryskierparkingattheVailMountainSchool,locatedat3000 BoothFallsRoad. ShouldthePlanningandEnvironmentalCommissionchoosetoapprovethis request;theCommunityDevelopmentDepartmentrecommendstheCommission passthefollowing motion: “ThePlanningand EnvironmentalCommissionapproves the development planamendment,pursuantto12-9C-5,DevelopmentStandards,Vail TownCode,toallowfortemporaryskierparkingattheVailMountain School,locatedat3000BoothFallsRoad andsettingforthdetailsin regardthereto. ShouldthePlanningandEnvironmentalCommissionchoosetoapprovethis request,theCommunityDevelopmentDepartmentrecommendstheCommission makesthefollowing findings: “ThePlanningandEnvironmentalCommissionfinds thefollowingbased uponthecriteriaoutlinedinsectionVIII ofthe December8,2008Staff 6 memorandum: 1.Theproposed developmentplanamendment isconsistent withthe developmentobjectivesofthe Town. 2.Theproposed developmentplanamendment willhaveno negative effecton lightandair,distributionofpopulation,transportation facilities,utilities,schools,parksandrecreationfacilities,andother publicfacilitiesneeds. 3.Theproposed developmentplanamendment willhavenonegative effectupontrafficwithparticularreferencetocongestion, automotiveandpedestriansafetyandconvenience,trafficflowand control,access,maneuverability,andremovalofsnowfromthe streetandparkingareas. 4.Theproposed developmentplanamendment willhavenonegative effectuponthecharacteroftheareainwhichtheproposeduseisto belocated,includingthescaleandbulkoftheproposedusein relationtosurroundinguses.” ShouldthePlanningandEnvironmentalCommissionchoosetoapprovethis request,theCommunityDevelopmentDepartmentrecommendstheCommission adopt thefollowing conditions: 1.Theapplicantshall monitorandenforcenodouble-parkingandno over-flowparkingontheRight-of-way,streetorlandscaping. 2.Theproposed signage requiresanapprovedsigndesignreview application. IamopposedtotheTownofVailgrantingapermitforparkingintheVailMountain Schoollotforthe followingreasons: 1.Thisisaresidentialareaandnotcommercialzoning.Thisisacommercial venture. 2.Weenjoyourvacationtimeinourhomeandalargeincreaseintrafficwill adverselyeffectourqualityoflife.Wehavelivedtherefor 24yearsandpurchased inthisareafortheresidentialambiance. 3.Evenatemporarypermitwillincreasethetrafficandpersonsinthisarea. Presently,peopleparkinthelotanditisnotwellpatrolledbythepolice.I frequentlyamaskedby commutersiftheycanparkinthelot.Mostdosoanyway.I cannotrecalleverseeingaticketissued. 4.Oncethisispermitted,evenonatemporarybasis,peoplewillreturnandpark there.Plus,thiswillsetaprecedentforfutureyearsandwe willforeverbe inundatedbycommutersduringtheholidays.Whenthelotisfull,peoplewilllookto parkonBoothFallsRoadorBaldMountainRoad. 5.Thebusstopcannothandleevenonemorepersonwhoisnotaresidentofthe area.Duringthebusyseasons,theEastVailbusisveryfullfrom8-10inbound and andthe3-4outbound.Itfrequentlypassesthisstop.Waitingfortwoorthree bussesisnotuncommon.BaldMountainstopisworsebecausetheyarethelast stopontheinbound. 6.If theTOVaddsbussestoaccommodatethispermit,itisanincreasedcosttothe system.Whopaysforthis?Thiswillincreasetheworkloadofthepolicedepartment toenforcethenoparkingareas.Doyouhaveextraofficerstodothis?Again,there is acostinvolvedanditshouldbepaidbyVailMountainSchool. Insummary,thispermitshouldnotbegrantedeventhoughitisfor thegoodcause ofstudentfundraising.Itwilleffectthequalityoflifeoftheresidentsofthisarea andtheincreasedcostswillbebornbythetaxpayers.Plus,Ibelievethatthisisa violationofzoning.
