At your req�est I have examined the subject property for the purpose oF evaluating potential
geologie hazards to the dc�plex praposed to replace the existir�g structure thereon,a�d the effe+�ts
of mitigating such hazards as may exist on adjacent properties, in accordance wit�Town of Vail
Regulations Chapter 12-21-13. All ofthe lot is included in the "High 5everity Rockfa[1" zone as
shown or� t�e Torwn of Vail (T01� rock�ail hazard maps (Sheet 9).' The "Del�ris Avalanche High
Hazard" zone limit passes from northwest to soutf�east through the nQrtheast quarter of the lot,
with the downslope boundary coincideat with the southwest (upslope) side of the existir�g
residence, thus incarparating�he southwestern three-quarters of the lot (TOV debris flow and
debris ava�anche haza�-d mapsz}.Finally,the lot appears to be divi�ed raughly in half into the High
Hazard -Amended (Red} and Medium Hazard -Amended �Blue) snow avatanche ha2ard zones on
the upslope and downslope portions respectively,3 although tt�e original TOV avalanche �azard
maps suggest no classification.The current TOV avalanche hazard map places the entire lot�n the
"Possable Avalanche Inf�uence Zone"category.4All of these maps are of small scale and necessarily
generalized. More detailed wor�C elsewhere in the area of the Bighorn subdivisians, and more
particularly with regard to the adjacer�t Lot 8, Bighorn No. 2 Subdivision, have �nore tightly
defi�ed hazard boundaries.Although heavy snow cover has prewented a de�ailed examination af
Lot 7 for this report, close analysis of both color and black-and-white airphotos as well as recent
geological sfudies, together with projection.� af hazard boundaries as s�own on the Amended
Final Plat of Lot 8, adjacent to the southeast boundary of Lot 7, s�sggest t�at t�e high-hazard

The lot lies near the west end of rhe cul-de-sac at the northv,rest end of Lupine Drive, in a location
rnapped by Kellogg,et a!_ (2Q03�)where Pinedale Till,tl�eir rnap unit Qtp, is present at the s�rface.
Pineda[e�11 was deposite� by the last of the valley glaciers t�iat carved the present form of the
upper Gore Creek region during the PinedaSe glaciation 16,040 to z3,000 years ago (16-23 ka}.
The till occupies the lower margins of the Gare Creek Valley From the higher elevations to the
east to about S.5 rniles west of the p�-operty, although i�is frequently covered by younger alluvial
and colluvial depasits. A subtle feature af the till is an erratic train of mostly limestone ar�d
do4omite boulders, same vf them quite Large, alor�g the southern side of the valley near the
upslope lirnit of the unit as mapped. Most of t�ese boulders are distinctly re�tangular with one
dimension 5ignificantty longer,witit frequently-rounded edges,and virtually atl that haven't been
disturbed have a ti�iek liche�► coating and are w�ll incised into the under�ying and sursounding
soil. It is likely that these boulders,which make up a substantial percentage of the larger rocks,
those greater than 3 ft in maximum dimension, present on and in �he v�cinity oF Lot 7, were
loosened from ttae exposed rock ledges by the Finedale glaciat�on, rolled ar fell onto t�e ice as
it retreateci, and as the last melted were depasited c�ose to their origin over 13,000 y�ars ago.
Ot�er boulders, most of�herr� smaller, and cobb�es that are moderat�lyto strongly rounded and
where exposed lich�en-covered,were also deposited as the glacier retreated,although varying rock
types suggest these rocks originated further up valley. Kell�gg,et a1.,describe this unit as follows
(2003, p. 3; metric units converted to English, internal references omitted):

flowed dowr�Gore Creek valley to be jained by other glacsers ot�the south flank
of the Gore RaRge.The terminus of the Pinedale glacier is indistinct, bttt believed
to terminate about 1.9 miles west ofquadrangde.Age of P�nedale deposits in type
area in Wyaming is 16-23 I�a.Mapped as higl�as 190 ft above present stream level
in Gore Creek valley.Thickness at some places as much as about 20 ft.
Overlapping the Pinedale Till at appraximately the 8,400-ft contour on t�e steeper slopes of the
southwestern part of the lot and extendi�g upsloge to about 8,620 ft Kellogg, et al,, map a thin
veneer ofQuaternary colluvrurn, uni�Qc. Sr�rface rocks on this materEal are usually less than 3 ft
in maxirnum dirr�ension, and are derived entirety�rom the�liff's and ledges exposed immediately
upslo�e. Some of these rocks have bounced or roiled further downslope and can be found on Lot
7.T�ey are generally smal ler and m�re angutar than those deposited uncier glacial conditions,and
have �ess well-developed or no lichen coating.The colluaial unit,which will not be disturbed by
construc-�ion, is described as follows (2003, �. 2):
Col[uvium (HolQCene and upper P�eistocene}—Unconsolidated to slightly indurated,
mostly non-stratifed, dark-brown to light-gray-brown deposits that mantle
surfaces thaC slope �ess than about 50 degrees; rock clasts and fine-grajned
material are mixed by downslope movement.Cor�tains angular pe��les,cobbles,
and bouiders deri�ed �'rom weathering of bedroek. I.o�ally overiain by loess, as
thick as about 1.67 ft, composed aFvery f ne grained eolian sand,silt,and minor
clay. Soil development characCerized by an "A" horizon that is typieally 1-4 in.
tt�ick aRd a "B" horizon typi�ally 2-8 in. thick that displays prismatie structures,
indicating clay buildup. Inciudes sh2etwash and some landslides or� slmpes and
minor al�uvium in small channels. Commonly underlies areas covered by open
meadows, sagebrush, and (or} aspen groves. 5maqer roiluvial areas are
unmapped,particularlyv�rhere unit is thin and discontin�ous.Maximum thickness

Bedrock beneath Lat '� is the uppermost pa�rt af t�e lower merr►ber of the Minturn Forrnation,
Fnapped as[Pml,of Pennsytvanian age.The contact between the lawer member and the Robi�son
Limestone member, [Pmr, is covered by either colluvium or tiil,but�n ei�her ease is present in t�e
�illside at or immediately above the southwest boundary of tihe lot. The Robinson Limestone
member, which consists of thic[c limestone and do(omite beds inter(ayered with sa�dstone,
s€Itstone, and shale, forms the cliffs and ledges directly upslope above the lot to the svuthwest
and, much more prominently, ta the immediate west and south. Most of the bo�lders found on
and near the property origi�ated from these exposures. These u�nits are des�rsbed as follows
{Kellogg, et a[., 2043, p. 5):

tan and light-tan, cross-bedded, arkosic, micaceous pebbly sandstone and
light-grayish�pink sandy siltstone and shale. The ratia of carbonate to
clastic rocks is about 1:2.5. Most [individual� �imestone and dolomitrc
�`rmestor�e beds are a.2 in to 7 ft thiCk; many di the beds extend for several
rniles.The lower 60-ft-thick,gray-weathering limestone contains distinctive
laminated, knobby beds and may represent a reef facies.A few of the other
thicker carbonate beds (as much as 30 ft thick) may also represent reefs
and are massive, v�ggy, and grayish-arange weathering. The do[omitic
limestone weathers to pale yellawish brown;the lirnestane weathers pale
gray. Clastic beds typically weather in rounded forms as compared to
relative4y angular weathered forms in the carbonate beds.Thickness r�orth
of Gore Creek abaut 400 �t; south of Gore Creek as thick as about 600 ft.

Al[ of the geologic hazards rnapped as affecting Lot 7 are derived from the exposed cliffs and
ledges of the Robinson Limestone mem'ber 4f the Minturn Formation, and the steep slopes that
have developed belaw them. Actual expos�res direetly uphill from the lot are limited, especially
compared to those present immediately northwest �nd southeast along the outcrop, and the
actual rockfali hazard to the property is thus diminished as welL The beds dip tv the southwest,
into the hillside, at 10° ta 15°.The resulting"keystone" effect tends to hold rocks in place, ever�
where broken by jvinting and weathering has removed underlying support. Exposed rocks that
do eventually fall tend to �reak off in rectangular pieces with a long dimension parallel to the
exposure and sEide downhi�l rather than as rounded shapes that roll and bounce.As opposed to
slopes where the surface and bedding(or other rock surfaces)dip in�he same direc�ion, ror_l�fali
from �his type of slope increases rather than decreases stability. Theee is a distir�ct break in the
slope above Lat 7 between the colluvium unit and the lowest of[he mapped (imestane ledges
(Kellogg, et al., 2003), and all slopes above the lot, including the ledge area containing limited
rock expvsures, are moderately vegetated. All these factors further mitigate the actual rockfal[
hazard to Lvt 7 ta no more than moderate.
Debris avalanches are basically mixtures of debris flows and snow avalanches that can move down
planar slopes as well as in drainages (chutes}. They most commonly occur in spring, during
periods of rapid melting and heavy spring rain that saturates the snow, adding weight while
decreasing cohesiveness and therefore stability ar�d at the same time thawing the tap layers of
frozen soil under the snow, dest�bilEZing both the snow-so€I interface and the Upper soil layers
'I as well. With trees, mud, and rocks as cvmponents as well as snow, they have a greater density
than snow avalanches and therefore greater pptentiaE kinetic �nergy and resulting potential
destructive power. However they a15o move more slawly and because of internal fri�tion often
sto� before even reaehing the�oes of the slopes they are sliding on. The steep slope area abave
the lot is rnodestly convex, the potential slide area is small, and the gradient below 8,4�0 ft
decreases rapidry. Therefore, while as with rockfall the debris flow hazard is not nonexistent, it
is no more than moderate.

With regard to snow avalanche, the speC�fic(ocation of Lot 7 is not known to have experienced
avalanches in historic time,there is no evider�ce of avalanches within a 25-year eetuTn period,and
tf�erefore it wcauld appear that the entire proposed construCtion area is in the Blue zone
(moderate hazarciy, if that. [t is likely that the mitigating measures for rockFall and debris
avalanche described below will be adequate to rnitigate against snow avalanche. However, as
previously advised, avalanche hazard recagnition and mitigatian are specialties i€�whieh[do not
cla�� expertise, and if a more accurate assessrnent of the risk and recommendations for
mi�igation are desired you should seek the opinion of a quali�ed professional in the field.
Lot 7, Bighorn No.2 Subdivision is thus determined to be subject to moderate rackfali and debris
avalanche hazards. A formai rockfall analysis has not been gerfQrmed because surfa�e
c�►aracteristics could not be determined due to snow cover. Bvth hazards may be mitigated in a
nurnber ofways. l would recommend utilizing existfng boutders as shown on the si�e plan worked
into a berm, rock wall, or a cornbination of both in approximately the position indicated by the
b�ue line on the a�tfiached rnodified size plan. "['his structure shauld uttimately extend at least 8
(eight) �t above the original grade on the uphill side.A berm should be constructed of a mixture
af earth and small boulders worked around the existing boulders, compact�d to 85% groctor
density, and s�►ould be at least three (3} feet thick at the tap, w�th a s�ope on �he upper side of
at least 1.5h:1v. Trenching on the upp�r side is acceptable and will even increase the
et�'ectiveness vf the berm, although excavated slapes should have a grade af no steeper than
2�:1v or be suppvr�ed by an engineered retaining wa�l (§12-Z1-12(G)�. In lieu of a berm, a rock
wall designed by a qualified engineer to equivalent strer�gth could be Constru�ed in the same
locativn. A combination a�'berms and rock walls is also a possibility. �I"he structure as a whole
s�ouid be sligh�ly eoncave uphill, and consequently adequate drainage into the site drainage
system either through the structure or via gravity drain(s� on the uphill side will be required.The
uphilI side should be inspected and cleaned as necessary at least annually, or after any known
rockfall or debris avalanche event. l also recomrnend extendir�g vertically as well as horizontally
reinforced conerete walls integral with�he Fou�dat�on to a height of eight�eet, or the tap of the
first f�oor above final grade which ever is �righer, on the uphill side of Unit B, with certified
hurricane-resistant windows an� doors in all openings an this side of the structure. I would also
suggest installation of hurricane-resistant windows on tl�e west-facirag wall af the l.lnit B living
room and both windows and doors on the uph�ll-fa�ing walls of the eastern section of Unit A.
An less-intrusive and Qotentially less-costiy aiternative to the berm and foundation extension
mitigations discussed above wouSd be the insta�lation ofan energy-absorbing fence at t'�e locatian
of the blue line on the madified site plan. Such#'ences use heavy high-strength steel netting held
in place by a system o�'cables and pulleys to restrain Falling rocks and ot�er debris.While design
criteria are dependent on the type of fence and suppoet structure, I would recommend a 10-ft
height as a starting pvint. The installation shotald be designed to restrain tf�e load of a debris
avalanche as wel! as rocks. [t is my understanding that such fencing is tess useful in mitigating
snow avalanche hazards unl�ss speCiflcally designed for the purpose. lf a fence is �sed, the
upslape walls of Unit B should be af 2x8 constru�ction,and certif ed hurricane wir�dvws and doors
sl�oufd still be installed as above.

The Town o� Vail Staff has reviewed the design review application for the proposed new Fischer
Residences Iocated 3796 Lupine �rive. The foflowing is a summary of the comments from this review:
1. The zoning statistics must be corrected to reflect a lot size of 0.869 acres (37,854 sq.ft.), rather
than 0.9 acres (39,204 sq.ft.).
2. The GF�FA basement deduction calculations must be corrected ta address the two units as a
single structure (party wa9�s do not factor into these calculations and both units will have the same
percentage basement deduction).
3. The exterior parking spaces must be shown on the site plan with a 9'x19' box, rather than 9'x18'.
4. The western driveway turn-around does not conform to the minimum 20 faot vehicle turning
radius standards. A turn-around is not required far this unit, but if constructed it should be
fur�ctional.
5. The western driveway turn-around should be r�oved east (min. 2 feet) to accommodate a
landscape buffer between the asphalt and the property bvundary.
6. Adjust the limits-of-disturbance fencing or show other tree protection methods on the site and
landscape plans.
7. Label the top-of-wall and bottom-of-wall elevations for all retaining walls.
8. A Revocable Right-of-Way Permit will be required fior aii existing and proposed improvements
within the Lupine Drive Right-of-'Way.
