property will be a re-circulating water feature using
domestic water only. This water feature will not mix with
the existing surface water-course that starts up-hill on

diverted to an underground pipe and daylight into the
existing pond as it always has. Therefore, we will have SGM
(or similar) engineer the underground pipe based on flow
rates of the existing water-course. This report shall be
submitted and approved prior to installation of proposed
water feature and any landscaping in that may be in
conflict with pipe diversion.
2. A Drainage easement, in a format aproved by the Town
Attorney, shall be granted to the Town for the drainage
noted in condition 1

1. The proposed improvement to the section of the existing
water - course that is located solely on the Zekelman's
property will be a re- circulating water feature using
domestic water only. This water feature will not mix with
the existing surface water - course that starts up -hill on
the neighbor's property. At the point where the existing
water - course hits the new design, the water will be
diverted to an underground pipe and daylight into the
existing pond as it always has. Therefore, we will have SGM
(or similar) engineer the underground pipe based on flow
rates of the existing water - course. This report shall be
submitted and approved prior to installation of proposed
water feature and any landscaping in that may be in
conflict with pipe diversion.
2. A Drainage easement, in a format aproved by the Town
Attorney, shall be granted to the Town for the drainage
noted in condition 1
