This guide has bcen written to help you understand the Town of Vail's development process,projects we are
currently working on, and other information that may be of interest to you, your business and your family.
„, The Community Development Department is eomposed of three divisions: Building,Planning, and
Environmenral Health. The Community Development Departmen� is responsi6le for a wide variery of programs
and projects, which include subdivision planning, reviewing proposals for new construction, reviewing requeses
for variances, condirional use permits, rezonings,processing building permits, restaurant inspections, monitoring
air qualiry, enforcement of the sign code,public art,Housing Authoriry and more.
We know the approval process may be time consuming, but there is an important reason for any development
review: to ensure that all development is consistent with the high standards we strive for in our community and
to ensure protection of the environment and aesthetics that all residents and guests enjoy. To create and
maintain a qualiry communiry,part of ou�role is to ensure that densities, building heights, building setbacks,
proposed uses, constructian methods and signs conform to Town of Vail zoning, building, subdivision, sign and
environmenral health codes. It can be a cumbersome proeess, but it is a necessary one for the future of our
resort communiry.
In order to ezpedite the application process and assist you in meeang schedules, we stiongly recommend that
you consult with the Town of Vail stafJ`'on matters concerning procedures,fees, schedules and submitlal
requirements before beginning the detailed planning for yow project. We are currently in the process of making
changes to the zoning code and building code to make them more effective for both applicant and Town sta,�`:

Review Authority: The Vail Town Council consists of seven members,one of whom is elected Mayor by the other Council
members. The Town Council has the final authority on all decisions concerning annexation,rezoning, creation of special
development districts, and creation of subdivision. Upon appeal,the Town Council can review decisions of the Community
Development Department staff, the PEC and the DRB. The Town Council holds public hearings on the first and third
Tuesday evenings of each month, and conducts work sessions each Tuesday afternoon.

The PEC heazs requests for variances, conditional uses, minor and major subdivisions, speciai development disrricts,
rezonings and condominium conversions. They also review exterior alterarions in the Village and Lionshead azeas. They '
hold public hearings on the second and fourth Monday aftemoons of each month.

serve two year terms. Also on ihe DRB is one member from the PEC,each of whom serves for three months.
The DRB reviews the exterior design of all new conskruction,exterior alterations, decks, fences,retaining walls, walks, color
changes, landscaping and signs wi[h relation to design review criteria. They hold public meetings on the fust, and third
Wednesday aftemoons of each month.

' FROM THE FRONT DESK...
• We currently have three administrative assistants at the front desk area. When cailing in for
inspections, or visiting the office, you will most likely meet Lorelei Donaldson. If you have questions
concerning the PEC or Housing Authority meeting schedules, Amber Blecker, Planning Administrative
Assistant, will be able to assist you. Janeil Turnbull, Building Administrative Assistant, works with the
building division, and handles building permits. These ladies are able to answer many of your
questions, and can direct you to the rigM person for further assistance.
A reminder to all contractors, builders, architects, etc.: PLEASE call in your inspection request at least
24 hours in advance. If you have any doubt as to when you need an inspection, be safe and call to
verify. As the constnaction season progresses, the building inspectors are busier each day, so if you
want an inspection, please call early! When calling for an inspection, please have the permit number,
job name, job address, type of inspection needed, date, time needed, and your name and the
company. We are unable to confirm a spec'rfic inspection time, however we will do our best to meet
your needs.
The inspectors are usually available between 8:OOAM - 9:OOAM and between 4:OOPM - 5:OOPM to
answer questions.
The length of time required for building permit review is now approximately three to four weeks from the
time of complete submittal--so please allow for this time when scheduling your projects.
Improvement Location Certificates (I.L.C.) are required on all projects unless otherwise specified.
Please ask your building inspector 'rf one will be required for your project. There is a 48 hour review
period between the time of submittal to the time a framing inspection can be requested. (Scheduling
and completion of a framing inspection is conditional upon approval of the I.L.C.).
PLEASE NOTE: Effective immedlately, new (project) job sites will be required to have a
drainage/culvert inspection by the Public Works Department before any building construction
inspections can begin. Please call Public Works at 479-2158, 24 hours in advance for this
inspection.
Community Development Goes High Tech!
A stand alone computer program, designed to provide the user with useful information pertaining to
Community Development, is slated for completion in August. The program is entitled "Com-Dev on
Disk," and will provide any builder, developer, homeowner or individual interested in building with DRB
and PEC deadline and meeting dates, as well as general information on the Community Development
Department.
The program is designed to be very user friendly. The program will require the user to input basic
information and should be easy for those who have no computer experience. The program should be
useful for anyone dealing with the Community Development Department within the Town of Vail.
Com-Dev on Disk will also furnish alfowable GRFA for duplex, primary/secondary and single family
zone districts with a minimum amount of information from the user. In addition, the program will allow
the user to answer basic building code questions, including design load criteria, code amendments and,
with basic input, to calculate an approximate building permit fee structure. The mechanical section of
the program will allow the user to calculate the cubic feet per minute required for certain types of
commercial hoods, as well as determine air and duct sizes. The program will have general recycling
, information and provide facts on environmental issues, including current facts on fireplace allowances.

FROM THE BUILDING DIVISION...
The Building Division is comprised of the Chief Building Official, two building inspectors/plans
examiners, one electrical inspector and one building administrative assistant.
The Building Division's primary role is to review all construction plans to ensure compliance with the
applicable codes, including building, plumbing, electrical and mechanical. Other responsibitities inctude:
1. Issuing building permits and collecting permit fees.
2. Conducting inspections of buildings under construction.
3. Conducting landscaping and revegetation inspections.
4. Enforcing building codes.
5. Issuing certificates of occupancy.
The following represent current building division issues which may concern you:
Upcoming Code Adophon
The Town of Vail is currently in the process of adopting the 1991 Uniform Codes. This includes
Building, Plumbing, Mechanical and Fire Codes. We are proposing several minor amendments to the �
code which pertain to development in the mountains. Some of the proposed amendments include: 1) a i
fee structure altowing a fast track system for permits; 2) amendments for the provision of drainage
improvements not necessarily required by the UBC; 3) other amendments to clarify the intent of the
Code which tend to be unclear. Many of the proposed amendments will be editorial in nature. The
project is currently underway, and will be ready for adoption at the beginning of August. Inforrnation
and meeting dates will be available from the Communfty Development Department, and will also be
published in the Vail Trail.
B�ng Statistics `
The following charts and maps detail the building activity for the first six months of 1991 in the Town.
We have broken the Town down into 15 different areas which are shown on the maps which follow.
These are not zone districts. The vafuations are based on cost of construction as provided by the
building permit applicant. The purpose of the maps is to show you where construction is occurring in
the community.
Relocation of Community Development Offices
The Community Development Department offices will be relocated to the old Post Office building across
the parking lot from our existing location. We will be sharing this space with the Code Enforcement and
Community Service divisions of the Police Department. Our hope is to start construction this fall. We
will try to make the transition as smooth as possible so operations will not be disrupted. Our previous
office space will be used for the personnel department, meeting rooms and a public reception area.

FROM THE PLANNING DIVISION...
The Planning division includes the Assistant Director of Planning, three planners, one planning
technician, one intern, and planning administrative assistant. The Planning Division is responsible for
all long-range planning as well as current planning for the Town. The Planning Division's primary
responsibilities include:
1. Developing and updating the Comprehensive Plan for Vail.
2. Conducting special studies.
3. Negotiating between public and private sectors to ensure adherence to the Vail
Comprehensive Plan, to obtain quality development, maintenance of open space, etc.
4. Reviewing annexation requests, subdivision applications and final plats, including plans
for special development districts, and presenting these to the PEC and Town Council
for their review and approval.
5. Reviewing proposals for new construction to ensure conformity to the design review
criteria and zoning requirements, and eventual presentation to the DRB.
6. Reviewing requests for variances, conditional uses and rezoning, and presenting the
requests to the PEC.
7. Reviewing sign applications for conformance to the design review criteria and with the
sign code and presentation to the DRB. �
8. Enforcing the zoning and sign codes, and responding to violations.
9. Inspecting construction and landscaping to check conformity with design review
standards and conditions.
Zoning Code Revisions Continue
Changes to site coverage and Gross Residential Floor Area (GRFA) definitions have been made for all
zone districts within the Town of Vail. The intent of this effort has been to simplify and streamline the
Town's methods of calculating GRFA and site coverage. Amendments to the code regarding affordable
housing requirements are also in the works. Staff is now working on the completion of amendments to
the remaining sections of the code. The draft Development Code Revision Report includes over 200
pages, covers every chapter of the zoning code, and proposes approximately 220 amendments to the
code. While many of the amendments proposed in the report deal with "mechanics," or procedural
issues, there are many substantive changes recommended to the code. For example, the report
includes major revisions to the Commercial Core I district (Vail Village), hazard regulations, parking
requirements, and the definition, administration and non-conforming use chapters.
The staff is currently reviewing the draft and will be working to finalize the report over the ne� month.
Once the report is finalized, copies will be distributed to the Council, PEC and public. Shortly
thereafter, the staff will outline the recommendations in the report to the Council, PEC and Zoning Code
Task Force. Given the scope of the report, it is not possible to cover every recommendation of the
report during these presentations. Rather, the focus of the presentation will be on the major
amendments proposed in the report.
Following these meetings, a series of in-depth joint worlcsessions will be scheduled with the Council,
PEC and Zoning Code Task Force. The purpose of these meetings will be to review the specific
recommendations of the report, receive public comment on these recommendations, and ultimately "
reach consensus on final amendment proposals for future code adoption.

New Survey Procedures
If you are involved in construction this summer, it is likely you will need to provide the Town with some
type of survey information. In orde�to make the Town's requirements for sunreys more easily
understood, the staff has prepared a brief inemo outlining survey information needed at the various
steps of construction. Please pick up a copy of this information from Lorelei at our front desk when you
start your project.
Housing Authorily
Members of the Town of Vail Housing Authority Board of Commissioners were sworn into office on
February 21, 1991. Since that time, in order to get up to speed on issues relating to the provision of
affordable housing, the Commissioners undertook an intensive education process. As a part of this
process, the Commissioners met with individuals who have practical experience and are knowledgeable
in the area of providing affordable housing. Speakers included individuals with expertise in public
financing, private financing and legal issues, as well as staff and Board members of other Housing
Authorities in the state. In conjunction with meeting these individuals, the Housing Authority sought
input from members of the Town Council, community leaders and major employers. The next order of
business for the Authority is the preparation of a business plan. Through the business plan, members
of the Authority will establish priorities and objectives to be achieved over a three to five year time �
frame, establish a specific work program and related strategies targeted to achieving those objectives,
investigate and make recommendations regarding sources of financing for Authority operations, identify
user groups for which housing will be provided, and promote Authority development objectives and a
County-wide cooperative affordable housing effort. Rosall, Remmen & Cares, Inc., a planning, design
and research firm out of Boulder, Colorado, will assist with the preparation of the Authority's business
plan. It is anticipated work on the business plan will be completed by October 1, 1991. Funding for
preparation of the plan was provided by the Town Council.
Census Data
The U.S. Census Bureau is reporting the total permanent population of the Town of Vail to be 3,659
persons. Eagle County is estimated at 20,928 persons (including incorporated and unincorporated
Eagle County. The Town has filed a formal recount request to the Bureau which is currently being
reviewed. According to other sources, the Town should have a permanent population of approximately
4,500 persons. Final statistics and information gathered in the census should be available by the end
of the summer.

The AIPP Board is currently commissioning a piece of art for the main pedestrian stair at the Vail
Village Transportation Center, which will create a memorable and welcoming experience. It is our
intent to commission a piece of art which is reflective of the nature of the community. The type of piece
has not yet been decided. A jury will select three semi-finalists in August. A final artist to design the
piece will be chosen in October. The project will be funded in part by grants and donations from the
private sector. A number of public meetings will be held to discuss the project. The artwork will be
installed in June, 1992 and dedicated in September, 1992.

The Town of Vail is currently spearheading a large number of long-range planning projects. Listed

FROM ENVIRONMENTAL HEALTH...
The Environmental Health Officer's duties include the foliowing:
1. Monitoring the air quality in Vail and developing ordinances to regulate contributing
sources.
2. Conducting inspections of food service establishments for compliance with State
regulations.
3. Enforcing regulations set forth by the State for restaurant operations.
4. Handling complaints concerning public nuisances, such as trash, noise, food poisoning
and water and air pollution.
5. Responding to emergency situations involving hazardous wastes and/or possible
contamination of food shipments or products.
6. Reviewing and approving all plans for restaurants, whether new or remodeled, prior to
the issuance of a building permit.
7. Organizing the Town of Vail clean-up day.
The following are some of the projects that Environmental Heafth has worked on:
Clean Up Day 199I .
Clean Up Day 1991 dawned fair and sunny, a great relief considering that it had been snowing only 48
hours previously. The Town of Vail organized the effort to benefit local charitable and non-profit
organizations by offering $20 per clean up participant to the organization of their choice. The incentive
concept continues to be a great way to involve a considerable number of people.
Saturday morning saw 261 volunteers show up for registration at Golden Peak to collect garbage bags,
don safety vests and receive work assignments for the morning. They all set off at 9:OOAM to collect
trash and return to Ford Park three hours later for a feast provided courtesy of Shirkie Evans and '
numerous local merchants.
Their efforts resulted in 5.48 tons of trash being collected and 39 different charities benefitted from the
effort. IYs all over for another year and we look forward to another event next year.
Fireplace Issue Revisited
This year, the Vail Town Council and PEC have been looking hard at the air quality challenge facing
our community and Valley. According to a 1989 Air Sciences, Inc. report, 57% of Vail's air quality
picture is attributable to smoke generated from wood burning, 39%from dust generated from Interstate
70, and 2% from emissions related to restaurants. The Council and PEC have not taken these figures
lightly and have sought to address the problem in a comprehensive, yet fair manner.
An ordinance, approved February 5, 1991, which would have banned construction of new wood burning �
fireplaces has been the subject of ongoing discussion. A proposal was recently put forth which would
relax this ordinance, while at the same time take steps to address the air quality concern.
The ordinance will be revised to allow one EPA Phase II certified solid fuel burning device or two gas
log fireplaces in newly constructed dwelling unfts and up to two gas appliances. There will continue to
be a prohibition against open hearth fireplaces for purposes of woodburning.

In addition,the newy proposed ordinan�e will prevertit tirepiaces from being relocated and rebuiit during
• a remodel p�ocess unless they meet the new code requirements. Solid fuel (wood) burning devices will
continue to be restricted or prohibited in restricted units and aocommodation units.
When the revised ordinance is passed, the staff wiil begin focusing its efforts on a public education
program. The main focus of the program will be to inform the public of the various aftematives
available to reduce the amouM of particulate pollut'an coming irom existing units. The information will
cover solid fuel altematives as well as natural gas options. The Counal has set a goal oi a 50%
conversion of the existing fireplaces through a volur�tary program by June of 1994. The Town is also
wortcing on improving road sanding practices and coordinating this effort with the Colorado Division oi
Highways.
