Dear Bill,
Thank you for your assistance to date on resolving the GRFA/dwelling unit situation at
Casolar. Obviously this is a very important issue for our client, Todger Anderson, who
owns the two remaining un -built lots at Casolar.
As you may recall we provided you with an analysis of existing GRFA based on our
review of floor plans that were available from Town files. At that time you indicated our
analysis did demonstrate that a substantial amount of remaining GRFA is available but
noted a minor discrepancy in how we calculated basement level/walk out space and how
Town codes state these calculations should be made. Attached you will find an updated
analysis in accordance with how the code stipulates walk out levels are to be calculated.
I expect that in the near future Todger will ask us to prepare a variance request for the
number of dwelling units allowed at Casolar. Prior to doing so I would appreciate your
help with the following:
Remaining GRFA
Based on a Buildable Site Area of 105,080 sq. ft. the allowable GRFA is 37,800 square
feet. Based on our analysis of the floor plans for the eight lots that have been built on,
29,950 sq. ft. of GRFA exist currently. As such remaining GRFA at Casolar is 7,850 sq.
ft. A slope analysis and GRFA analysis of Casolar is attached.
Assuming these numbers are deemed accurate I would request written confirmation from
you regarding Casolar's available GRFA.
Allocation of GRFA
It is my understanding that for zoning purposes the Town considers Casolar one lot. Can
I then assume that the Town has no interest in the "allocation" of GRFA, i.e. the amount
of GRFA that may be constructed on any one lot? The projects CCR's do establish a limit
on the square footage for each lot but these are private covenants that the Town is not a

party to. Obviously any development would need to conform to other site
development /zoning standards of the RC Zone District, but I would appreciate
confirmation that the Town is not regulating the amount of GRFA on individual lots.
Site Coverage
Allowable site coverage in the RC Zone District is 25% of the total site area (142,963 sq.
ft.), or 35,741 sq. ft. In lieu of doing a detailed calculation of existing site coverage we
have calculated the total site area of all ten lots to be 24,221 square feet. If we assume
that 100% of every lot is covered with buildings the site coverage would be 17% of the
total site area. This is well below the maximum allowable site coverage. Please confirm
that this assessment is sufficient for determining that site coverage is not an issue with the
future development of Lots 4 and 5 (i.e. that no further comprehensive assessment of site
coverage will be required when development of the remaining un -built lots occurs.

Thank you for submitting the existing GRFA calculations for Casolar. I know this has been an arduous process
for your client to just get to this point with the homeowner's association and the Town's zoning regulations.
It appears the existing GRFA calculations you have submitted are accurate based upon the best available
information.
Your letter identifies the buildable area of Casolar as 105,080 sq.ft.; however, the topographic survey identifies
the buildable area as 105,000.8 sq.ft. The Residential Cluster District allows 36 sq.ft. of GRFA for each 100
sq.ft. of buildable lot area, so the total allowable GRFA of 37,800 sq.ft. identified in your letter is accurate.
For zoning purposes, the lots in Casolar are considered one entity and the standards of the Residential Cluster
District are applied to Casolar as a whole. You are correct that the Town's zoning regulations do not "allocate"
the GRFA for the individual lots in Casolar. Unlike other cluster developments in Vail, Casolar does not have
existing plat restrictions allocating the distribution of GRFA within the development. The allocation of GRFA
within Casolar is therefore generally at the discretion of the home homeowner's association. However, as you
are aware every future addition and new structure in Casolar will be evaluated by the Town of Vail for
compatibility with "existing structures, their surroundings, and Vail's environment" as part of the design review
process.
Your letter is accurate in determining the allowable site coverage in Casolar as 35,741 sq.ft. Unfortunately, the
existing site coverage can not be calculated based upon individual lot sizes in lieu of measuring the actual
existing structures. Not every dwelling unit in Casolar fills the entirety of its individual lot, several structures
were not originally constructed within the platted individual lots, and overtime additions have been constructed
outside of the individual lot boundaries.
It appears that most of the information needed to calculate Casolar's existing site coverage based upon the
existing structures (not lots) in accordance with Chapter 12 -2, Definitions, Vail Town Code, has been included
with your GRFA calculations.

available information), but can we take your comment to mean that the town is acknowledging /accepting the

Good catch, just a typo.

proposal to put all 7,850 sq. ft. on one lot. I suspect the sq. ft. will be allocated along the lines of how the other

trying to eliminate an issue with minimal effort.
It appears that most of the information needed to calculate Casolar's existing site coverage based upon the
existing structures (not lots) in accordance with Chapter 12 -2, Definitions, Vail Town Code, has been included
with your GRFA calculations. I recently received more info from the survey work that was completed for
Casolar. This should make it pretty easy to nail down an accurate site coverage number and clarify this along
the lines of how we have addressed GRFA.

RE: Proposal to vacate a portion of Sandstone Road R.O.W. /Casolar Vail lots 4 and 5
Gentlemen:
Thank you both for your time thus far with the work we are doing on Casolar Vail. Over the past
few months we have made great progress in resolving issues with the remaining development
potential for Casolar Vail. We are now focusing our efforts on the building location and design
of the last two remaining lots. In that regard the purpose of this letter is to outline our proposal
for the Town Council to vacate a portion of the Sandstone Road right -of -way. This request is
made on behalf of Todger Anderson, owner of Lot 4 and Lot 5 of Casolar Vail.

Sandstone Road R.O.W.
The Sandstone Road right -of -way proximate to Casolar Vail was created by a series of three
subdivisions. While adjacent to each other, it appears that there was little coordination in the
platting process of these subdivisions. The end result of this platting was a road right -of -way
that includes only one - quarter of the area needed for a cul -de -sac. A diagram of this existing
r.o.w. condition is found on the next page.

The request to vacate this portion of right -of -way is justified by the following:
• The land area on the remaining 3 /'s of the cul -de -sac has been platted and is now a part of
privately owned lots, hence there is no opportunity to complete a "full circle" for the cul-
de -sac. The '/ portion of the right -of -way is now obsolete.
• A cul -de -sac has been constructed at the end of Sandstone Road, as such from a traffic
circulation perspective a second cul -de -sac is not necessary.
• Based on an initial evaluation from Public Works, the land area included in this '/ cul -de-
sac area is not necessary for road operations or maintenance.
The '/ cul -de -sac was dedicated to Eagle County by the original developers of the Lions Ridge
Subdivision. The Town of Vail assumed ownership of this right -of -way when this area was
annexed. The Town has no practical use for this awkward portion of right -of -way. If this
request is approved by the Town this portion of right -of -way would transfer back to the Casolar
Vail Homeowners Association.
Casolar Vail
Casolar Vail is zoned Residential Cluster and includes ten lots. Eight of these lots have been
developed, each with a duplex. The project covenants stipulate that one single - family home and
one duplex are permitted on the two remaining lots (lots 4 and 5).
While the original intention of Casolar Vail was for all homes to be accessed via the Casolar Vail
private drive, existing site conditions make this a very challenging proposition. Lot 4 is located
18' above the elevation of the private drive, creating significant design challenges. The
driveway to an adjacent home encroaches into Lot 5 and encumbers approximately 20% of this
lot. Finally, the Casolar private drive significantly exceeds road grade standards and the addition
of more traffic from new homes would exacerbate this situation. For these reasons consideration
has been given to accessing Lots 4 and 5 from Sandstone Road.
Benefits of Vacating a Portion of Sandstone Road R.O.W.
If approved by the Town, the land area to be vacated would become a part of the Casolar Vail
common area. The owner of Lots 4 and 5 would then work with the Casolar HOA to re- locate
the two lots in a way that would allow for site access from Sandstone Road. Ultimately
application would then be made to the Town to re -plat these two lots.
The primary benefit of this road vacation would be to avoid site design issues inherent in
accessing Lots 4 and 5 from the private drive. While a nominal amount of additional GRFA
would be created by the new land area that would be added to Casolar Vail, the main reason for
this request is the flexibility that would be created in the design of the last two remaining lots.
