Dear Ms. Ochs:
As you know from our meeting on December 16, 1999, we represent the Foreys
who are the owners of �he above-referenced property ("Lot 6"►. The Foreys are in the
midst of a remodel of the residence on Lot �. An improvernent location certificate was
recently performed �y Int�r-Mountain Engineering, Ltd. which showed that the
elevation of the �oof peak may exceed Town of Vail height limitations in two places.
Beca�ase of this, the Town has taken the position that work must stop and that no
inspections rriay be performed an the praperty.
At our meetirag on December 16, we explored several possible salutians, The
Foreys and I are evntinuing to research the matter but in the interom requested
permissian #fl put a front daar on the residence in order to secure items being stored
there and requestad permission to contir�ue rrvith canstruction and inspections.
!t was made clear to Karen Forey and to me that the Foreys proceed at their
own risk. Prior to receiving a temporary certificate of occupancy or a final certificate
of occu�ancy, the height prablem must be eesolved to the satisfaction of the town
either by demonstrating compliance as the roof �peaks now exist or by taking remedial
action to lower the peaks. We apprec�ate your cooperation in letting the Foreys
proceed with work.
