Our files show that you are the owner of record owner tor tl�e Creekside Building, which is located at 223 East
Gore Cr�eek Drive in Vail. For sozxie tzzne naw, the slaff at khe Town of Vail has been aware of a number of
issu�s concerning the canditian of the Creekside Builciinb. More recently, in conducting a fir�al inspection for
building perr��it number B97-0251, the remode� of the G�re Cree�C Gzill, ihe Suildinv Safety & Inspection
Services Divisi�n and dhe Town of Vail F�r� Departcnent discavered many additivnal violations of the town's
mininauzn safety standards relating to public l�ealth, building codes and fire c�des.
The violations of minimum adopted standards and regulatians that were immediately apparent are listed as
follows:
1) Sewage Ejector Pits. There are tw�o open sewage sumps located in the bas�rncnt. Accc�rdin� to plumbin�;
and �ealth cades, these sumps, whic� are part of a sewage ejectoi� system, must be sealeci by a �;�sket�d
cover and vented to a location above the roof (Sec�. 710.1 D, f 994 L/"nifar�n PCi�rnhir�g Code (UPC)). In
addition, sewa;�e ejector systems that se�ve areas acc�mmUCiatin� the public must als� be equipped with
dual, backup pumping systezns in thc event that th�: primary sy�tem s}ao�ild fail (Sec. 710.�, 1I�4 U'PC}.
There are signs that raw szwage has overtZowed int� the basement of thz building. This is also a potenlial
violation ofCRS 25-i-107(m), which co�tld be enforc�d through t�le Water Quality divi5ion o#�the C�lorado
Department of Pttblic Health anci Education. Pleasc nc�tc that this violation alane c�uld result in an order t�
vacat4 the buildin� until suc11 time chat tllis unt�cccptable ec�n�iition has 4�e�:n satisfactor�lv corre�t�ci.
?) Unlatir�ful Canstruction. A ply�voad shed roof structure t11a� ��as apparel�tly constr�zcted on ihe east si�e of
the buzlding soinetime last year wa:� built without the required DRB appraval anc� withc�ut the requir�d
buildin�; permit and in--pro�;ress inspections ("Se�:tiort.r 1(1b, 108 and 1(�9, 1997 L'niform Bzcilclitzg Cade
(UBC)). li� addition, it is highly unlik�ly tllat thr; Uniform Building Code {�[;BC), as adopted by the town,
will permit a co�nbustible, non-fire-resistive structure with unprotected opc,nin�s t� be built in such clase

praximity to th� property line. In any case, the use of plywood on the exterior does not meet the town's
design standards.
3) Building and Fire Codes Carreetions. A number of required corrections were no�ed at the time of the
final inspec:taon for the Gore Creek Grill. These include clearing the emergency exit from the basernent of�
ihe huiIding, changing the door swing of the gate at the back d�ck to swing in the direction of emergency
egress travel, repairing an unsate section of guardrail at the dec�C to conform with S�ection �09 of the UBC,
relocating either the decorative, suspended light fixtures or the f re sprinkler �eads iaa the dining room so
that th� sprtnkler heads provide coverage for the areas below the light fixtures, re�vor�in� the kitchen
equrpment line so that equipment is �ocated under the Type I hood as required and revising the automatic
suppression system for tk�e l�itchen hooa so that open burners are covered by the system, etc.
4) DRB Approval Co�ditions. The Design Review Board (DRB) approval for improvements to the building
iz�c�uded conditions tlaat the entire east side of the building and the decks, rails, fascia, etc., be repainted.
This work has not been completed to date.
5) Unapproved Items. The umbrellas, new wind screen and Cluistmas lights were illegally insta�led and must
be removed or a DRB ap�roval for them must be obtained.
6) Exterior Lighdng. Some of the extersor right fistures, i.e., floodlights, do not comply �avith the town's
lighting code or electrical code and must be removed.
7) Exterior Starage. The property owner and/or tenants are storing items outside of the building on the east
side of tl�e property. This storage is not permitted, and these items must be remov�d immediately.
8) Drainage into Gore Cree�:. It appears that some sort of unidentified liquid waste may be draining into
Gore Creek.
Nate that this list may not be complete, but inc�udes anly the vialations that were readily apparent after a review
of our files and at the time of the most recent insp�ction.
Sectic�n 104.2.5 of the 1997 edition of the Uniform Buildin� Code {UBC), as adopted by the Town of Vail,
reads as follows:
"104.2.5 Occapaney violations. Whenever any buildin� ar structur� or equipment therein
z�e�ul�ted by this code is bein,� useci contrary to tl-►e provisions of this code, the building of�cial
may order such �ise r�iscontinu�ed and khe structure, or pc�rtion theseof, vacated by notice server�
on any person causing such use to be continued. Such person shall discontinue tl�e use within tlte
time pres�ribed bv the buildin�,� ot#icial after �•�ccipt of suc1� notice ta make tlz� structure, or
pUrtic�n ch�;re�f, comply with th� r�:quir4�n�nts c�f thia code."
The electrical, fire, mechanical and plurnbing cc�des adopteci by the Town of Vail have simi�ar provisi�ns f'or
enFc�rcement. Tnis lettzr shall serE�e as writtera nc�tiee to youu tl��t the property is ir� violatian of the buildin� and
fire codes adopted by the Town of Vail, which are found undc:r Title 1 Q of the Town of Vail Municipal Code
and the zonin� regulations of the Town of Vail, �vhich are found under Tit1e 12 of the Town of Vail Municipal
Code.
Please respc�nd in wr�ting �o this letter within thirty (3Q} days, or b no later tha❑ December 10, 1999, with a
detailed proposal tc� bring t�� property into compliance with the minimum public health, safety and welfare
requirements of the Town of Vail. If you shoulci fail to respond by December 10, 1999, or subsequently fail to
implement an approved plan for compliance, the Town af Vaii will have no recourse but to arder the affected
portions of the property vacated and to take le�al actibn against you in order to achieve compliance.
Of course, legal actifln should always be a last resort. The Town of Vail staff wQUld rather serve as a resource
tti work with and assist you in meeting the minimum health and safety standards that benefit all of the tawn's
busirness owners, residents and guests.

We are planning to start construction on Sweet Basil Restaurant located at 193
East Gore Creek Road in late April. We plan to use the adjacent right of way for early
AM deliveries. We will have use of the existing dumpster located at this restaurant for
our use to remove �onstruction debris. 4ur employees wil� use the Vail parl�ing structure
