Dear Planning and Environmental Commission:
The owners of units #1602, #1605, & #1608 at 4460 Timber Falls Ct are requesting a variance.
Neighboring buildings have begun to upgrade their exterior decks and my clients have decided to do the
same, maintaining the sense of uniformity the Timber Falls association likes. However, a strict adherence
to the online code of the Town of Vail and the existing size of the property is creating a practical difficulty.
The amended final plat for the Timber Falls Condominiums, Phase VII from 1979 shows previous phases
of development and indicates future development areas to the north and south of the property in question
(Fig. 1). There have been later phases of construction in the Timber Falls community during the past
thirty-four years that have developed the north portion of the property. And according to the Timber Falls
representative the association is fully developed. No buildings will be added to the area in the southwest
corner of the property.
The other buildings in the complex are in neighboring proximity to buildings or property lines with other
associations and a strict adherence to the code would seem in order. What makes the situation unique
for the south wing of 4460 Timber Falls Ct, and the reason for the variance request, is the undeveloped
area of the property to the south.
In order for my clients to meet their goals and be compatible with the wishes of the association we are
requesting a variance to the setback requirements in the Town of Vail online code for the south wing units
of 4460 Timber Falls Ct. The south exterior face of the building is located twenty feet from the property
line, which is the setback requirement for a medium density multi-family zoning district described in the
Site Development Standards (14-8-1).
The Site Development Standards state that ground level decks are permitted to extend into the setback
half of the setback distance or ten feet, whichever is less. They also state that upper decks are only
permitted to extend into the setback half of the setback distance or five feet, whichever is less.

To meet the uniformity rules of the association we are requesting a lifting of the setback requirements for
the exterior decks of the south wing so they can extend into the setback ten to twelve feet for all levels.
Permitting of this variance will only ease the setback requirements. None of the decks will cross the
existing property line (Fig.2). The undeveloped land owned by the association will not be compromised.
In addition, this variance request will have no effect on light and air, distribution of population,
transportation and traffic facilities, public facilities and utilities, or public safety. Nor will acceptance of the
variance have an effect on the existing or potential uses of structures in the vicinity.
