Dear Mr. Banner, Mr. Valfs, and Mr. Fleeger:
Thank you for your wilfingnes� to work co9laboratively with the Town o#Uail to restore the
publically-owned stream tract �roperty adjacent to each oF th� referenc�d praperties to a healthy
riparian area. Per discussions wifh all three property owners and Gearg� F�uther, Director,
Community Development Departm�nt, on December 5, 2013, ancE a su�se�uenf inee#ing wi#h
the praject contractor, Scott Sones, Landsca�e Archi#ect, on .fanuary 6, 2�1�, the following
terms and conditions were agreed up�n as conditians 4fi compGance and remediataon.
Property owners (�anner, Valls and Fleeger) will:
1. C�ntract with a Landscape Arc�i#ect to submit a land�cape plan ta#he
Comrnunity �e�velopment Department by January 17, 20'i4 for r�:�iew and
approv�ap prior ta initia#ing any work within the stream tract.
2. Contract with, and procure the services af L.andscape Architect ar�d
Landscape Cor�tractor ta remove ali nan-native turf grass and plant a mix of
nat�ve plants, including a g�ass seec[ mix, shrubs, willr�ws, and oth�r riparian
species.
3. Comple#e the installativn of the wark by June �5, Z014
4_ Gontinue to irragate fhe res#orec! area for two years followir�g fhe instalCation ta
insure praper germinafiQn and growth. Following the two year period (June
15, 2016), cut and cap the irrigation syst�m at the praperty line.
5. DFSCOntinue all �nauthorized activities in the town-ovwned s#ream tract.
fi. Acknowledge that all work instailed by the property awners will be owned by
#he Town from installation therea�ter.
7. The property owners shall be the responsible for the cost of the stream ract
restoration w�rk.
The Tawn of Vail wi1l:
1. Review and approve the submitted landscape plan by January 24, 2014. I�
the plan can not be appro�€�d at that time, tf�e Town wili prc��ide a writtert list
Qf�ssues which E-riust be addressed ta make tl�e plan approvable.
2. Purchase and sup�ly the native grass seed mix.
3. Inspect t�e work far acceptance upon �ornp[etion.
4. Maintain the stream tract, including weed cor�trol, as deemec� appropriate by
the Town.
