Dear Mr. Ruther:
Rush Condominiums is a four-unit condominium project located at 2821 Basingdale Boulevard.
The owners of Rush Condominiums have learned that the vacant lot immediately adjacent to
Rush Condominiums on the west and located at 2841 Basingdale Boulevard was recently sold.
We want to call to your attention that development of 2841 Basingdale must take into account
the dependence of Rush Condominiums on a parking easement for the benefit of Rush
Condominiums located on the easterly end of 2841 Basingdale.
Parking for Rush Condominiums is extremely limited. It is, of course, an "older" condominium
project, having been built in approximately 1972. The standards for parking in Vail in 1972
were undoubtedly less stringent than they are today. There is insufficient parking for Rush
Condominiums, even with the use of the parking easement. Thus, the use of the parking
easement on 2841 Basingdale is critical to the owners and occupants of Rush Condominiums.
We ask that in approving any future development of 2841 Basingdale, the parking requirements
of Rush Condominiums be taken into consideration. We welcome the opportunity to
constructively resolve the parking issues incumbent on Rush Condominiums when you and the
Town of Vail Design Review Board are evaluating the proposed development of 2841
Basingdale.

On behalf of the Town of Vail and the Community Development Department, I would
like to thank you for your recent correspondence of April 30, 2014 regarding the parking
situation at the Rush Condominiums and the existing parking easement located at 2841
Basingdale Boulevard. Please also thank your husband for his assistance in relaying the legal documents. The Community Development Department is committed to
ensuring that existing easements are honored and that parking issues are addressed
collaboratively.
Your correspondence will be placed in the legal files for both the 2841 Basingdale property and the Rush Condominium property, allowing for it to be readily available
during the future review of any proposed development.
