RESOLUTION AUTHORIZING THE VACATION OF EASEMENT
WHEREAS, the Eagle River Water and Sanitation District is a quasi - municipal
corporation and political subdivision of the State of Colorado, formed and operated
pursuant to Article 1, Title 32, Colorado Revised Statutes; and
WHEREAS, the Board of Directors of the District is empowered to acquire or
dispose of real and personal property pursuant to Section 32- 1- 1001(1)(f), C.R.S., and to
authorize its designees to act on its behalf; and
WHEREAS, the Board of Directors of the District has determined that the
vacation of the easement described on Exhibit A attached hereto and incorporated herein
by this reference ( "Property") is to the public benefit, health, safety, and welfare.
NOW, THEREFORE, be it resolved by the Board of Directors of the Eagle River
Water and Sanitation District that the easement Property described hereinabove shall be
vacated for good and valuable consideration, and hereby authorizes the General Manager
to execute any and all documents required to effect such vacation.
ADOPTED AND APPROVED this 22nd day of May, 2014.

Re: Lot 15, Block 9, Vail Intermountain Development Subdivision
Dear District:
We represent 2754 Snowberry Drive, LLC., which is the record owner of Lot 15, Block
9, Vail Intermountain Development Subdivision, situated at 2754 Snowberry Drive, Vail,
Colorado ( "Lot 15 "). On December 27, 2000, a Claim of Easement was recorded by Eagle River
Water & Sanitation District (the "District ") at Reception No. 747006. A copy of the Claim of
Easement is enclosed.
In the Claim of Easement, the District claims a Water Facility Easement over Lot 15, as
well as over Lot 14. The real property records indicate that Lot 14 is now owned by the District.
Lot 15 does not contain a water storage tank, access road, water line or appurtenants. We
are also unaware of any authority which grants the District the right to simply claim an easement
without the consent of the owner, or a finding by the court.
Please take such action as is necessary to release the Claim of Easement as it affects Lot
15.

CLAIM OF EASEMENT
WHEREAS, the Eagle River Water and Sanitation District is a quasi - municipal
corporation and political subdivision of the State of Colorado; and
.WHEREAS, the Eagle River Water and Sanitation District is successor -in- interest to the
Vail Intermountain Water District; and
WHEREAS, in approximately 1974, the Vail Intermountain,Water District constructed a
water storage tank on property currently owned by the George E. Miller Isle of Man Educational
Trust f described as Lots 14 and 15, Block 9, Vail Intermountain Subdivision ( "Property "); and
or Victoria M. Miller,
WHEREAS, the original property owner consented to the construction of the water
storage tank on the Property, as reflected in the Affidavit attached as Exhibit A, but inadvertently
failed to grant a formal easement to Vail Intennountain Water District for the water storage tank
and the access road; and
WHEREAS, the current and preceding owners of the property have known of and have
not objected to the District's continuous use and maintenance of the water storage tank, access
road, water line, and appurtenances for a period exceeding 18 years.
NOW, THEREFORE, the Eagle River Water and Sanitation District does hereby claim a
Water Facilities Easement by prescriptive rights of use over a period of 18 years, and by the
original acquiescence to this easement by the original property owner, as fully described on
Exhibits B and C.

1. During the 1970's, 80's, and 90's, I was managing partner of Vail
Intermountain Associates, a limited partnership, which owned the property currently
known as Lots 14 and 15, Block 9, Vail Intermountain Subdivision ( "Property "), I
also was a Board member of the Vail Intermountain Water District. Upon this
Property, in approximately 1974, the Vail Intermountain Water District constructed a
water tank with the approval of the property owner which I then represented. Once
the tank and access road were finally determined, it had been my intention to grant an
easement to the Vail Intermountain Water District, the successor of which is now the
Eagle River Water and Sanitation District. A formal easement for the tank and
access road was never granted through oversight or error. It is my belief that the
current owner and operator of the water storage tank is entitled to an easement either
through prescription or acquiescence.

SUBJECT: EASEMENT VACATIONS AT 2754 SNOWBERRY, VAIL CO
Summary of Subject: The builder at 2754 Snowberry would like for ERWSD to abandon the
following two easements. Water facilities easement No. 747006 located on the east side of 2754
Snowberry and Roadway, parking and utility easement No. 121108 located on the northern side
of the fore mentioned property both of the vacations are to facilitate the building of a duplex
home on 2754 Snowberry
Discussion /Background: The water facilities easement has not been in use since the new Inter -
Mountain tank went into use. It is staffs opinion that this easement should be abandon as the 7.5'
utility and drainage easement that will stay in place would be sufficient for any future needs.
The roadway, parking and utility easement located at the front of the property has no use to
ERWSD as all assets are currently in Right Of Way.
Alternatives: Leave both easements intact and work with the builder on an easement
encroachment agreement.
Legal Issues: The builder's attorney has previously sent a letter to Collins, Cockrel and Cole
regarding the abandonment of the water facilities easement.
Budget Implication: N/A
Recommendation: Staff believes that both of the easements may be abandon without any
negative impact to ERWSD.

RE: 2754 Snowberry -Water Main and Water and Sewer Services
Dear Mr. Dantas,
The latest set of drawings, submitted to Eagle River Water and Sanitation District (District) on April 10,
2014, show a significant cut over the 8 inch water main. The District would like inform you that the
ERWSD minimum specs must be maintained at all times throughout the construction process. If and
when the cut takes place, you will be required to, at your sole expense, permanently relocate the water
main. Furthermore, until this relocation is done to the district satisfaction, or the current conditions have
been maintained or restored, no water or sewer services or water or sewer taps will be provided to 2754
