CO 8,1632 General Comments 14 -6570 August 21, 2014 As scheduled; a representative arrived on -site to perform ire below discussed services and we have the following comments. ­OPEN HOLE- The exposed materials at the base of the excavation for the condominium addition basement footings were observed. At the bottom of footing elevation. the exposed materials appeared to be comprised of silty clayey sand with scattered cobbles that were generally consistent with our experience of the anticipated conditions in this area. No project geotechnical report has been prepared for this site, but plans call for an assumed soil bearing capacity of 2.000 psf. Quantitatively verifying bearing capacity generally requires access to subsurface and Standard Penetration Test data. An excavator was used to expose the undisturbed native material in the foundation excavations. and a vibratory plate attachment was used to recompact the foundation subgrade surface. Based on the limited amount of available subsurface data, the observed soils are deemed to be potentially capable o` providing an allowable bearing capacity of 2.000 psf, however the possibility of the presence of weak subsurface materials resulting in allowable bearing capacities less than 2.000 psf cannot be ruled out from surface observations only. In the event that quantitative verification of allowable bearing capacity is necessary, drilling and sampling should be performed. First Amendment to the Declarations 3. Rules and Regulations 4. By -laws and 5. Peto Application. The question is whether the Peto's can encroach 1 Oft into common area. As you are aware the First Amendment to the Declaration's includes a specific provision regarding Lot 8. Paragraph 6 is an addition to Article Seven of the Original Declaration. Paragraph 6 provides in part that Lot 8 shall have an 8ft easement along the easterly lot line for deck, patio and entrance purposes. This is intended as an exclusive easement in favor of Lot 8 (which I assume became Unit 8 upon construction of the Unit). Paragraph 4 of Section Seven provides in part that "in the event that any utility easement or "easements" are required after December 31, 1981, in the "Common Area" only written approval and written conveyance of the Association will be required for the granting of any such easement." Though Paragraph 4 gives some hope to approval by the Association without the need to amend the Declarations by way of a 2/3 d vote of the Owners and the First Mortgage Holders (Article Eleven. Paragraph 2) 1 believe that reading the balance of the paragraphs of Article 7 that this refers to Utility easements rather than the type of easement that the Peto's are seeking. It is my opinion that the Peto's need to revise their plan to limit the encroachment to the 8ft area or alternatively the Declarations need to be amend Article Seven, Subparagraph 4 to clarify the scope of authority that the Association has to allow easements within the common area. In the past when Declarations have been amended because of the actions or needs of one owner the owner bears the cost associated with the amendment. Please call to discuss upon receipt. Jim James Wm.
