We have completed paperwork from Mr. Stone indicating that he will agree to the deferred judgment and
sentence for one year and will remove the path and comply with the TOV encroachment issues. Linda has it in
the court file if you need a copy of it.

Ms. Causey,
As I mentioned to you when we met, we were previously told by a
representative of the TOV, Rachel Dimond, that our garden improvements were
not encroaching on TOV property.
Approximately two and one-half years later my wife was named a defendant
in the subject action and served with a summons by 3 representatives of the
Vail Police Department.
No notice of another determination of the alleged encroachment was ever
provide to us and I find the conduct of the representatives of the TOV in this
matter to be reprehensible.
I would like to learn what attempt was made by representatives of the TOV to
communicate with us about this matter in the ensuing two and one-half year
period and why the TOV felt it necessary to commence legal proceedings
against her, when no previous notice was ever given to her or me about the
redetermination in question.
