HomeMy WebLinkAboutB13-0417 Conditional Release Letter from Public Works December 2, 2014 New Path Networks 2000 Corporate Drive Canonsburg, PA 15317 (724) 416-2000 Re: The Crown Castle Hub Site 241 East Meadow Drive, Vail, CO 81657 To whom it may concern, The Town of Vail (the “Town”) has received a letter of intent (the “letter”) from the President of Aspen Wireless Jim Selby, a sub-contractor for Crown Castle, to install additional equipment at the above-referenced Hub Site (attached). The Town of Vail has discussed certain outstanding issues with both Crown Castle and Aspen Wireless and hereby responds to Mr. Selby’s letter as follows. As we have previously discussed, the Town is concerned that work has been done at the Hub Site without Town approval and in violation of the terms of the lease and the Town Building Code. Please be advised this practice is not acceptable and will no longer be tolerated by the Town. As such, the Town will be forced to seek all available legal remedies if such practice continues. Despite these repeated violations, the Town will issue a building permit on or about December 3, 2014 to allow Aspen Wireless to complete the Verizon hub installation. The permit is issued with the Town’s express understanding that an engineered solution to solve the Hub Site exhaust and HVAC cooling issue on the mezzanine level and walkway corridor as discussed in Mr. Selby’s letter will be fully installed and operational to the Town’s satisfaction as soon as practical, but no later than June 1, 2015. Because any proposed solution to the HVAC cooling issue will need to be approved by the Town and will likely require Design Review Board approval, the Town will need to see the proposed, engineered solution for the Town’s review and comment no later than February 1, 2015. In addition, as the owner of the subject real property, the Town will need to sign any development review application which is ultimately submitted to Town’s relevant reviewing agencies. As such, and in consideration that there may be a requirement to amend the current Conditional Use Permit, a final application package shall be prepared and presented to the Town no later than March 15, 2015. A failure to meet any of the dates above will be considered a violation of the underlying lease and the Town of Vail will take all necessary steps to protect its property.
