Dear Mr. Dilling:
One of the many functions of Code Enforcement is to provide for the enforcement of the Town of
Vail Municipal Codes.
It has come to our attention that the above-described property may be in violation of the Town of
Vail Municipal Codes as follows:
The following is a list of violations, possible actions to be taken and a deadline for each to be
brought into compliance with your Conditional Use Permit and also with the Town Code.
1. You continue to park vehicles in the Town's right-of-way in violation of your conditional
use permit and also in violation of posted signs. Please discontinue using this area
immediately.
2. Your trash dumpster must be moved inside the approved enclosure. The enclosure must
also be painted, inside and out,to match the color of the existing building(was approved
as dark gray). This must be done by April 15, 2005. Also, no parking is allowed or
approved in front of the dumpsters.
3. You are parking vehicles on the landscaping areas, especially along the western side of
your concrete area. Please remove these vehicles with 24 hours of receipt of this letter.
4. The temporary shed that was approved by the PEC for housing soil remediation
equipment is still there. Per the PEC conditions (see attached staff inemorandum) this
building was to be removed by 10-23-02. Please do the following: a) submit a complete
' PEC application by Febr��ary 08, 2005 if you still need to use this equipme»t/ shed (witl�
proof of wl�y it is still needed) —OR- b) Please remove the shed and all equipment
� � contained witl�in it by April 15, 2005.

S. You continue to park vehicles in unapproved parking spaces. Please discontinue use of all
unapproved parking spaces immediately OR submit a complete PEC application to
request additional spaces. There is room for additional approved spaces along the
western edge of your paved surface lot (there are currently only 3 approved spaces along
that side of the property).
6. You currently park / allow customers to park in close proximity to the fire hydrant.
Please discontinue this immediately.
7. You currently have a Pepsi machine stored outside along the west facing wall of the
business. Please move this inside or remove it from the property by January l 8, 2005.
8: You currently have a Go Fast cooler stored outside near the shed. Please move it inside or
remove from the property by January 18, 2005.
9. You currently have another white colored upright cooler located outside of the business.
Please move it inside or remove it from the property by January l 8, 2005.
10. You are currently storing other racks and cardboard containers outside. Please move
these items inside or remove them from the property by January 18, 2005.
Section 12-7G-12(LOCATION OF BUSINESS ACTIVITY) of the Town Code states, in part,
that:
o All offices, b�sinesses, ar�d services permitted by Section 12-7G-3 of this Article
shall be operated and cond�ucted entirely within a building, except for per��itted
unenclosed parki�ag or loading areas and such otl�er activities as rnay be
specificully autho��ized to be unenclosed by a conditional use permit. (Ord.

Any applicable State or Federal approvals must be received prior to removal of the shed /
remediation equipment. Also, the active building pennit must receive the final inspection �
immediately following the removal of the above-mentioned items or the application for continued
use of the shed/equipment.
I have enclosed a copy of your PEC approval, DRB approval and a partial copy of the approved
site map for your convenience. Failure to comply, with any of tlzese vi�olations, will result i�z a
summons being issued.
