In general Vail Mountain has no concerns with the balcony expansion proposal; however, with our
increased emphasis on the summer product there will be very specific parameters set for access to this
and all future projects. When the time is appropriate we can begin to explore and reach consensus on
access.

We are also working on a project that will extend the existing balconies at levels 4-6 on the east side of
the South building above the restaurant deck (level 3) per the attached drawings. I would appreciate it
if you would also review these drawings and let me know if you see any issue with this project relative to
the east property line. It is most likely the TOV will require a letter from you stating VR’s
acceptance. Thank you. Chip
