e Unlawful deposits: Sutjec{ to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or cause to be littered, tracked or depcited, sand, gravel, rocks, mud, dirt, snow, ice, or any
olher debris or material upon any street, sidewalk, alley or public plaoe, or any portion thereof.
o i,lotice; Abatement: The Director of Public Works may notify and require any person who violates or
caus€s another to violate the provision of subsec{ion A hereof, or who has in the Drecto/s employment
a petson who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debnis or materhl within twenty tanr (241 hours afler receipt of said notice
by the Direcior of Public Works. In the event the person so notified does not comply with the notice
within the perM of time herein spedfied, the Direclor of Public Wo*s, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snorn, ice, debrb or any other material to be removed
from any street or alley at the expense of the notified.
s Summons and Penalty: As an altemative to the notice for renprral provided in suboection B above,
any person who violates or causes arrcther to violate the same, may be bsued a sumrpns to appear
befoF the Municipal Court of the Torrn for said violations, and upon being found guilty of a violation
hereunder be punished m prcvided in Sec{ion 1-4-1 of this code.
o ilotice and Penalty: lt is unlawful for any peson to fail or refuse to comply with the notice of the
Director of PuHic Works as provided in subsection B hereol and any such person shall, in addition to
payment of the etQense of removal inq.rned by the Director of Public Works, as provided in subseclion B
hereof, upon being found guilty of a Molation hereunder, be punishable as provided in Section 14-1 ot

section of this Atticle, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under lhe conditions prescribed by Oolorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehide to be removed or causo it to be removed and ptaced in
storage in the nearest garage or other place of safety designated or nraintained by this Municipality, and
the charyes for towing and s{orage of such vefricle shall be cfrarged to the o,vner of the vehkje in

adjaoent to Town of Vail roads or $reds and the installation of temporary or permilent culverts at
a@ess points from the road or street onto the construdion site. Srch approval must be obtained
prior to any requesis for inspedion by the Town of Vail Bnilding Department for footings,
temporary dectrical or any other inspedion. Heme call Leonard Sandoval at 4792198 to request
an inspection from the Rrblic Works Department. Allow a minimum of 24 hour notie.

. You must obtain Design Review Board (DRB) approval if any of the mechanical work will involve
ANY exterior work. This includes and is not limited to removal and replacement of driveway snow
meft systems. Please contact a planner at 479-2128 before submitting your mechanical permit
application.
. The Town of Vail has adopted the 1998 International Mechanical Code (IMC) with the 1997 Uniform
Mechanical Code (UMC) as an acceptable alternative.
. All new construction within the Town of Vail is considered to be of unusually tight construction, thus
all combustion air is required to be drawn from outside the structure for mechanical equipment.
Reference the 1997 UMC Sec. 7OL.2.
Town of Vail Fireplace Ordinance
In September of 1991, the Vail Town Council adopted an ordinance which restricts te construction and
use of open hearth fireplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and revisions, striving for compromise, yet effectiveness in addressing
the air quality issue. Therefore the following criteria has been adopted:
o Construction of open hearth wood burning fireplaces is no longer permitted within Town of Vail
municipal boundaries.
. Dwellino Units - Each new dwelling unit may contain:
One (1) EPA Phase II certified solid fuel burning device and no more than two (2) gas appliances
(B vent)
OR
Two (2) gas log fireplaces and no'more than two (2) gas appliance fireplaces (B bent).
o Restricted Dwellinq Units - Each new restricted dwelling unit may contain:
One (1) gas log fireplace and not more than one (1) gas appliance fireplace.
. Accommodation Units - eain new accommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.
I If two or more separate dwelling units or accommodation units are combined to form one larger
unit, the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
. If during the course of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be converted to
natural gas or replaced by an EPA Phase II certified unit.

The following is the description of the request.
With the addition of new floor structure, our client would like to increase the floor area of the
existing Upper Level of their (2) level condominium. All of the added floor area occurs with-in
the existing footprint of their unit. The added floor area will increase the total existing GRFA of
this unit from 999.0 S.F to 1,217.3 S.F. for a net increase of 218.3 S.F.
We are requesting approval for the added 218.3 S.F. of GRFA by way of Section 12-15-5
Additional GRFA (250 Ordinance).
As noted on the attached plans, a window will be added to the Southeast corner of the
Proposed Bedroom on the Upper Level and an existing sliding glass door on the North side of
the Existing Bedroom on the Upper Level will be replaced with a window. The addition of the
window in the Proposed Bedroom will be similar if not exactly like the windows, which have
been added in the same location in several other Antler's units, which have been modified in a
similar fashion to what our client is proposing. lt is our understanding that these other Antler's
units and the modifications made to them were reviewed and approved by the Design Review
Board. Due to the location of the sliding glass door, the Association Board has approved
replacing it with a window and stucco to match existing. The door can only be seen when
standing directly in front of it on the common exterior corridor. lt is completely hidden from view
from all adjacent portions of the building, the building court yard and the roadway adjacent to
the building, by the building elevator tower, which is located directly North of the existing door.
For this reason and due to the Associations approval of the change, we would hope that the
Design Review Board would find this change to be acceptable.
In addition to the windows to be added is the replacement of all the existing windows with metal
clad insulated wood units. The new windows will be the same size and the cladding will be the
same color as the existing windows.
