General Information:
This application is required for proposals involving minor exterior alterations and/or site improvements.
Proposals to add landscaping do not require DRB approval unless they involve the addition of patios,
water features, grading, or the addition of retaining walls.

ENCROACHMENT AGREEMENT
THIS AGREEMENT, is made and entered into this_ day of March, 2007, by thc
Eagle River Water & Sanitation District, a quasi-municipal corporation of the State of Colorado,
hereinafter referred to as "District", and Northwoods Condominiums, hereinafter referred to as
"Property Owner".
WHEREAS, Property Owner is presently the owner of certain real property described as
600 Vail Valley Drive, Building D, Unit 204, located in Eagle County, Colorado; and
WHEREAS, the District is presently in possession of an easement, 10-feet in width,
running through the aforementioned property, said easement is described on Exhibit A, attached
hereto and incorporated herein by this reference; and
WHEREAS, Property Owner desires to construct permanent structures that will encroach
upon said easement in an area approximately 295 square feet. Said encroachment is herein
described on Exhibit A, which is attached hereto and incomorated herein bv reference.
NOW, THEREFORE, in consideration of the covenants and promises herein, the parties
hereby agree as follows:

1.The District shall permit the permanent strucfure to encroach upon said easement.
The Property Owner shall indemnifiT the District from the costs of any repairs to
the District's utility lines which may occur as a result of the construction of the
pennanent structures over and upon such easement.
The Property Owner shall hold the District harmless from the cost of repairing any
damage to the structures that may be caused by the installation of new utility lines
in said easement, or by a break in present and future utility lines of the District, or
by the repair of such break by the District or by other maintenance of its lines.
The Property Owner shall indemnify the District ffom any increase in the cost of
construction o f any new utility lines or in the cost of any repairs to the District's
utility lines, such increase , if any, due to the proximity of the permanent structures
to the utility lines.
This Agreement shall bind the successors and assigns of the Property Owner, and
shall be appurtenant to and deemed to run with and for the benefrt of the
aforementioned property in Eagle County, Colorado until such time that the
District abandons said easement. This Agreement shall be recorded against said
property in accordance with the laws of the State of Colorado.

This limited easement agreement (the "agreement") is entered into this lst day of May,
2A07,by and between NORTHWOODS CONDOMINIUM ASSOCIATION, a Colorado non-
proni ,otporution (.NCA"), whose address is 600 Vail Valley Drive, Vail Colorado, and Javier
de Pedro' ("Owner"), who is the record owner of Condominium Unit D-204 in the NCA
community.
Recitals
A. NCA is the common interest community association organized under the terms of
a Condominium Declaration recorded in the records of Eagle County, State of
Colorado on December 23,1975 in Book 243 atPage 810 (the "Declaration").
B. The Owner holds record title to the Condominium Unit (the o'Unit") designated
above and wishes to utilize a portion of the NCA land adjacent to the Unit in
order to construct patio and other outdoor improvements'
C. The NCA land which Owner seeks to utilize is a part of the general common
elements for the NCA community as described and defined under the terms of the
Declaration.
D. The Declaration and the goveming documents for NCA, as well as the provisions
of the colorado common Interest Ownership Act ("cIoA"), provide sufficient
authority to permit NCA to grant limited easements upon its general common
elements for the purpose of constructing implovements. However, such limited
€asements .an only be granted in circumstances where NCA can be assured that
the relevant improvements will not damage any physical structures, will not
interfere with utility or other systems serving the NCA community, and will not
intrude upon the rights of any other NCA condominium unit owner-
E. In order to assure that the Owner will construct or place any improvements upon
the general common elements in a manner that protects NCA and the other
o*o"rr, the NCA Board of Directors requires the Owner to discuss any proposed
improvements with the NCA managers and to obtain the preliminary approval of
tfre NCe Architectural Review Committee (ARC), The Owner must also execute
this limited easement agreement. This executed agreement must be delivered to
the NCA managers, The final plans for the proposed irnprovements must be
approved by the ARc before any construction may be commenced upon the
eeneral common elements.
ACCORDINGLY, the parties, in consideration of the mutual covenants to be performed
hereunder, agree as follows:

inttoauriion of landscaping or any variety of planting or gardening enhancements within the
Easement area. The EasJment s'hall be nonexclusive in all respects, and NCA specifically
reserves the right to use all or any portion of the Easement at any time for the purpose of
constructing otier improvements, maintaining or repairing any structure or system within the
NCe ro111tiunity, allowing vehicular or other access for such purposes, and for the general use
and access by otirer NCA owners in ascordance with the goveming documents of NCA'
Z. Construction and Maintenance. The Owner shall have the sole responsibility and

improvements and keeping the area within the Easement in a desirable and well-kept condition,

constrirction, other than routine repairs or maintenance, may be conducted upon the Easement by-
the Owner without 30 days' prioinotice to the NCA managers and the receipt by the Owner of
written permission to commence such work. NCA has the right to rectiff at the owners cost if
the owner does not abide these terms.
3. Expenses andFees.
3.1 In addition to paying all expenses and fees in connection with the
construction of any permitted improvements upon the Easement as well as all expenses
and fees in conneciion with the maintenance and repair of the Easement area, the Owner
shall be responsible for any attomey fees or other costs incurred by NCA in connection
with the negotiations for and the granting of this Easement'
3.2 The owner shall be responsible for paying any expenses and costs of
restoring the Easement to its former condition and replacing any improvements upon the
Easement in the event NCA is required to disturb the Easement in order to perform
required maintenance, repair or reconstruction of the general conunon elements.
4. Use of Easement. The owner agrees to use the Easement area only in a manner
which is consisGnt with the permitted improvements thereon. In addition, the Owner may not

use the Easement area in any fashion that would disturb the quiet enjoyment of the surrounding
premises by other owners and their guests. The Owner further agrees to abide by any present or
future rules adopted by NCA which may rcgulate or restrict the use of the Easement, and the
Owner also agrees to make use of and manage the Easement in accordance with the NCA rules
of conduct.
5. Liability and Insurance. l'he Owner shall be liable for any personal injuries or
damages sustained by any NCA condominium unit owners or thcir guests and invitees which
arise out of, or which are related to, the use of the Easement under the terms of this agreement or
the construction of improvements by the Owner within the Easement area. 'fhe Owner agrees to
indemnily and hold NCA harmless against any loss, damage, claim or action which may be
attributable to or arise out of the use of the Easement by the Owner or any guests or invitees of
the Owner or the construction or maintenance of improvements by the Owner within the
Easement area. The Owner also agrees to insure against such potential loss and liability to the
extent that it is reasonably practical for the Owner to obtain such insurance coverage.
6. Utilities. NCA reserves the right to grant easements or
company or governmental entity to use the Easement area for the purpose
sovernmental services to the NCA community.
7. Term. The Easement granted by this agreement shall be
term of ten years commencing frorn the date of this agrcement. The

8. Subsequent Owners, The Easement during the term granted in this agreement
shall be appurtenant to the Owner's condominium unit and shall be considered to have bcen
transferred and assigned with any conveyance or transfer of the condominium unit. The
Easement may not be assigned, transf'erred or conveyed separately frorn the appurtenant
condominium unit. NCA may require any subsequent owner or owners of the appurtenant
condominium unit, as a condition precedent to the use of the Easement, to execute an agreement
sirnilar to this agreement in which the subsequent owner or owners agree to be bound by the
tenns, conditions and provisions of this agreement and stating an address to which notices
hereunder shall be sent.
9. Assignrnent. This agreement may not be assigned by the Owner except in the
case ofthe transfer or conveyance ofthe appurtenant condominium unit. This agreement may be
assigned by NCA without the consent of the Owner. In the event of any permitted assignment,
notice shall be provided to the other party in accordance with Section l0 below. Any permitted
assignment shall be binding upon the heirs, representatives, successors and assigns ofthe parties.
10. Notices. Any notice required or permitted in this agreement shall be deemed

The Town Staff has reviewed the design review application for the proposed landscape remodel
for the De Pedro Residence at Northwoods, Unit D204. The following is a summary of the
comments from that review:
. Northwoods Condominiums is located within a Special Development District thal
requires a minimum setback of 10 feet around the property boundaries of the
development sile. Pursuant to Section 14-10-4, Vail Town Code, porches, steps, decks
or terraces, and similar features may only encroach up to 5 feet into this required
setback area. Therefore, the design of the proposed flagstone patio and built-in BBQ
must be revised to comply with this standard.
Please submit a revised site/landscape plan addressing the above listed item to the Town of
Vail Community Development Department. lf you have any questions or comments, please feel
