RE: Staff approval of new garuge doors
We respectfully request staff approval of a new garage door design for
the23 townhomes at the above reference townhome association.
The association wishes to provide its owners with an aesthetically
pleasing garage door with a high "R" value which is energy efficient.
We are in the process of getting quotes from Overhead Door and Vail
Valley Garage Doors which includes professional installation.
The door we have selected is a steel door with an "R" value of 16.5 or
higher (see attached photograph.) The color will be a neutral
bronze/taupe (see color chip) which will coordinate with the current
building color and will be in sync with any future paint color changes to
the buildings.
We need to get this project underway so your staff approval on 7'3-07
would be extremely helpful.

Townhome association voted to allow Julie Hansen, Board Member, to

PUBLIC WORKS AND THE PUBLIC WAY PERMIT PROCESS
How it relates to Building Permits:
Fill out the attached check list with the Building Permit Apolication.
If yes was answered to any of the questions then a "Public Way" permit is required. you
can pick up an application at either Community Development, located at 75 South Frontage
Road or Public Works, located at 1309 Elkhorn Drive.
Notice sign-offs for utility companies. ALL utilities must field verify (locate) respective
utilities prior to signing application. Some utility companies require up to 48 hours notice to
schedule a locate.
A construction traffic control/staging plan must be prepared on a separate sheet of paper,
An approved site plan may also be used. This plan will show locations of all traffic control
devices (signs, cones, etc.) and the work zone, (area of construction, staging, etc.). This
plan will expire on November lst and will need to be resubmitted for consideration for
approval through the winter. Be aware that your resubmission for winter may be denied
depending on the location of construction.
Sketch of work being performed must be submitted indicating dimensions (length, width
and depth of work). This may be drawn on the traffic control plan or a site plan for the job.
Submit completed application to the Public Workt office for review. If required, locates will
be scheduled for the Town of Vail electricians and irrigation crew. The locates take place in
the morning, but may require up to 48 hours to perform,
The Public Work's Construction Inspector will review the application and approve or deny
the permit. You will be contacted as to the status and any requirements that may be
needed. Most permits are released within 48 hours of being received, but please allow up
to one (1) week to process.
As soon as the permit is approved, the Building Department will be notified, allowing the
"Building Permit" to be released. Please do not confuse the "Public Way Permit" with a
"Building Permit".
NOTE: The above process is for work in a public way ONLY. Public Way
Permits are valid only until November 15th. A new Public Way Permit is required
each year if work is not complete. Re-application each November lSth does not
mean an automatic renewal.

BUILDING PERMIT ISSUANCE TIME FRAME
If this permit requires a Town of Vail Fire Department Approval, Engineer's (Public Works)
review and approval, a Planning Department review or Health Department review, and a review
by the Building Depaftment, the estimated time for a total review will take as long as three (3)
weeks.
All commercial (large or small) and all multi-family permits will have to follow the above
mentioned maximum requirements. Residential and small projects should take a lesser amount
of time. However, if residential or smaller projects impact the various above mentioned
departments with regard to necessary review, these projects may also take three (3) weeks to
review and approve.
Every attempt will be made by this department to expedite this permit as soon as possible.

that if the permit is not picked up by the expiration date, that I must still pay the plan check fee
and that if I fail to do so it may affect future permits that I apply for.

o The Town of Vail Building Department has developed the following procedures to
ensure that new construction sites have adequately established proper drainage
from building sites along and adjacent to Town of Vail roads or streets.
The Town of Vail Public Works Department will be required to inspect and approve
drainage adjacent to Town of Vail roads or streets and the installation of temporary
or permanent culvefts at access points from the road or street onto the construction
site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electrical or any other
inspection. Please call Leonard Sandoval at479-2198 to request an inspection from
the Public Works Department. Allow a minimum of 24 hour notice.
Also, the Town of Vail Public Works Department will be approving all final drainage
and culveft installation with resulting road patching as necessary. Such approval
must be obtained prior to any Final Ceftiflcate of Occupancy issuance.

o Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or
deposit, or @use to be littered, tracked or deposited, sandf gravel, rock, mud, dirt, snow, ice, or any
other debris or material upon any street, sidewalk, alley or public place, or any portion thereof.
o Notice; Abatement: The Director of Public Works may notify and require any person who violates or
causes another to violate the provision of subsection A hereof, or who has in the Director's employment
a person who violates or causes another to violate the same, top remove such sand, gravel, rocks, mud,
dirt, snow, ice or any other debris or material within twenty four (24) hours after receipt of said notice
by the Director of Public Works, In the event the person so notified does not comply with the notice
within the period of time herein specified, the Director of Public Works, or other authorized agent, may
cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other material to be removed
from any street or alley at the expense of the notified.
o Summons and Penalty: As an alternative to the notice for removal provided in subsection B above,
any person who violates or causes another to violate the same, may be issued a summons to appear
before the Municipal Court of the Town for said violations, and upon being found guilty of a violation
hereunder be punished as provided in Section 1-4-1 of this code.
tr Notice and Penalty: It is unlawful for any person to fail or refuse to comply with the notice of the
Director of Public Works as provided in subsection B hereof, and any such person shall, in addition to
payment of the expense of removal incurred by the Director of Public Works, as provided in subsection B
hereof, upon being found guilty of a violation hereunder, be punishable as provided in Section 1-4-1 of
this Code. (1997 Code: Ordinance 5 (1979).

o Whenever any police officer finds a vehicle attended or unattended, standing upon any poftion of a
street or upon any place within this Municipality in such a manner as to constitute a violation of any
section of this Article, or left unattended for a period of twenty four (24) hours or more and presumed to
be abandoned under the conditions prescribed by Colorado Revised Statutes section 42-4-1102, as
amended, the officer shall require the vehicle to be removed or cause it to be removed and placed in
storage in the nearest garage or other place of safety designated or maintained by this Municipality, and
the charges for towing and storage of such vehicle shall be charged to the owner of the vehicle in
addition to a ten dollar ($10) impoundment charge. (Ord. 2(1968) $ 3: Ord. 28(1981) 5 1)

Hazula and Jay Enyard at Jay Enyardrs office.
The ltems we dlscussed were basically those ltems that appeared inyoun letber to P&R Constructlon and the steps that BiII Robble wastaklng to correct the aane.
I thlnk that if you will refer to the last two itens, per your
agreement with Bi1l, they had baslcally been taken care of. The
Homeownerrs Association dld not belleve that they had. They statedlhat they would comply with the rules and regulations of The Townof Va1l, and once The Town of VaiI approved of the same, they felbthat they had compJ-led wlth those ltems t,hat would be necessary.
We also dlseussed ln great detail the fact that they wanbed theflowerboxes to be lnstal-led in front of bhe garages and bhey wantedplftzers put 1n the plantlng area ln fronL of the garages. 8111

Several other ibems came up at the meetlng; one was a dlscusslon
regarding the road out in front and who would pave lt. Bill indl-
cat,ed that he had had discussions with The Sfate of Colorado, aswell as the Town of Vail. I can't teII you how thal is golng to
be resolved, because basically we do not believe that we have anyresponslblllty for the lnstallation of the road or the malntenancethereof.

Thjs letter wi'l I memorialize the agreement between P & R Enterprises'
the developer of Pitkinf Creek Townhouses and the Town of Vail relat-
ing to issuance of the tertificates of occupancy. At-lfe time Jim
Ru5in, Zoning Administrator, agreed to issue the certificates of
occ;pincy on-the condjtion thai when the exterior of the bui'ldings
need to be resea1ed or restained, that one co1or be agreed on and
submjtted to the Design Review Board and/or Zoning Adm'i nistrator
for approval. At thal time, a'l'l the buildings wil] be designated to
Ue reiiinted, restained or resealed so as to be the same color.
A copy of this letter will be delivered to the Townhouse Association
and made a part of their permanent records.

to bave started in a shaft on the second floor of Unit #9. E\ridence of
a ctfnney fjre that occured within a section of single wall pipe, located
within the sht't was for:nd. Agparently the fire ignited 2"X 4"s withjn
the shaft and spread rp to an cpen wood frane attic.

At approxJrnately 0730 hours the area was secured and red tagged as
an unsafe buildlng. I could not aIlo$r the investi-gation team to start
due to the arncr:nt of debris laying on the ceiling joists. This was
due to the structural collapse of the roof that occurred during the
f i-re.
I elected to postpone the j.nvestigation until the olvners could hjrea contractor and have the debris renroved which would make the secondstory safe enough to start our jnvestigation.
'AlproxirnatLey 24 hours later I was advised by Andv Beck of Beck and
A.ssociates that they would be doing the salvage work. r advised !{f. Beckthat he was not to distr:rb the chjnu-rey chase or flue pipe to unj-ts
#8 and #9. He agreed to call and advise ne when we could take a lookat ttris area.
Approxirnately 72 hours later we were abre to start our investigation.
A1l evidence pointed to the flue chase area of Units #8 and #9. Ttreflue chase was not fire rated nor did it shcn^r anv evidence of everhavhg been fire rated.
Tte fJ.ue pipe fron unit #9 shcmred. evidence of over heatilg. The netal
was of a white color. Ttre charrilg in the chase appeared to start ilthi.s irrrEdiate area and extend. 14> and into the roof area.
After brealcing the flue pipe apart, which was d.one frorn the top d.own,we found that the flue pipe section between the floor of the secondfloor and the ceiling of sare only had the outer layer of what appearedto be triple waI1 flue pipe. We examined all other flue pipe andfound it all to be trip.le wall. we then transported all ilue pipe to thernain vail Fire station and photographed alr sections. we rater arloredinsr:rance personnel to do the sare.

The results of my investigation into the fire occurrjng at the above
address are as follqrs:
The structure fire appears to have been caused by a ccrnbinatlon of related
factors and events. Evidence found at the scene of the fire i-ndicates
ttre presence of abnorrnally high heat ins ide the chinrrey flue pipe of
Unit 9. It is presr-lred that this high heat was caused by a chirru-rey fire
occurring scrne tine dr:ring that evening. It would appear the
chfuney fire produced sufficient heat withj_n the section of flue pj.pe
havirg only the outer wall of a triple wa11 pipe, located at the second-level of Unit 9, to cause igrnition of adjacent ccnrbustible studs.
iallonring the fire to prcrpogate verti-ca-lly from the shaft wall found
adjacent to the bathroorn at the second leveL of Uni_t 9, into the
adjoining shaft enclosr:re of Unit 8, up ttrrough the thimbl_e at the
ceiling of the second floor in both units, and then propagating up
through and into the attic of Llnits 8 and 9.
lntenrielving the tenants of Units 8 and 9, I was infornred both parties
had a fire in their respective fire boxes that evening prior to the fire
and that both fires were "extinguished,, at approxjmatelv I0 p.m. The
fireplace a\Unit t had the folloring ntlrbers prirted on the box itself--
863755 05062005. There were no obvious nrode1 nwnbers found on the tag
irtside the fire box. The fjre box di_d not reveal any indication of
inproper jnstallation, unusual rnrear and tear, or manufacturer deficiency.
Ho\,vever, Unit 9 did appear to have a guantity of coals j_n the bottqn of
tte fire box estjrnated to be approxirnately 6" - 8,, deep at t-he rear of the

box tapering dovm to the front of the box to a depth of approximately
2" covering the entire floor space of the box. In interviewing the tenant
it was disclosed he had a rather large arount of cedar burnj-ng in the
fireplace that night. Reportedly the cedar conprised the remains of a
bookshelf system.
At approxirnately 1710 hours on 9/25/85 I received permiss j,on from Torn
Maron, reportedly the owner of Unit 9, via telephone (818-708-0240) who
was reported"ly residing at 4641 Carrtina, Tarzana, CA 91356, to conduct
a search of Unit 9 for the purpose of obtaining evidence and determining
the cause and origin of the fire. Likewi.se, I recei_ved permi_ssion frcm
Gary Gifman, resident of Llnit 8 and reportedly the or,rner of the sane
unit, to conduct an investiqation into the cause and oriqin of the f ire.
Tbe structure itself appears to have been constructed in 1979. Ttre date
of the construction permit frorn the Tornn of Vai1, project #43-379C, permit
#197 dated 2/L6/79, indicates the type of construction being T\pe 5,
-:L Hour Occlpancy, C'roup R, Division 1. Buitding permit indicates l\pe 5,
L Hor:r C'roup G-t construction consisting of approximately 6,304 sq. ft.
Permit application indicates Permit was dran n on the name of p and R
friterprises, with an address of p.O. Box l-21-l-, Vail-, Colorado.
D{amjnation of the flue pipe in Units B and 9 ind-icate they are conprised
of triple wall flue in various lengrths with the exception of the second
floor of Unit 9. While conducting an investigation we removed a 30" angle
section of pipe fronr the floor level of the thjrd floor and peered dcr^rn
into the section of pipe installed at the second floor of Unit 9. It
becatre self evident that the tvro inside sectj-ons of the triple walI pipe
were not present at the tire of or:r investigation. Tfre triple wal] flue
appeared to be installed only in the section frorn the filfebox up to and
ju.st through the second level floor at which tjrne it converted to singte
wall pipe, contjnued up through the second story where it connected to
a thimble of triple walt pipe through the ceiljng of the second floor and up.

The outside section of tripte wall pipe was for.rnd to be 56" long, approxjnntely
13!" jnside dianeter, with a 42!" outside cirsunference. Ttrere is a section
of triple wall pipe innediately belcw the outside shell of the tripre wall
pipe. It was 23!" 1ong, 13b" h dianeter. The short secLion of plpe on the
second fl-oor fit dor,'rn on top of the thimble a.s it canre through the second
level floor. The sestion of single wall pipe was connected above the short
section and extended r:p for a distance of 56" where it connected with a 34!"
rong section of tripre walr pipe. rt was noted that approximately 48" up frcrn
the base of the pipe in the second story of unit 9 there was a distjnct
heat demarcation line on the duct as indicated in the photos. This is
presumabry the location the creosote radiated heat from the sinqle wa1l
pipe to the adjoining combustj_bl_e nembers.
The shaft in which the pipe was located at the second floor was adjacent
to the bathrocrn. rt was approxirnately 33!" x 27". the cons truct ion
of the straft enclosure itself was primarity 2,,X 6', studs on the party
walL with 2"x 4" corner posts. one rayer of 5/9" sheetrock appears Eo
have been installed on the outside of the studs for the three warrs
"insiQe the bathroqn. The party wa]l appears to have been separated by
L" fiberboard. Noti-ng char depth, it was determined that on the party
warl at a height of 48" above fi-nished fl-oor, char was approxlnrately
1/8' deep. At 60' it was L', deep. At 70,' it was !,' deep and. at g0',
off the floor it was 3/4" deep. rnsid.e djnrensions of the shaft ind.icate
we had an inside d.inrension of 22\,' squa.re, with char evident on the
2"X 4" corner posts at approximately the 3' level. The degree of char
appeared to be deeper and lor,'rer inside the shaft warl of unit 9 than it
was in Unit 8. A visual observation revealed. the fi_re ;,ppeared to llave
started on the party wall and combustible 2,'X 4,, corner posts on the
inside of the shaft and spread r4>ward tkrrought he ceiling and up at an
angle tc,hrard the party wall- between units 8 and 9. Apparently the party
waI1 failed (i.e. L" fiberboard deteriorated and burned) allcwing fire
to propagate into the shaft enclosr:re for Unit B, at which tine it
spread q> through and around tbe thimbles and intot he wa1l space in
attic of third floor.

Factors contributilg to fire spread appear to be a lack of fire stopping
at party walI construqtion betr,reen Unit 9 and Unit I0 at the roof change
elevation. In addition, fire spread appears to have been undetected for
sore period of tinre due to an appa.rent absence of operable smoke detectors
in either tnit 8 or Unit 9 and assi-sted by the availability of combustible
materials in concealed smces.
Dte to the arrount of char and destruction in and around the ceiling of
the second-story and by observing f.ire burn patterns, it appears the
fjre inside the chinney originated sqre tjnre between 10 p.m.. on the
night of the 24th and 4 a.m. on the nprninq of the 25th.
Dre to structural instability of the rernaining roof, 3rd floor and 2nd
fLoor ceiling, investigation was suspended fron approxirnately 4 p.m.
9/25 unitl I a.m. 9/28. the prcperty was posted and secured during
this period.

the VaiI Fire DeparUrent to a reported chinney fire at 3950 North Ftontage Road,
Pitkln Creek Townhqnes. IJpon arrival firefi-ghters saqr heavy smoke eminating
frcrn three out of the four roof structures of the for:rpfex. At 4:23 a.m. Vail
t15:,*nuttrrent called a C;eneral Alarm.
The fire took approxjrnately one hour to contain. The enti-re operation took
thre purpers, one ladder truck and 25 firefighters.
Mditionally, a l"lrtual Aid Alarm was called at 4:51 a.m. Eagle River Fire
Departnent responded with two purry)ers, a .l-adder truck on standby and six
f5refighters.
In addition to di-rect fi-refighting procedures, Tcrvrn of Vail Public Works provided
additional- errergency lighting and nnnpcwer, whi-le Holy Cross, Town of Vail
Building Departnent, the Vail Police Deparmtent and the Arnbulance personnel '
stood by for assistance as needed.
Fjre and Building officials estjnnte the initial damage to be in the neighbor-
hood of 5500,000.

I am an officer and director of the Pitkin Creek TownhouseAssociation. The members of the Association have determined
that its name is confusingly similar to the name of the develop-
ment on the south side of I-70 in East Vail. Pursuant to Article
XI , paragraph 2 of the Declaration of Covenants, Conditions
and Restrictions for Pitkin Creek Townhouses, dated February
L9, L979, the approval of the Town of Vail Planning and
Environmental Conmission is required before any amendment tothe name can be made. The purpose of this letter is to requestyour approval to a change of the name of the Association to
"The Falls at Vail Townhouse Association. "

This letter is in reference to the Pitkin Creek Townhouses
Project located in East Vail.
Having thoughly analyzed the proposed type of retaining walls
and the proposed locations of the same in this project, I do not
foresee any future slope stability probl erns using this method of
retent i on.
Attached to this letter you will find a sheet with the detailsfor constructi ng these crib retaining walls. Provi ding these details
are adhered to and the slope is terraced in four foot (4t) increments
as indicated on the plans, the stability of the al tered slope shoul d
be no less then that of the original slope.
You are probably aware of similar type of crib walls in theVail area which retain earth in heights up to threnty foot (20t).It is my professional opinion that terraci ng the slope in fourfoot (4t) increments is a stronger and safer method for retaining
the earth then to attempt to retain the full height of the cut witha similar type of crib retaining wall.

SCOPE
This report presents the results of a soil anC fcundation inves-
tigation for the proposed Pitkin Creel< Torynhouse Develognent located
north of Interstate Hiohway 70 in East Vail , Eagle County, Colorado.
the report presents the ficst desirable type foundation, allcxrable soil
pressures, mter table conditions ancl other soil-related desiqn and
cpnstructiqr details.
PROPOSED @IS'IFTJCTICbI
The Froposed buildings will consist of two-story frarne structures
with underqround parking. The lcx*er floor will be slabrcn-grade.

SITE @}DITIOIIS
The proposed buildings will be l-ocated in a relativeJ.y flat area
droppirq down gentl.y to the southwest; hosever, the qrourd surface
rises sharpl.y rnrth of the buildinq site. The site is .presently vacant
ard cpvered with natirae grass, weeds ard aspen trees. Iarge scattered

boulders were noLed at several locations across the sitc. pitkin Creek
borders the east properLy line. t€ dry irriqation ditches transect
the site northwest to scuthwest. Estinated elevation differenee across
the Froperty is on the order of 150 feet.
SUBSOIL @NDTIICIIS
The subsoil conditions at the site were investiqated by use of a
backtroe. Four test pits were excavated at the locatlons shon on
Fiq. l. Generally, the subsoil canditions are fairly unifcrm and
ocnsist of 1 to 3 feet of topsoil overlying dense, sandy gravel with
cobbles ard boulders to the depth investigateC, 10 feet. Cradation
analyses performed on the ninus 3 inch frction and ,\tterberr lirnits
tests are presented on Figs. 4 and 5

BiJII.',DITG TUJNNATIOIS
Based on the subsoll ocnditions an<l the proposecl construction, v€
believe the most desirable type foundati.on is spread footings praced on
the natural granular soils. The following desiqn and construction
detai.ls should be observed:
(1) AlI footings should be placed on the natural granular soil below
any to6rsoil.
12) Footings plac€d on the sanCy gravet should be desiqned for a
maxfunum soi] pressure of 41000 psf. Under this pressure, we
estimate that total setbleflEnt will be less than I inch and
differential settLement on the order of L/2 Lnch.

(3) Iocat soft pockets of soil found at the base of the footintl
excavations shoul.C be renroved and fcotings extende"l doun to the
lower firrn soil . care should be taken in renovinS large boulders
so as not to disturb the renainirg soils.
(4) C-ontinuous foundation walls should bo well reinforced top and
bottcm Lo span an unsupfrorted length of at least l0 feet. In
addition, lower level wa1ls should be Cesiqned as retaining
structures for latera-l- earth pressures based on an equivalent
fluid weight of 35 pcf. Slooes adjacent to wall's should drain
away fron the building.
(5) A11 footings should be prwided with adeguate soil crcver above
.their bearing elevation for frost protection.
GROUND FT,OORS
The on-site soils, exclusive of any Lopsoil, are suiiable to i t

support slab-on-grade construction. tto ninimize Camage Cue to slight
differential rmvcment, all slabs should be separatcd fron bearing
nernbers with positive expa.nsion joints. Floor slabs should be provided
with crcntrol joints and adequately reinforced.
SUBDRAIN SYSIEI,I
Althoqh no free water was encountered at the tiine of our inves-
tigation, it has been otr experience in this area that durirq snovrnelt
and spr inq runoff, seepage naters can become a problem. tr^le recornerd
that the sbructure be protected b,y an underdrain system. The under-
drain should onsist of perforgted pipe crnbeddcd in a gravel-filled

trench placed at footing Erade leading to a suitable outl-et where water
can be renrcved by gravity flcry or purnping.
O SITE CP.ADIIIG
Cut and fill slcpes at the site should be stable at an inclina-
tion no steeper than 2:1 (horizontal to vertical) to an approximate
O maxirnum height of 15 feet. Good surface drainage and vegetative cover
should be provideC to protect nan-nade slopes.
In required fill areas, all veqetation arrd topsoil should be
a stripped. The exposecl surface should then be benched to provide a
level for fill placercnt. FiIl placed along roaCs and under @nsrete
flatrcrk should be ccrnpacted to at least 958 standard Proctor density
O @timun npisture content.
On-site soils free of topsoi I are suitable for orrerlot f il-] ard

horrever, erratic soil conditions may occur between test pits. If such
ccnditions are fourd in the exposed excavatign, it is advisable that we
be rctified to inspect the foundation excavation.
