ANY q<terior w6rk. This includes and is not limited to removal and replacement of driveway snow
melt systems. Please contact the Development Review Coordinator at 479-2L28 for addiUonal

o The Town of Vail has adopted the 2fi13 International Mechanical Code and the 2OO3 International
Fuel Gas Code.
o All new construction within the Town of Vail is considered to be of unusually tight construction,
thus all oombustion air is rcquired to be drawn from outside the structure for mechanical
eguipment.

Town of Vail Fireolace Ordinance
In September of 1991, the Vail Town Council adofied an ordinance which restricts te aonsilruction and
use of open hearth fireplaces within municipal boundaries. Since that time the ordinance has
undergone numerous changes and revisions, striving for compromise, yet effectiveness in addrcssing
the air quality issue. Therefore tte following criteria has been adopted:
I Construction of open heart{r wood buming fireplaces is no longer permitted within Town of Vail
municipal bounparies.
Dwellinq Units - Each new dwelling unit may contain:
One (1) EPA Phase II certified solid fuel burning dwice and no more than two (2) gas applianes
(B vent)
OR
Two (2) gas log fireplaces and no more than two (2) gas appliance ftreplaces (B bent).
Restricted Dwellino Units - Each new restricted dwelling unit may contain:
One (1) gas log fircplace and not more than one (1) gas appliance fireplace.
Accommodatioil Units - Each new aooommodation unit may contain:
One (1) gas log fireplace or one (1) gas appliance fireplace.

unig the combined unit may retain one woodburning fireplace (if one already exists) and no more
than 2 gas appliance fireplaces, or may convert up to two existing fireplaces to gas.
If during t{re course of a remodel an existing woodburning fireplace is altered or moved, the unit
must then comply with all provisions of the ordinance. That is, the fireplace must be converted to
natural gas or rFplaced by an EPA Phase II certified unit

Overhead seruices are not allowed in the Town of Vail.
Underground seruices shall be in conduit (PVC) from the uffility transformer to the electric meter, main
disconnect switch, and to the first electrical distribution circuit breaker panel.
The main disconnect switch shall E readily accessiblq andlocated next to the meter on the exterior wall of
the structure. All underground conduits are required to be inspected berfore back-filling the trench.

TOWN OF VAIL ELECTRICAL PERMIT GUIDELINES
All installations of elterior hot tubs or spa's require a DRB approval from planning. This application will
not be accepted without a copy of the DRB approval form attached (if applicable).
If this permit is for installation of an exterior hot tub or spa on a new elevated platform or deck over
30" above grade, you must also obtain a building permit.
If this permit is for installation of an exterior hot tub or spa on any existing deck or elevated platform,
a structural engineer must review the existing condition and veriry that it will support the added
concentrated load. Please provide a copy of the structural engineers wet stamped letter or drawing
with this application.
If this is a remodel in a multi-family building with a homeowners association, a letter of permission
from the association is required.
If this permit is for a commercial space, two (2) sets of stamped dnwings are required. Electrical
one-line and panel schedulu are required if load is added or distribution is altercd.

If this permit requires a Town of Vail Fire Departrnent Approval, Engineer's (Public Works) review and approval,
a Planning Department review or Health Department review, and a review by the Building Departmen!, the
estimated time for a total review will take as long as three (3) weeks.
All commercial (large or small) and all multi-family permib will have to follow the above mentioned maximum
requirements. Residential and small projects should take a lesser amount of time. However, if residential or
smaller projects impact the various above mentioned departments with regard to necessary review, these
projects may also take three (3) weeks to review and approve.
Every attempt will be made by this departnent to expedite this permit as soon as possible.

sites have adequately established proper drainage from building sites along and adjacent to Town of Vail roads or
streeb.
The Town of Vail Public Works Departrnent will be required to inspect and approve drainage adjacent to Town of
Vail roads or streets and the installation of temporary or permanent culverts at access points from the road or
street onto the construction site. Such approval must be obtained prior to any requests for inspection by the
Town of Vail Building Department for footings, temporary electical or any other inspection. Please call Leonard
Sandoval at970479-2198 to request an inspection from the Public Works Department, Allow minimum of 24
hour noUce.
Also, the Town of Vail Public Works Departnent will be approving all final drainage and culvert installation with

Unlawful deposits: Subject to subsection C thereof, it is unlawful for any person to litter, track or deposit, or cause to
be littered, tracked or deposited, sand, gravel, rocks, mud, dirt, snow, ice, or any other debris or material upon any
street sidewallg alley or public place, or any portion thereof.
Notice; Abatemenh The Director of Public Works may notify and require any person who violates or cruses another
to violate the provision of subsection A hereof, or who has in the Dircctor's employment a person who violates or
causes another to violate the samg top remove such sand, gravel, rocks, mud, dirt, snow, ice or any other debris or
material within twenty four (24) hours after receipt of said notice by the Director of Public Works. In the event the
person so notified does not comply with the noUce within the period of time herein specified, the Director of Public
Works, or other authorized agent, may cause any such sand, gravel, rocks, mud, dirt, snow, ice, debris or any other
material to be removed from any street or alley at the expense of the notified,
Summons and Penaltyr As an altemative to the notice for removal provided in subsection B above, any person
who violates or causes another to violate the same, may be issued a summons to appear before the Municipal Court of
the Town for said violations, and upon being found guilty of a violation hereunder be punished as provided in Section
1-4-1 of this code.
Notice and Penalty: It is unlawful for any person to fiail or refuse to comply with the notice of the Director of Public
Works as provided in subsection B hereof, and any such person shall, in addition to payment of the expense of removal
incurred by the Director of Public Works, as provided in subsection B hereof, upon being found guilty of a violation
hereunder, be punishable as provided in Section 14-1 ofthis Code. (1997 Code: Ordinance 6 (1979).

removed or cause it to be removed and placed in storage in the nearest garage or other place of safety designated or
maintained by this Municipality, and the charges for towing and storage of such vehicle shall be charged to the owner

Information Handout
Problem Statement
The Vail Village and LionsHead Village are invaluable assets to the community. Thousands of people come to Vail eadr year to
sightsee, recreate, shop and to enjoy everything the Vail Valley has to offer. The community and merchants rely upon our guests to
generate revenue. Our summer/winter guests expect a pleasant experience while in Vail,
To insure that all of the proposed construction has as little negative impact on the ommunity and on our guest as possible, the Town
of Vail finds it imperative to create and implement the Vail Village and LionsHead Village Construction Hours Handout.
It would be irresponsible for the Town of Vail, the construction aontractors and the merdrants, to not actively partkipab to minimize
the impact of construction in the Vail and UonsHead Village areas.
The Vail Village Streetscape Project will continue through 2005. Improvements scheduled for
2006 will be concentrated along Gore Creek Drive west of the Children's Fountain, Gore Creek
Promenade and around the frontage of the Mill Creek Court Building. Additional streetscape
improvements are scheduled to begin along East Meadow Drive.
All construction projects and/or remodels within the Vail Village Core Area should contact
Scott Bfuhm, Town of Vail Streetscape Coordinator, at 970-477-3418 for further information.
Givens
The following givens are intended to provide the basic foundation by which construction will be completed in
the villages:
. The public's health, safety and welfare shall be honored at all times..
. Adequate pedestrian, loading/delivery, vehicle, and emergency vehicle access and circulation shall be
maintained.
. Roadways and pedestrian walkways shall be kept clean and free of dirt and debris.
. All construction deliveries, equipment, tools and materials entering the Vail Mllage and pedestrian areas
must go through CheckPoint Charlie. All LionsHead construction activity must go to the Vail Police
Depaftment for a parking permit. Do not use delivery zones for construction parking; refer to approved
staging plan or make other arrangements for parking,
. The hours of outside construction activity shall be as follows:
- April 15 - June 23 & September 5 - November 17, 7iO0 a.m. until 7:00 p.m., seven days a week.
June 3O thru September 1, work must end by 4:00 p.m. on Fridays.
November 13 - April L5,2007 work allowed within daylight hours only.
- Deliveries shall be restricted to the hours of 7:00 a.m. to 11:30 a.m. on Gore Creek Drive and 7:00 a.m.
to 8:30 a.m. on Bridge Street,

SHAFT ENCLOSURES
707.1 General. The provisions of this section shall aoolv to
vertical shafts where such shafts are required to proteci o;n_
ings.and penetrations through floor/ceiling and roof/ceilini as_
semblies-
707.2 Shaft enclosure required, Openings through afloor/ceiling assembly shall be protectedby a s1aft enclo'sure
complying with this section.
Exceptions:
I . A shaft enclosure is not required for openings totally
within an individual residential dwelling unit and
connecting four stories or less.
2. A shaft enclosure is not required in a buildins
equipped throughout with an automatic sprinklei
system in accordance with Section 903.3.1 .i for an
escalator opening or stairway which is not a portion
of the means of egress protected according io Item
2.1 or 2.2:
2. l. Where the area of the floor opening between
stories does not exceed twice the horizontal
projected area ofthe escalator or stairwav and
the opening is protected by a draft cunain and
closely spaced sprinklers in accordance with
NFPA 13. In other than Groups B and M, this
application is limited to openings that do not
connect more than four stories.
2.2. Where the opening is protected by approved
power-operated automatic shutters at everv
floor penetrated. The shutters shall be of
noncombustible construction and have a
fire-resistance rating of not less than 1.5
hours. The shutter shall be so constructed as to
close immediately upon the actuation of a
smoke detector installed in accordance with
Section 907.10 and shall completely shut off
the well opening. Escalators shall cease oper-
ation when the shutter begins to close. The
shutter shall operate at a speed of not more
than 30 feet per minute ( l52.4 mm/s ) and shall
be equipped with a sensitive leading edge to
arrest lts progress where in contact with anv
obstacle, and to continue its progress on re_
lease therefrom.
3. A shaft enclosure is not required for penetrations by
pipe, tube, conduit, wire. cable, and vents protected
in accordance with Section 712.4.
4. A shaft enclosure is not required for penetrations by
ducts protected in accordance with Section 712.4.
Grease ducts shall be protected in accordance with
the International Mechanical Code.
5. A shaft enclosure is not required for floor openings
complying with the provisions for covered malls or
atriums.
6. A shaft enclosure is not required for approved ma-
sonry chimneys, where annular space protection is
provided at each floor level in accordance with Sec_
tion 7 l7 .2.5.
7. In other than Groups I-2 and l-3, a shaft enclosure is
not required for a floor opening that complies with
the following:
7.1 . Does not connect more than two stories.
7.2. Is not part ofthe required means ofegress sys_
tem except a-Ii permitted in Section t 019.1 .
7.3. Is not concealed within the building construc_
tion.
7.4. Is not open to a corridor in Group I and R oc_
cupancies.
7.5. Is not open to a corridor on nonsprinklered
floors in any occupancy.
7.6. Is separated from flooropenings serving other
floors by construction conforming to required
shaft enclosures.
8. A shaft enclosure is not required for automobile
ramps in open parking garages and enclosed parking
garages constructed in accordance with Sections
406.3 and 406.4, respectively.
9. A shaft enclosure is not required for floor openings
between a mezzanine and the floor below.
10. A shaft enclosure is nol required forjoints protected
by a fire-resistant joint system in accordance with
Section 7l 3.

RESPONSES TO COMMENTS:
1. We have determined that the floor area of the unit will exceed 2000 s'f. and a second
exit will be required. The owner has decided to remove the door to the western most
bedroom on the entry level of his unit and convert this space into a family and
entertainment room. He will then install an exit door in the west wall of this space into the
common corridor. Refer to Drawings A-1A and A-2A.

The spiral stair in question is exactly like the one in Liftside Condominiums Unit A-72,
which was discussed and approved in a telephone conversation on 5-1 1-06. At that time
you had confirmed with Greg Denckla of your department, that the stair met the present
cooe.
It was not intended for this area to be a floor or walking surface. lt was our intention to
provide a shelf for shoes below the clothes hanging rod above. The shelf was to span
over the +/- 1'-8" wide x 4'-0" long void in the existing floor. We have raised the shelf to
be +l- 2'-6' above the floor and aligned with the adjacent duct enclosure. (Refer to Detail
No. 3 on Sheet 4-6). We hope that having shifted the shelf up that it will not be
considered a floor or walking surface. The following related details and interior elevations
have also been corrected to reflect this change. (No's. 2, 3 and 4 on Sheet A-3 and No's.
4 and 6 on Sheet A-7.
The flue in question actually passes below the shaft construction that surrounds the
elevator shaft vent, which extends from the face of the shaft to the roof, with the duct
starting approximately 5'-0' above the floor.
All of the new shaft construction has been identified on Sheet A-28. The existing shafts
located on Sheet A-1B represent field located shaft construction which we assume
enclose ductwork or plumbing lines that pass through this space from those below. lt
should be noted that BUILDING CODE NOTE NO. 4 on Sheet A-1A require the
Contractor to invite your Department out for a field inspection to identify code
deficiencies which were not apparent prior to demolition. These deficiencies would then
be corrected. The construction identified in Details 4lA7, 5lA7 and 6/47 surrounds
ductwork that provides heating and ventilation for this unit only and is connected to a fan
coilwith-in the unit
We hope that the above information and attached documents will answer all you questions,
resolve the outstanding issues and will allow you to release the building permit as soon as
oossible.
