The Town of Vail, is now collecting the parking fee due as a result
of your cornrnercial expansion. Since you do not have any on site parking
requirements, the Tovm assesses a fee, and revenues are used to help
pay for the parlcing stTuctures.
Your parking fee is calculated using the following inforrnation:
(See Section 18.52.00 of the Mrmicipal Code.)

inches thick consis-iing of th ree inches of dry wall and insulation
and six inches of concrete. A core would be put in the wall toenable f resh air to enter the f irep Iace. The f ireo lace would
haVe a unit -lo limif room air ava i lab le for combustion and a de-
vice for heat transfer. The ch i mney is a single unit Class A
iriple I ined sta in less stee I n ine incb Preway, The f inep lace
lvould be tied fo it with an adapter. Br ick and mortar wou ld be
used to aesthetically face the f irep lace.
I cons ide r this p roposa I a signif icant upgrade in safety and
ef f ic iency over the f reestand ing unit which was insta I led af thetime the co ndo was built in 1972 and has none of the f eatures nowrequi.red by the town of Vail building code.
Early. aPproval wou ld be appreciated since I have now scheduled
consturction dur ing the period l2 - l7 September at a t ime I can
retu rn to Vail f rom Vi ashington and mon itor the consfruct ion.
De lays beyond fhat f ime would be very diff icult for me to ac-

DESCRIPTION OF VAR
Bud Benedict representing the Antlers LionsHead has
requested a variance to add 430 sq, ft. of GRFA to the existing
Antler's bullding. The use of this space will be as employee
housing. The 430 sq, ft, wil-1 be an addition of three bedrooms
to an existing dwelling unit.
The Antlers building is currently in excess of its GRFA.
A parking variance i-s not required since no additlonal dwelling
units are being constructed and the 430 sq. ft, would resul.t in an
additional parking requirement of .43 of a space, which when rounded
out would result in no additional requirement.
CRITERIA AND FINDINGS
Upon review of Criteria and Findings, Section 18.62.060 of
the Municipat Coile, the Department of Community Development recommends
approval of the requested Variance based upon the following factors:
Consideration of Factors
The relationship of the requested variance to other
existing or potentlal uses and structures in the
vlci.nity.
Other buildlngs in the vicinity of the Antlers are close
to or in excess of the present GRFA requirement so they would be
required to go through the same process if they wanted to add
space for employee housing.
The degree to which relief from the strict or literal
interpretation and enforcement of a specified regulation
is necessary to achieve cornpatibility and uniformity of
treatment among sites 1n the vicinity, or: to attain the
objectives of this titLe without grant of special privilege.

With all the remaining units in the Antlers
owned by individual condominium owners, these units would not
be available for employee housing, We are encouraging the
provision of employee irousj-ng and are in the process of
discussing the lssuance of increased densities for its provision.
The effect of the requested vatj-ance on light
and aj,r, distribution of population, transportati.on,
and traffic facillties, public facilities and
utillties, and public safety.
We foresee no adverse effects on these factors.
Such other factors and criteri-a as the Commission
deems applicable to the proposed variance.
No other factors are found applicable.
Findings:
The Planning & Environmental Commissi.on sha11 make
the following findings before granting a variance:
That the granting of the variance will not
constitute a grant of special privilege incon-
sistent with the limitations on other properties
classified in the same district.

detrimental to the public health, safety,

Dear Diana:
Thank you very much for your letter of September 14,L977. I have spoken with Duane Carling who is doing the
remodeLing work on the Seibt Condominium and have advised
him of the contents of your letter. He has assured me that
he will obtain the required permits and will cooperate
ful1y with Mr. Pierce.
It has come Lo my attention that several condominium
owners in the Antlers Lionshead Condominium Unit have requested
and have been granted permission to enlarge the porches
adjoining their units. According to my information this
enlargement would increase the usable floor area by a
considerable amount. My clients are understandably dismayedat this action, especially in light of the denial by the
Town Board of permission for the Seibts to remodel theirunit. It may welt be that in your eyes the enlargement of
the porch area does not constiLute an enlargement of usablefloor space and therefore no variances required. Elowever,I have been asked by my clients to request from you a brief
explanation as to the granting of permission for the other
condominium owners to enlarge their porches.
Additionally, I have never received a copy of thewritten denial which was apparently issued by the Town Board
concerning Dr. and Mrs. Seibtsr request for a variance. It

shall indemnify Lessor against all liabilities' expenses, and

enclosed please find informption concerning Albi Fire
Retardant Coatings and Insul-Bl,aze Fire Retardant Coatings,
together with Building Materials Directory published by
Underwriters Laboratories. Dr. and Mrs. Seibt have made
an exhaustive attempt to find a coating suitable for cov-
ering the studs in their condominLum. My reading of the
inforrnatLon enctosed leads me to bel-ieve that either one
of these coatings would be satisfactory and would provide
the degree of protection required under the Uniforrn Build-
ing Code.
As I mentioned to yourDuane Carling of tsear
Construction Company will be fiirishing the remodelling

Plate Glass. The information concerns their fire-
retardant coating Speedhide 42-7. As you may recall,it is the Seibts I intention to use this fire-retardant
coating in lieu of repLacing the wooden studs with
concrete or metal studs.
I would ask that you take the time to review the
enclosed material and advise me at your earl-iest con-
venience as Fo whether this eoating will be acceptableto comply with the Uniform Building Code as enactedin the Town of Vai1.

FIRE.RETARDANT COAT'NGS
A f ire-retardant coating is intended lo delay ignition tor
aboul 1(F15 minules and reduce the surface burning rale
ot interior combustible finish materlals.
The coating may be apptied by trowel as a thick plaster
or by brush, spray or roller. The protection atforded is
generally proportional tb the thickness of application.
When exposed to high temperatures, intumescent-type
lire.retardant paints form an insulating blanket which re-
tards surtace ignition and reduces the burning rate of the
combustible substrate on the coated side.
These coatings are not intended as a substitute lor the
need of automatic sprinklers. Their use is particularly
applicable in low hazard areas having very limited com-
bustible materials.
Approved products are rscommended for use only over
those combustible surfaces on which they have been suc-
cessfully fir€ tested.. Some of the listed coatings will successfully preserve
the dimensional stability ot low-melting, combustibt€ cel-
lular plastics in addition to delaying their ignition tor't0-.|5

Bud Benedict, representing Dr. and Mrs. Ifolfgang P. Sei-bt, has
applied for a gross residential floor area (GRFA) variance in
order to a1low completion of loft area of approximately 210 sq.
ft. The existing Antlers is presently a legal non-conformlng
building; allowable GRFA is 41 ,400 and existing buildj-ng contains
51,216, With the addition of 210 more sq. ft. of GRFA, the
building i-s approximately 24% over the maximum allowable.
Ttrere are extenuating circumstances or hardship that should be
considered; however, they are of an economic nature which may
not be considered by the Planning Commi-ssion. The project was
started without a building permit by an unlieensed contractor.
The remodeling same to the atten'bion of the Building Inspector
who put a "Stop l{ork" order on the job. Before the "Stop l[ork"
order was issued, the contractor had completed most of the neces-
sary work and had been paid a substantial sum by the owner. The
loft area, as installed, does not meet Uniform tsuilding Code
requirements.
CoNSTDERATTON OF FACTORS (18.62.060)
1. The relationship of the requested variance to other
existing or potential uses and structures in the
vicinity.
The requested.variance wouLd make no modification to
the exterior of the building. There are 1O more identical units
in the Antlers building alone, rvhich could potentially add 2,500
additional square feet of GRTA if this variance were approved.
A number of other buildings in the Lionshead area have existing
loft areas which could be enlarged or high vaulted ceilings that
could a1low lofts to be added. 250 sq. ft. does not seem to be
a great deal of floor area; however, it is the approximate size
of a standard lodge room and multipLied by manl' similar GRFA
additions to short-term units. could mean additional people'
There have been no other GRFA variances granted for
short-term units, nor any GRFA variances granted in the Lions-
head area. The only GRFA variances ever granted have been for
making a long-term unit more liveable, and many others have been
den ied.

u.. ., interpretatlon and enforcement of a specifledregulation is necessary to achleve compatibility anduniformity of treatment among sites in the vicinity, -or to attain the objectives of this ordinance withoutgrant of special privilege.
. Due to the extent that this variance wil"l- exceed the GRFApermitted, we do feel that this would be a grant of specialprivilege. Denial of the variance would be necessary to achj-evecompatibllity and uniformity of treatment as no other GRFAvariances have been granted in the vicinity.
3. The effect of the requested variance on light andair, distribution of population, transportation andtrafflc facilities, public facilities and utilities.
We foresee no adverse impacts on these factors.
B. FINDINGS:
1. That the granting of the variance will constitutea grant of special privilege inconsistent with thelimltations on other properii-es calssj-fed in the samedistrict.

That there are not exceptional or extraordinarycircumstances or conditions applicable to the siteof the variance that do not apply generally to otherproperties in the sarne zone,. c. The strict or llteral i-nterpretation and enforce-
ment of thc speeified regulation would not deprivethe applicant of privileges enjoyed by the ownet'sof other properties in the same distric,t.

The only extraord.inary circumstance, or practical diffi-culty is a financial one and the Zoning Ordinance specifleally
states that "Codt or inconvenience to the applicant of strictor literal eomplriance with a regulation shall not be a reasonfor granting. a variance."
The Buil.ding Official has stated that in order to make
the constructio4 meet the Building Code, the entire new loft would
have to be removed and reconstructed using either steel or concreterather than wood as now exists.
The Department of Cormunity Development strongly reeom-
mends denlal of the requested variance on the basis that no
hardship exists.

Gentlemen:
We have completed our geotechnical studies for the Antlers
Condominium swinuning pool, Vail , Colorado' as outlined in our
let.ter dated June 14, 1977. Results of our field sLudies,
our opinions and conclusions are presented below.
We undersLancl , 20 by 4O-fooL spread footing founded swimn'ing
pool ancl surrounding redwood deck are planned. A retaining
waIl, which will support the north eclge of the redwood deck,
is planned between the existing Antlers Condominium and the
swimming pool . The southern portion of the redwood deck will
be supported by wing wa1ls cantilevered from the side of the
swimming pool, and the east and west portions will be supported
by a continuous spread footing. Location of the proposed
facil-ities is shown on Figure l and proposed deck, pool bott-om
and footing levels are shown on Figure 2, attached- If
completed designs vary from our understanding, we should be
advised to permit re-evaLuation of our recomnendations and
conclusions.
The swimming pool site is located south of the southwest
corner of the Antler Condominium Complex on a north to south
sloping hiLI. The site had been stripped of vegetation and
partially excavated prior to our field studies. A soft
bogSy area bordered the site to the west and south- The
site is located approximaLely 70 feet north of Gore Creek.
Provisions should be made to protect planned foundations from
undermining by high water in Gore Creek. No bedrock outcrops
were observed at the site.

At thc tinc of our field studies the pool and deck area had
been par:tia11y excavated into three benches. Man-made fi1l,
consist.ing of san<ls ancl gravels v,/as exposed at the bottom ofthe northernmosL bench at an approxi-mate elevation of 8092.Soils exposed across the bottom of the other two benches, atelevations of aplrroximately 80BB and B0B4 were soft clayeypeats. Our test holes dri.lled just to the east of the excavation
showed 5 feet of man-made fill and 6 feet of dense sandygravels over medium dense very clayey sands to the maximum
depth drilled of 24 feet. Our test pits excavated from the
lowest bench 1evel showed from 3 to 4 feet of very soft,
clayey peat over: mcdium dense very clayey sands. Test pits
excavated upslope of the proposed swimming pool site beneaththe Antler Condomjnium for Woodward-Clevenger & Associates,fnc. (our predeccssor firm) report No. L5744, dated
February 4, I97?., showed a thin layer of topsoil and up to
3 l/2 feet of man-macle fill over from 2 l/2 Lo 3 feet ofloose. clean to silty gravelly sands underlain by dense
sandy, cobbly gr.rvels.
The man-made fil.1, consisting of gravelly silty sands appearedto be erratic in density. We have no information on how thisfill was placed. The very soft clayey peat witl settle uponloading causing greater than "normal" movement of foundaLions
pl.aced thereon- We do not believe the man-made fill or cl-ayeypeat will support foundations and recommend they be removed
beneath planned footings and pool bottom. The dense sandygravels and the medium dense, very clayey sands found beneaththe man-made fil-1 and the peat should support foundations
designed for moderate loads.
Free water was found at depths of from 4 to 5 feet in ourtest ho1es, and at depths of 2 to 4 feet in our test pits.
Dewatering wi1l, in our opinion, be necessary to completeconstruction in the dry. We believe the most practi,cal
dewatering mcthod, considering the limi.ted area to be
dewatered, would be pumping from sumps or collector ditchesat the botLom of the excavation.

on the natural sands and gravels or on structural fillreplacing the existing man-made fill and the very soft peat
should be designed for a maximum soil pressure of 3,000 psf,controlled by the weaker medium dense, very clayey sands.If higher design pressures are desired, they may be obtainedby placing the footings on a minimum of 3 feet of structuralfil1. Footi.ngs placeil on such fill may be designed for a
maximum soil pressure of 5,000 psf provided the pressur€: .n
the underlying natural sands and gravels, calculated as
shown on Figure 3, does not exceed 31000 psf.

100 percent of maximum density (ASI'M D 698). To facilitate
compaction of the structural fill at the bottoms of
excavations in areas presently below the water table, we
suggest sands and gravels used as structural fill be asclean as possibJ.e (containing less than 5 percent minus
#200 sieve size soils) and be compacted with a vibratorytype rolIer. We should continuously observe structural fill
placemenL.

We understand a retaining wa11 will be constructed approxi-mately 25 feet south of the existing condominiums, beLweenthe pool area and the condominiums. The l-ateral pressure
on retaining wa11s depends upon the type of backfilI, theheight of the retaining wall, hydrostatic pressure behindthe waI1, influence of adjacent foundations and tolerable
wa11 movement. "Active" earth pressures may be assumed forwall design if sufficient wall movement to develop the shearstrength of the backfill soil can be tolerated with theassociated cracking and settlement of the ground surface
behind the wall-. fn the case of retaining walls where
movement is restricted, !,re suggest they be designed for "atrest" Iateral earth pressures which assumes no wall movement.

an "active" pressure coefficient (Xa) of 0.28 or an "at rest"
pressure coefficient (Ko) of 0.5 and a soil unit weight of
125 pcf in designs. We recommend a triangular pressure distri-
bution be used. Hydrostatic pressure and surcharge should be
added where applicable. Operation of heavy rollers should be
avoided within 5 feeL of wa11s to reduce wall movements.
Hydrostatic pressure could be eliminated by provi,ding a r.J.ean,
free-draining sand and g,ravel drain adjacent to the wal ls'
connected to a positive gravity outfall or pumped sump.
Wetting of foundation soils always causes some degree of
volume change in the soils and should be prevenled during and
aft-er construction. Methods of doing this include compaction
of impervious backfill around foundations, provision of an
adequate grade for rapid runoff of surface water away from
the faciliLies and discharge of roof downspouts and other
water collection systems well beyond the limits of the
backfilf, as well as other usual precautions which may be
indicated during design and construction.
Exploratory data presented herein were collected to help
develop designs and cost estimates for this project and thus
have limited value for indicatinq conditions for contractor
bidding or construction. If it Is necessary to portray
underground conditions well enough to enable contractors to
more accurately evaluate conditions for bidding and execution
of work, then we recommend considering exploratory work
designed for that purpose after the affecteld designs are
essentially finalized.
Professional judgments on design alternatives and criteria
are presented in this report. These are based partly on our
understanding of the characteristics of the facility being
planned and partly on our general experience with subsurface
conditions in the area. We do noL guarantee the performance
of the project in any respect, only that our engineering work
and judgments nendered meet the standard of care of our
profession.
Test holes drilled for this study were spaced to obtain a
reasonably accurate picture of subsurface conditions for
design purposes. Variations from the conditions portrayed
which were not indicat.ed by the test holes frequently occur.
